Rent Agreement
This Agreement is made and entered into on Wednesday, the ………, 2019, which shall
be effective from …………, 2019 (“Agreement”), between :
Mr xxxx s/o xxxxx, r/o xxxxxx hereinafter called “Owner” (which expression shall wherever
the context so requires or admits, mean and include her heirs, executor, administrator and assigns)
of the First Party.
AND
Mr xxxx s/o xxxxx, r/o xxxxxx, hereinafter called “Tenant” (which expression shall
wherever the context so requires or admits, mean and include its successors and assigns) of the
Second Party.
WHEREAS THE Owner is the Owner of the Flat No. xxxxxxx at xxxxxx (full address)
consisting of three Bed Room, One Dining Room, One Drawing Room, with attached Three
Toilets, One open Kitchen, Two Balconies, One , &one Car parking (herein after referred as
“said Premises”);and
WHEREAS the Tenant is desirous of taking on Rent the said Premises on terms and conditions
hereinafter appearing.
1. The Owner hereby agreed to demise unto the Tenant the said Premises together
with all fixtures, tube lights and fans as mentioned at Annexure “A” to hold to the
Tenant for a term of 11 months from [date] to [date] (“Rent Period”) paying
thereof rent at the rate of Rs.[Amount] /- (Rupees xxx only) per month (“Rent”)
. The Tenant shall pay the maintenance charges, electricity, diesel, gas and other
incidental or any other charges of the said flat directly to the concerned authority
and shall provide copy of such payments made to Owner immediately. After expiry
of this Rent Period and if the Rent Period is extended after 11 months then the
monthly Rent will be increased by 10% in monthly Rent, subject to discussion with
other terms and conditions remaining unchanged .
2. The Tenant to the intent that the obligation hereby created shall continue throughout the
terms of the Rent Period, hereby covenants with the Owner as follows:
a) To pay the Rent for each month in advance on or before 1st of every
current English Calendar month in the following manner. Draft/Cash of
INR [amount /- (Rupees xxxx only). Failure to pay by 5th of each month,
the Tenant will be liable to pay interest @ 18% p.m. on the payable amount.
c) To pay the maintenance charges as per actual on monthly basis to the society
including any other charges applicable, as per society norms.
d) To keep the interior of the said premises clean, tidy and maintain in good
condition and to be responsible for the ordinary routine maintenance of the
fitting and fixtures in the said Premises.
e) Not to make any alterations, in the said Premises or remove any door, or
other fitting and fixtures therein.
f) Not to assign, transfer, sublet or part with the possession of the said Premises
or any part thereof at any time.
g) To permit the Owner or his agent to enter and inspect the Premises after
due notice.
h) Shall not deface any of the surfaces (floor, walls, doors and wood work) or
change colors /paints etc.
i) The Tenant shall handover peaceful possession of the premises along with
all its original fixtures and fittings and keys to the Owner in good working
condition on the expiry of the Rent Period fixed herein (the same conditions
as on the date of occupation), subject to normal natural wear and tear due
to ordinary use and lapse of time.
j) The Tenant indemnifies the Owner towards loss or damage caused to the
premises and any of its accessories and fittings due to theft, neglect or misuse.
Actual cost of restoration in such an event shall be borne by the Tenant.
b) The Owner shall all the municipal and property taxes to the authorities as
may be demanded from time to time. However, the Owner may instruct the
Tenant to pay said taxes and the Tenant shall have right to make adjustment
in the due Rent in the following month.
c) He will permit the Tenant on payment of the monthly rent to use occupy and
enjoy the premises without any disturbance or interruption.
d) To execute and complete all such documents and to do all such acts things
and deeds as would be necessary effect to this Agreement. All cost of
Agreement including registration/payment of stamp duty, as may be
applicable, will be borne by the Tenant.
a) The Tenant paying the Rent hereby reserved and observing and performing
the several covenants and stipulations hereby on its part contained shall
peaceably hold or enjoy the said premises during the Rent Period or any
extension thereof without any interruption by the Owner or any person
lawfully claiming under or in trust for him.
d) The said premises shall not be used for any commercial activity or office
purpose, but only for the residential needs of the Tenant.
e) That the Tenant shall pay Rs. [amount] /-(Rupees Twenty one thousand
only) as One month’s advance rent and Rs.[amount]/-(Rs. xxxxx only) as
interest free security deposit (“Security Deposit”). That Security Deposit is
refundable at the time of vacating the premises after deducting
dues/damages if any.
f) That the Tenant shall pay the electricity charges as per the actual electricity
consumption for the rented premises. The Meter Reading on [date] is
_______________.
g) In case of any dispute arising out of or in relation to this Agreement then the
jurisdiction will be Lucknow Court only.
h) That the Rent agreement is made in duplicate. The original shall be kept by
the Owner and the photocopy, duly certified by Public Notary, thereof by
the Tenant.
