PETITION

PETITIONER, through the undersigned counsel, unto this Honorable

Court, most respectfully alleges – THAT:

1. Petitioner, JEAN COLIS VALLESPIN, Filipino, of legal age,

single, and a resident of Purok 1, Brgy. Bubon, Butuan City, who
can be served with the Court’s notices and other legal processes
through the undersigned Counsel at Purok 13, Brgy. Poblacion,
Prosperidad, Agusan del Sur.

2. The MUNICIPAL LOCAL CIVIL REGISTRAR OF

PROSPERIDAD is being impleaded as required by law, which
holds office at the vicinity of Municipal Hall, Brgy. Poblacion,
Prosperidad, Agusan del Sur, where it may be likewise served with
summons and other legal processes of this Honorable Court.

 3. Petitioner is the youngest of the eight children of Spouses
ANTONIO D. VALLESPIN and ESTRELLANA R. COLIS
(deceased) who were married on May 20, 1999.

4. Petitioner was born on January 13, 1999 at their residence house in

Brgy. Los Arcos, Prosperidad, Agusan del Sur, through the help of
a local “mananabang”. Thus, she was born when her parents were
not yet married.

5. The facts of Jean’s live birth were registered late. Her mother
registered her facts of birth before the Municipal Civil Registry of
Prosperidad, Agusan del Sur only on August 1999. It can be
readily seen in the same document that the then Municipal Local
Civil Registrar, Cerina D. Gallocanta, affixed her initials on top of
Jean’s surname which she wrote as “COLIN” and with no middle
name attached to Jean’s name. This is evidenced by her Certificate
of Live Birth issued by the Philippine Statistics Authority (PSA).
Hereto attached is a PSA copy of the said Certificate of Live Birth
marked as Annex “A”.

6. All along, Petitioner thought that her surname is “VALLESPIN”

and her middle name is “COLIN” because her parents were
already married at the time her record of birth was registered. She
even kept her record of birth issued by the Municipal Local Civil
Registrar of Prosperidad to her mother. Hereto attached as Annex
“B” and “B-1” is a copy of the said Certificate of Live Birth.

7. Moreover, Petitioner’s father had acknowledged paternity on

Jean’s record of birth as evidenced on page 2 (Annex “B-1”) of
Jean’s record of birth both issued by the PSA and the Municipal
Local Civil Registrar.

8. Presently, Petitioner is residing in Butuan City and desired to work

abroad. Worse, when Petitioner secured a copy of her Certificate of
Live from the PSA, she confirmed on her Certificate of Live Birth
which bears no middle name and a surname which is supposed to
be her middle name.

9. The Certificate of Live Birth of Petitioner issued by the PSA,

therefore, contains substantial error. The error pertains to the
absence of Jean’s middle name and her surname which is supposed
to be her middle name.

10. Since Petitioner was legitimated by the marriage of her parents,

her father’s surname and middle name should have appeared in
her record of birth.

 11. On the contrary, Petitioner has been publicly known as JEAN
COLIS VALLESPIN as evidenced on her School Record and
other public records. Hereto attached are copies of her School
Record and Barangay Certification as Annexes “C” and “B”,
respectively.

12. For these reasons, Petitioner humbly prayed before this Honorable
Court that her record of birth be corrected to reflect her true name.

PRAYER

WHEREFORE, premises considered, it is most respectfully prayed

of this Honorable Court that, after due notice, publication and hearing, an
order be issued DIRECTING the Office of the Municipal Civil Registry of
Prosperidad, Agusan del Sur to CORRECT the surname of Petitioner as
“VALLESPIN” and her middle name be indicated as “COLIS” and
accordingly INFORM the Philippine Statistics Authority of these substantial
corrections to reflect her true and rightful surname and middle name.

Further, petitioner prays for such other reliefs found just and equitable
under the premises.

and a resident of Purok 1, Brgy. Bubon, Butuan City, after having
been duly sworn to in accordance with law, state - THAT:

1. I am the Petitioner in the above-entitled case;

2. I have caused the preparation and filing of this Petition;
3. I have read the foregoing Petition and that the allegations
therein are true and correct of my own personal knowledge and
based on authentic records;
4. I further certify that I have not commenced any other action or
proceeding involving the same issues in the Supreme Court,
Court of Appeals or any other court, tribunal or agency and to
the best of my knowledge, there is no action or proceeding
involving the same issues pending before the Supreme Court,
Court of Appeals, or any other court, tribunal or agency. Should
I learn thereafter that a similar action or proceeding has been
filed or is pending before the Supreme Court, Court of Appeals,
or any other court, tribunal or agency, I hereby undertake to
report the fact within five (5) days therefrom to the Court,
where the foregoing Complaint has been filed.
