COMMITTEE REPORT

NAME OF COMMITTEE : COMMITTEE ON ORDINANCES AND LEGAL MATTERS

SUBJECT: ORDINANCE NO. 1, SERIES OF 2018 OF BRGY. YAKAL ENTITLED

“AN ORDINANCE PROHIBITING THE DRINKING OF ALCOHOLIC AND
INTOXICATING LIQUOR IN PUBLIC PLACES WITHIN THE
TERRITORIAL JURISDICTION OF BRGY. YAKAL, CATARMAN,
NORTHERN SAMAR, AND PROVIDING PENALTIES FOR VIOLATION
THEREOF. ”

The Committee on Ordinances and Legal Matters to which was referred the
abovementioned subject had considered the same and has the honor to report it back to this
August body with the following facts, findings and recommendations:

1. That the Committee on Ordinances and Legal Matters is in receipt of a referral the
subject of which is ORDINANCE NO. 1, SERIES OF 2018 OF BRGY. YAKAL ENTITLED “AN
ORDINANCE PROHIBITING THE DRINKING OF ALCOHOLIC AND INTOXICATING LIQUOR IN
PUBLIC PLACES WITHIN THE TERRITORIAL JURISDICTION OF BRGY. YAKAL, CATARMAN,
NORTHERN SAMAR, AND PROVIDING PENALTIES FOR VIOLATION THEREOF. ”

2. That the subject ordinance is in congruence with the General Welfare Clause embodied
under Section 16 of the Local Government Code of 1991, which include the exercise of
the power necessary, appropriate, or incidental for its efficient and effective governance
and those which are essential to the promotion of the general welfare.

3. That the smallest LGU or the barangay should lead by example to disallow their
residents from drinking in the streets.

4. That drinking in public places causes disturbance, inconvenience, fights and riots and
injuries.

5. That the subject ordinance imposes justifiable penalties for violators which will
discourage drinking in public places.

 Recommendations:
Based on the foregoing facts and findings, the Committee hereby pronounces that the
ordinance is valid and in consonance with the existing laws.
