MEMORANDUM

FOR : Provincial Director

Tabogon Police Provincial Office

FROM : Chief of Police,TPS

SUBJECT : Investigation Report on Second-degree Arson and murder

DATE : May 08, 2019

I AUTHORITY

1. Memo from that Office dated May 10,2019 re-investigation report on

the above subject.
2. Inherent

II MATTERS TO BE INVESTIGATED

3. To determine the surrounding circumstances of setting a fire by the

suspect intentionally to the victims house that leads him to death
4. To possibly identify the suspects that will led to their apprehension and
possible prosecution

III FACTS OF THE CASE

5. The Defendant set fire to a couch on the fifth floor of Jesus Levy
Dacera’s house. Firemen attempted to put out the blaze, but decided
to give up when they saw they were having no effect. In retreating from
the house, they encountered another fire on the second floor of the
building and one of the fireman received severe injuries from this
blaze. The second fire was also determined to be caused by arson, but
there was no evidence that it had been committed by Defendant. He
was charged by murder of killing Jesus Levy Dacera while he was not
abole to go out at their house because of the large fire.

IV INVESTIGATION/FINDINGS

6. The fire was investigated by Police Colonel Dionio, who later began
investigating the case, found that most of the evidence linking Atil to
the crime was circumstantial. There were witnesses to the event and
the shed was bulldozed after the fire, destroying the crime scene -- an
investigator from the Tabogon Fire office had to examine the debris
from the edge of a dump. Members of the community testified at trial
that the suspect were known for blowhard person for threating some
residents to burn their houses. To Tuason, the only pieces of evidence
tying Atil to the crime were the expert testimonies on the forensic
evidence. Tuason hired Fire officer Jomel Codilla to analyze the
findings of the fire investigation report.Codilla concluded that in light of
more recent developments of arson science, the physical evidence
used to convict Atil was flawed. He notes:

 The fire had gone into flashover, which had left burn patterns
that were previously believed to be indicators of a liquid
accelerant.

 Victims are often found on their backs in accidental fires as a

result of passing out from inhaling noxious fumes.

 The direction of cracks in burned wood gives no indication of

which direction a fire has burned.

 Because of the destruction of the scene coupled with the

intensity of the fire in the shed, it is difficult to know how the fire
started.
The victim were examined on May 15,2019 by Dr.Hanny del Podador. He
reported that Jesus Levy Dacera , had soot in the lungs, mucosal tissue of
the larynx and trachea, and pulmonary edema, as well as
carboxyhemoglobin(COHb) saturation of 71.9%. There was severe
burning of most of the surfaces of the body. His body bore significant fire
damage;however the cause of the death was established to be “inhalation
of smoke, flame and/ or superheated gases.

V CONCLUSION
It was foreseeable that firemen would have responded to the
situation, thus exposing them to a life-threatening danger. The fire set by
defendant was an indispensable link in the chain of events that resulted in
the death. The court determined that it was hardly credible that
defendant's action was not of such a magnitude as to demonstrate a
wanton and depraved indifference to human life. Defendant was aware
that the house of Dacera was occupied by transients and that it was
located in the middle of a crowded neighborhood.

VI RECOMMENDATION/DISPOSITION

After careful perusal of circumstances of second-degree arson and

murder is committed by reason or occasion thereof, the penalty shall be
reclusion perpetua up to death to the suspect. He is criminally liable
because of his conduct was a sufficiently direct cause of the death, and
the ultimate harm is something which should have been foreseen as being
reasonably related to his acts.
