FORM IV: Declaration

By participating in The Freedom Memorial Museum Design Competition of the Human Rights
Violations Victims’ Memorial Commission (MemCom) and submitting our work we declare
the following:
1. We accept all competition conditions without any reservation, qualification or
exclusions;

2. We declare and affirm that:

a. We are the creator and owner of all the materials , work or creation submitted
to the MemCom;
b. We are not violating any third-party rights in the submission of any materials,
work or creation;
c. We consent for use by the MemCom of all the materials, work or creation
submitted without any fee or other form of compensation;

3. We waive any and all claims against the MemCom which may result from the
participation in The Freedom Memorial Museum Design Competition;

4. We agree that all the submitted materials in all stages of the competition will become
the property of the MemCom;

5. We agree that the MemCom shall have the copyright over the work or creation of the
participants in all stages of competition. Including but not limited to economic rights,
such as to publish, reproduce, display, and the right to control the erection of any
building which produces the whole or any substantial part of the said work;

6. We agree that the MemCom shall have the right to modify the designs submitted,
without altering them in a way prejudicial to the participants’ reputation;

7. We agree that the Memorial Commission shall have the unlimited right to publish,
reproduce, display, exhibit and otherwise use all submissions, work, creation and
materials through any means of communication, including but not limited to
publication, presentation, display and electronic posting;

 8. We agree to indemnify, defend and hold the MemCom, its officials, officers,
employees, agents and all other persons acting on behalf of the MemCom free and
harmless from any and all claims, costs, damages, liabilities, including reasonable fees,
arising out of or in connection with the creation and/or use of submitted materials for
any purpose including but not limited to infringement of any intellectual property rights
alleged by us or any persons or entities;

9. We agree that the MemCom shall have no obligation to implement or use any of the
competitors’ work;

10. We agree that the MemCom does not have any responsibility for lost or damaged entries
or those that do not arrive by the deadline date;

11. We acknowledge that the Memorial Commission reserves the right to refuse any entry
in The Freedom Memorial Museum Design Competition and to disqualify any entry for
non-compliance set forth by the MemCom.

TERMS AND CONDITIONS

The following terms and conditions are set forth by the Human Rights Violations Victims’
Memorial Commission (MemCom) for the conduct of The Freedom Memorial Museum Design
Competition

Copyright
1. Upon submission of entries, the competitor waives his/her rights over all the
materials submitted and it shall become property of the Memorial Commission;

2. The MemCom shall have the copyright over the works/creation submitted by each
team in all stages of the competition. Including but not limited to all economic rights
such as to publish, reproduce, display, and the right to control the erection of any
building which produces the whole or any substantial part of the said work.

3. The MemCom shall also have the right to make any modifications in the designs,
without altering them in a way prejudicial to the competitor’s reputation.

4. The competitor shall retain the moral rights over their work/creation, including
moral rights of attribution and integrity provided for under R.A. 8293 (Intellectual
Property Code of the Philippines)

5. The Memorial Commission shall have no obligation to implement any of the

competitors’ works.

6. Philippine copyright laws shall apply including Intellectual Property Code of the
Philippines.

Awards and Prizes

1. All awards and prizes shall be subject to 20% Final Tax in accordance with B(1)
Sec. 24 and A(2) Sec. 25 of Republic Act 10653 (National Internal Revenue Code
of 1997)

 2. All awards and prizes shall be divided equally among team members and shall
receive it in check under individual team member’s name. In case he or she cannot
receive personally there must be a Special Power of Attorney in favor of his/her
representative.

3. The five (5) Top Teams shortlisted who shall receive the Php 250,000.00 award are
required to participate in the final stage of the competition and submit all required
materials. If they fail or refuse to participate they must return the full amount
received within fifteen (15) days from commencement of the Final Stage without
the need of demand.
