3. FRAUD

Article 33. In cases of defamation, fraud, and physical injuries a civil action for damages, entirely separate and distinct from
the criminal action, may be brought by the injured party. Such civil action shall proceed independently of the criminal
prosecution, and shall require only a preponderance of evidence.  
• Court has ruled that Estafa falls under fraud in Art. 33 
CASES 
HEIRS OF SIMON v ELVIN CHAN 
FACTS: 
• Office of the City Prosecutor filed an information charging Eduardo Simon with a violation of BP 22 
• Three years later, Elvin Chan commenced a civil action for the collection of the principal amount of 336K 
• MTC dismissed the complaint 
• RTC affirmed MTC 
• CA reversed RTC Decision 
ISSUE/HELD/RATIO: 
1. W/N an independent civil action to recover the amount of the unfunded check will lie 
HELD: NO 
• There is no independent action to recover the value of a bouncing check issued in contravention of BP 22 
• Sec. 1(b) Rule 111 of the Rules of Court states that the criminal action for violation of BP 22 shall be deemed to
necessarily include the corresponding civil action 
• Rule states the inclusion of the civil action in the criminal case of BP 22 
• NO RESERVATION to file such civil action separately shall be allowed or recognized 
• Complainant must pay in full the filing fees based on the amount of the check involved 
• The provision of the ROC, although not yet in effect when Chan commenced the civil suit on Aug. 3, 2000, is NONETHELESS
APPLICABLE 
• Retroactive application of procedural laws does not affect any right of a person who may feel adversely afected 
• GENERAL RULE: No vested right may arise from procedural laws except in criminal cases when such changes to the
rules permit or require a lesser quantum of evidence to convict than what was required at the time of the
commission of the offense (it would be an ex post facto law otherwise) 
• Any new rules may validly be made to apply to cases pending at the time of their promulgation 
• Moreover, the new rule was adopted from SC Circular 57‐97, which took effect Nov. 1, 1997, before the suit was
commenced 
• The rule regarding the non‐allowance of reservation of civil actions arising from BP 22 , as well as the payment of docket
fees was: 
• Enacted to help declog court dockets which are filled with BP 22 cases 
• Creditors actually use the courts as collectors 
• Ordinarily, no filing fee is charged in filing criminal cases for actual damages 
• Payee/Collector uses the intimidating effect of a criminal charge to collect his credit, and sometimes the trial
court is not even informed that he has been paid already 
• Expected to expedite the disposition of BP 22 cases 
• Instead of instituting two separate cases, only a single suit will be filed and tried 
• Costly, burdensome, and time consuming  for both parties 
• Distinction between filing a case for Estafa and one for BP 22 
• Issuance of a bouncing check may result in TWO SEPARATE and DISTINCT crimes of estafa and violation of BP 22, the
procedures for recovery of the civil liabilities arising from these two distinct crimes are different and non‐
interchangeable 
• Estafa: offended party may opt to reserve his right to file a separate civil action OR he may institute an
independent action based on fraud pursuant to Art. 33 
• BP 22: No separate civil action to claim civil liability arising from the issuance of the bouncing check
