COMPLAINT-AFFIDAVIT
I, ANDY S. SANTOS, Filipino, of legal age and a resident of 375 Tramo St.,
Pasay City, after having been duly sworn to in accordance with law, do hereby
depose and state that:
2) On June 22, 2010 at around 7 p.m. , I went to Alarcon’s house to talk to him
regarding some problems at the Pasay City tricycle terminal. We are both
members of the tricycle drivers’ association. However, Alarcon upon seeing me,
got mad and asked me to leave.
5) The incident was referred to the barangay for conciliation proceedings but no
settlement had been reached as Alarcon failed or refused to obey the summons
sent to him. Hence, I was issued a certificate to file action by the barangay.

COUNTER-AFFIDAVIT
I, Luis C. Alarcon, Filipino, of legal age with postal address at of No. 30 Taylo St., Pasay
City, after having been duly sworn to in accordance with law, do hereby depose and
state that:
1) I am the respondent in the above-captioned case for slight physical injuries filed
by one Andy S. Santos.
3) The following day, I was informed that Santos fell down on the pavement as a
consequence of which he sustained physical injuries.

RESOLUTION
Complaint allege that on June 22, 2010 at 7pm, more or less at Tramo Street Pasay City,
respondent suddenly boxed the right side back portion of complainant’s head without no reason
at all. Thereafter, Respondent desisted and left. However, the complainant sustained an injury
that required medical treatment of less than nine (9) months. After carefully reviewing the
records of the foregoing complaint, the undersigned prosecutor finds that the allegations of the
complaint bore out the crime of Slight Physical Injury. Respondent’s manner of attacking the
complainant from behind and then for him to voluntary leave the latter are external
manifestations that fell short of intent to kill, so that, a Frustrated Homicide can be filed.
Moreover, there is also no basis to consider any stages of the crime of homicide since the
respondent, without performing all the acts of executions, voluntarily desisted in pursuing his
physical assault against the Complainant.
Nevertheless the complaint was able to substantiate that Complainant suffered injuries as a result
of the attack done by the Respondent and which requires the healing period of less than nine (9)
days and which constitute the criminal act of slight physical injury

WARRANT OF ARREST
The act of your neighbor in inflicting injuries upon you which required medical
attendance for seven days amounts to slight physical injuries which is penalized under
Section 266 of the Revised Penal Code (RPC)
The penalty for slight physical injuries is arresto menor or imprisonment from one
day to thirty days. As such, you shall first need to bring your complaint against your
neighbor before your barangay for conciliation. Barangay conciliation is a form of
dispute settlement that gives the parties an opportunity to peaceably settle their
disputes without going to court. If you and your neighbor failed to reach a settlement,
you will be issued a certificate to file action, after which, you may file a complaint before
the Office of the Prosecutor of the place where your neighbor punched you. You need to
attach in your complaint the medico-legal slip to prove the extent of the injury you
sustained and your certificate to file action.

INFORMATION
That on or about 22 June 2010 at about 7 o’clock pm, in the Pasay City and within the
jurisdiction of this Honorable Court, thesaid accused did there and then willfully,
unlawfully and feloniously, and withoutjustifiable cause therefor, attach, assault, and
beat one MARCO POLLO, striking himon the head and arms, thereby inflicting the latter
physical injuries, which haverequired medical attention for a period of five days, and
have incapacitated himfrom labor and studies for the same period of time.
