DEED OF DONATION AND ACCEPTANCE

KNOW ALL MEN BY THESE PRESENTS:

This DEED OF DONATION is made and entered by:

FRISO DEVELOPMENT CORPORATION, a


corporation duly organized and existing under the
laws of the Philippines, with office and postal address
at No. 68 Vienna St., Merville Park Subdivision,
Parañaque City, Metro Manila and, BUTUAN LAND
DEVELOPERS GROUP, INC., a corporation duly
organized and existing under the laws of the
Philippines, with office and postal address at No. 531
Commonwealth Avenue, Old Balara, Quezon City,
both represented by POTENCIANO R. MALVAR, M.D.,
by virtue of Board Resolution No. __________ and
Board Resolution No. ___________ respectively,
hereafter referred to collectively as DONORS;

-AND-

The CITY GOVERNMENT OF BUTUAN, a public


corporation duly organized and existing by virtue of
RA 523, as, amended, with address at City Hall
Compound, Brgy. Doongan, Butuan City,
represented herein by its City Mayor ENGR. RONNIE
VICENTE CONDE LAGNADA, per authority by the
Sangguniang Panlungsod under SP Resolution No.
275-2018 and herein referred to as DONEE;

WITNESSETH:

That DONORS are the true, lawful, and absolute owner of


a parcel of land located at Malvar Subdivision, J. Rosales St.,
Holy Redeemer, Butuan City, covered by Transfers Certificate of
Title No. RT-24585 with an area of THREE HUNDRED NINETY THREE
SQUARE METERS (393 sq. m.) and RT-24600 with an area of SIX
HUNDRED NINETY EIGHT SQUARE METERS (698 sq. m.)
respectively or a total area of ONE THOUSAND NINETY ONE
SQUARE METERS (1,091 sq. m.) in accordance with the
Technical Description of Lot 427-C-2-B-1-A and Lot 427-C-2-B-1-B
which is part of the Transfer Certificate of Titles mentioned
above and more particularly described as follows:

That FOR AND IN CONSIDERATION OF THE DONOR’S act of


liberality and generosity, the DONORS hereby voluntarily and
freely give, transfer and convey, by way of donation, unto said
DONEE, all of the right, title and interest which said DONOR has
in the above described parcel of land subject to the condition
that the DONEE shall exclusively devote the aforementioned
property to public use and to concretize the pavement of the
donated property at its own expense;

Be it also known that this Deed of Donation contains a


stipulation that the City Government of Butuan as DONEE, is
required to transfer the same after the above-mentioned
pavement has been concretized, to the Philippine National

Police, a national government agency, created pursuant to


law, with office address at Butuan City Police Office, Butuan
City. The said transfer shall be subject to the following
conditions:

1. The PNP shall utilize the said donated lot as an access road
from the PNP to the Malvar Circle. Further, as the said lot will
be constructed and cemented by the City, the Donee shall
consider the same as a public and access road also for the
Donor;
2. The PNP shall fence the boundary between PNP property
and J.T. Domingo Subdivision.
3. The PNP shall not fence or make obstruction with PNP lot on
its boundaries with the Malvar properties.
4. The PNP shall name its PNP conference hall Judge and Mrs.
Severo Malvar, pictures will be provided by the Donor.
5. In the event that the PNP and the City shall violate any of
the above agreements; the Donor Malvar shall have the
right to prevent the use of the road by erecting a fence at
the boundary between PNP lot and the access road being
donated.

The above stipulations are part of conditions and


obligations imposed by the DONOR upon the DONEE as the
intent of the PARTIES is to confer a favor upon the PNP by
allowing them the PNP to use the access road being donated
to the City of Butuan. Be that as it may, the DONOR and the
DONEE do not represent herein the PNP.

That the DONEE hereby accepts said DONATION made in


its favour by the DONOR, and hereby expresses its appreciation
and gratefulness for the kindness and generosity of the DONOR;

IN WITNESS WHEREOF, we have hereunto affixed our
