AFFIDAVIT
OF DESISTANCE
I, GAVINO BACOR LACSADO JR, Filipino, of legal age, married and a
resident of Barangay San Isidro, Labangan, Zamboanga del Sur, after having
been duly sworn to in accordance with law, hereby depose and state, THAT:

1. I am the private complainant in a criminal complaint for Libel against

MERLY A. PASCUAL & ALLAN ABAD, now pending before the Provincial
Prosecution Office, Zamboanga del Sur and docketed as IS CASE NO. IX- 09-
INV- 161- 00454;

2. At the time of the filing of the said case, I was overwhelmed by my emotion
and all that I had in mind was to avenge the seeming affront against my pride so
that I had nothing in mind but to cause them vexation;

3. I have come however to the realization that it would be unjust for me to

pursue a criminal complaint against MERLY A. PASCUAL & ALLAN ABAD,
knowing the fact that I do not have personal knowledge of the ultimate facts and
circumstances of the case that will support the charge against them, so that I have
decided to desist from further pursuing the case and withdraw the same;

4. I and the respondents have likewise come to terms and have agreed to
mend our relationships, we being long-time acquaintances, and we intend to
pursue our harmonious relationships with one another, with the thought that we
would have peace of mind in pursuing our individual endeavors; we have
therefore agreed to amicably settle the case and forget forever whatever lapses we
have caused;

5. I am executing this Affidavit of Desistance to attest to the fact that I and

the respondents have amicably settled this case and that I am no longer
interested of testifying in court against them. Likewise, all the foregoing
allegations are true and based on my personal knowledge.

TO THE TRUTH OF THE FOREGOING, I have hereunto affixed my

signature this 10th day of October 2016, at Pagadian City, Philippines.
