This revision is filed challenging the order of taking
cognizance, i.e. issuance of process against applicant in R.C.C.No.
135/2017,   passed   by   the   Judicial   Magistrate,   F.   C.   Saswad.
Pending   hearing   of   the   main   application,   this   is   an   interim
application for stay of the proceeding. 

[2] Heard   learned   Advocate   Mr.   Khandagale.   He   by

taking me through the complaint filed in the trial court, order
passed by the trial court and the other documents, including the
notice issued by complainant to the petitioner / accused argued
that accused is a reputed person in the Taluka and was the past
President of Zilla Parishad, Pune and out of the dispute regarding
sale   of   agricultural   land,   false   complaint   is   filed   against   the
applicant.   He   submitted   that   having   regard   to   the   averments
made   in   the   complaint,   it   is   highly   improbable   that   a   person
having such a background would commit the offence alleged. He
also submitted that there was no material before the trial court
for enabling it to issue process. 

[3] Considering the material placed before me, I pass the
following order. 
  ORDER

[1] The operation of the order of issuance of process /
taking cognizance, passed by Judicial Magistrate, F. C. Saswad
dated 08­05­2018 in RCC No. 135/2017 is stayed till next date. 
[2] Issue   show   cause   notice   to   respondents,   why   the
interim stay granted shall not be made final till the disposal of
the revision petition, notice returnable on 16­10­2018.
