In summary I was told the following: On 1/24/2017, at approximately 0005 hours, Senior Deputy Roach and Deputy Calvert were travelling southbound on highway 101 in a Sheriff's patrol unit. They initiated a traffic stop on a 2017 silver Cadillac being driven by the decedent, who was the sole occupant. Deputy Calvert approached the driver side window as Sr. Deputy Roach approached the passenger side. The decedent, while seated in the driver seat, was yelling out the driver side window, “just shoot me” and “I want you to kill me”. Sr. Deputy Roach then saw the decedent draw a firearm and start to move the firearm towards Deputy Calvert. Both Sr. Deputy Roach and Deputy Calvert fired multiple rounds from their handguns and into the passenger compartment of the decedent’s vehicle. Sr. Deputy Roach and Deputy Calvert backed away from the decedent’s vehicle and awaited additional resources before checking on the decedent On 1/24/2017, at 0035 hours, the decedent was declared deceased. After the death scene had been photographed and evidence around the vehicle had been collected by Forensic Specialist Jones; Sergeant Wells and I examined the decedent. ‘The decedent was seated in the driver seat not wearing a seat belt. The decedent’s upper torso and head were leaned to the right, over the center console. Prior to my arrival the decedent's firearm had been moved from his lap to the roof of his vehicle. Sergeant Wells and I then removed the decedent from the vehicle and placed him on a white sheet, before placing him in a body bag. The decedent was then placed in my vehicle and transported to the Coroner’s Office. I arrived at the Coroner's Office at approximately 0626 hours. On 1/24/2017, at approximately 0700 hours, Sergeant Wells assisted me with photographing and removing the decedent’s clothing. The decedent was wearing a gray plaid hooded jacket, long sleeve thermal shirt, long sleeve athletic shirt, blue jeans, blue plaid boxers, gray socks and tan slip on shoes. The decedent's black framed eye glasses were also recovered from the body bag. The clothing and eye glasses were secured in the Coroner’s Office forensic drying cabinet. Inside the decedent's right shoe I found a small plastic bindle with an unknown white powder. Inside the decedent’s pants pockets I located a black wallet with miscellaneous cards, lighter. folding knife and $775 in U.S. currency. Two expended bullets were recovered from the decedent’s shirt and individually packaged, One bullet fragment was found under the decedent’s 2 Coroner Case #17997 Decedent: Gallardo, Josue back, another bullet fragment was found near the decedent’s feet. ‘The two bullet fragments were also individually packaged Once the decedent's clothing was removed I observed 12 gunshot wounds. The entry and exit wounds were later identified at autopsy. Refer to Final Autopsy Report On 1/24/2017, at approximately 1016 hours, Detective Zuchelli and I met with the decedent's | ee | her work, os tT Paso Robles, CA. After I notified] lof the decedent's death, she spoke with Detective Zuchelli and me about the decedent. I summary, SM’ stated the following: [recalled that on 1/19/17, she received flowers and a card, at her work, from the decedent. The note on the card said goodbye and included suicidal ideations. ‘The note mentioned that the decedent was ready to kill himself, that he could not live anymore and wanted to end his life. [MII was unable to provide us with this card, as she could not find it, On 1/20/ a - several emails from the decedent. One email included a photograph of the decedent holding a gun to his head. Concerned about the emails and the note she had a the Paso Robles Police Department. received 1 phone calls from an unknown number that she the decedent, Dut did not answer the calls. RR clic ved that the decedent had been suicidal in the past. One incident was documented on 6/23/16 when the decedent was arrested for domestic violence and had reportedly held a knife to his own throat, stating that he was going to kill himself. Reference SLOSO case #1606-05355 On 1/23/17 believed ws At the conclusion of the interview With] she requested that the Sheriff's Office not release the decedent’s name to the media until 1630 hours; to allow her time to pick up her children. I then left and returned to the Coroner's Office. On 1/24/2017, at approximately 1435 hours, Detective Walker and I collected fingernail clippings (right and left hand), hair samples (head, chest and pubic) and DNA swabs (control, face, neck, back right hand, palm right hand, back left hand, palm left hand) from the decedent. The fingernail clippings, hair samples and DNA swabs were individually packaged and sealed. On 1/24/2017, at approximately 1645 hours, Detective Walker and I transported the decedent to French Hospital San Luis Diagnostic Center for a full body CT scan, This scan includes the decedent’s body from below the knees to the top of the head. I later reviewed the CT interpretation by Dr. Vernacchia, M.D. and incorporated it with this file I ordered an autopsy be performed on 1/25/2017. Forensic Pathologist Dr. Walter examined the decedent at the Coroner’s Office. Forensic Specialist J. West photographed the decedent during this autopsy. I provided Dr. Walter with information about the incident and he reviewed the records I had obtained as of this date. Upon completion of the autopsy, Dr. Walter provided a cause of death as Exsanguination (minutes), due to Multiple penetrating/perforating gunshot wounds (minutes).
