26- Warranty and Acceptance:

By signing this application form, the applicant warrants that it has or will in a timely manner obtain all
necessary licenses and authorizations to enable it to undertake the project.
The applicant further warrants that it has informed itself fully of all matters related to the submission of this
application and, without limiting the generality of the foregoing, that it is aware of all rules and regulations
and all technical, legal and financial requirements related to this application.
The applicant hereby accepts KAHRAMAA Standard terms (including the Conditions as stated in this
Application form), current Tariffs, deposit, bonds, and fees which are subject to change from time to time by
KAHRAMAA at its sole discretion.
The applicant further agrees that KAHRAMAA's rules and regulations shall govern the design, construction
and, operation & maintenance of the Connection Equipment (as defined in KAHRAMAA's standard PWSA)
and that the applicant shall abide by KAHRAMAA's wiring regulations, applicable KAHRAMAA Codes &
Regulations and rules related to design, construction, Operation & Maintenance of its internal network.

Conditions:

1. No customer is allowed to generate its own demand or export to third party without prior permission from
KAHRAMAA.
2. KAHRAMAA does not provide any warranty, express or implied as to the reliability, quantity and quality of supply
arising out of customer’s or third party’s defects and in all cases KM is not responsible for any damage or losses.
3. All designs and implementation of Customers project & connection schemes to KM system must be carried out
under supervision and responsibility of a professional engineering consultant and shall at all time be in
conformance with KAHRAMAA's specifications, rules and regulations.
4. KAHRAMAA, at its sole discretion, may conduct investigations for proposed supply of more than 5 MW of power
and/or 25 m³/hour (0.132MIGD) of water.
5. KAHRAMAA has the right to reject applications for temporary supply of power and/or water during construction
work. KAHRAMAA also has the right to reject applications for supply of Irrigation, Cooling, Fire Protection & Other
(excluding Potable Water) water during construction work.
6. If a customer suspends or terminates his project after securing commitment to supply from KAHRAMAA through
this application, then the customer must notify KAHRAMAA immediately in writing of the suspension / cancellation.
In this case the customer is obliged to pay KAHRAMAA for any non recoverable costs and to take the
responsibility for any commitments results from his suspension / cancellation decision.

7. In case of conflict between customer's project sites &/ routes and KAHRAMAA existing and/or future sites and/or
routes, the customer shall be responsible for the cost of any relocation of KAHRAMAA existing installations and
obtaining the alternative sites and/or routes for future and/or relocated installations which are in conflict with his
project sites and/or routes.
8. Customer/s with Heavy industrial developments, whose maximum demand exceeds 5 MW of power and/or 25
m³/hour (0.132MIGD) of water , is/are required to (i) deliver a signed PWSA (Power and/or Water Supply
Agreement) using KAHRAMAA standard terms to KAHRAMAA's 3 years prior to the proposed date of supply (this
is condition which must be met prior to any supply commitment being given by KAHRAMMA) (ii) enter into a
Power and/or Water Supply Agreement (P{W)SA) with KAHRAMAA, using KAHRAMAA standard terms, 18
months prior to the proposed commissioning date and the connection equipments will be subjected to the following
conditions:
a) If the heavy industrial customer elects (subject to Kahramaa’s prior written approval), to provide the
Connection Equipment (as defined in standard PWSA, then the Connection Equipment shall comply with
KAHRAMAA's standard specifications and technical requirements. On completion of construction and
warranty period, ownership of the Connection Equipment shall be transferred to KAHRAMAA at no cost to
KAHRAMAA but subject to payment by customer of applicable fees less any verifiable & justified actual cost
of Connection equipment paid by the customer.
b) KAHRAMAA shall be responsible for the operation and maintenance of the Connection Equipment (as
defined in standard PWSA).
9. Disconnection: In the event of a Purchaser Default in making payments for product above, KAHRAMAA may serve a notice
of disconnection to the Purchaser advising the Purchaser that, if payment in full is not received within Thirty (30) days of the date
of delivery of this notice, supply of Product will be stopped on expiry of the Thirty (30) day period. If the Purchaser has failed to
make payment in full before the expiry of the thirty (30) days period, then KAHRAMAA may, at any time thereafter and without
further notice to the Purchaser, stop supply of Product until payment of all outstanding monies is made, without any right of
compensation by KAHRAMAA to the Purchaser.
