WARRANTY

As an expression of confidence that our products will continue to meet the high standards of reliability and
performance that our customers expect, Survey Technologies, Inc. products carry the following warranty:

Hardware Warranty

STI hardware products are warranted against defects in materials and workmanship. If STI receives notice of a
defect within one year after the date of shipment to the Buyer, STI shall, at its option, repair or replace the product
or components which prove to be defective.

After notifying STI, the Buyer may return a failed product or component to STI for repair during the warranty
period. Buyer shall prepay shipping charges for products returned to STI for warranty service and STI shall pay for
return of the products to the Buyer. Buyer shall pay all duties and taxes for products returned to STI from outside
the United States.

Software Warranty

From time to time, STI will issue new revisions for the software which operates on its products. Software revisions,
when issued, will be provided upon request to STI customers free of charge during the first year after product
shipment. STI software is not warranted to be error free or to run without interruption.

Limitation of Warranty

The foregoing warranty shall not apply to defects resulting from:

1. Improper or inadequate installation or maintenance by the Buyer;


2. Buyer-supplied hardware, software or interfacing;
3. Unauthorized modification or misuse.

THE WARRANTY SET FORTH ABOVE IS EXCLUSIVE AND NO OTHER WARRANTY,


WHETHER WRITTEN OR ORAL, IS EXPRESSED OR IMPLIED. STI SPECIFICALLY DISCLAIMS
THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR
USE. THE BUYERS RIGHT TO RECOVER DAMAGES CAUSED BY FAULT OR NEGLIGENCE
ON THE PART OF STI SHALL BE LIMITED TO THE AMOUNT PAID BY THE CUSTOMER FOR
THE STI PRODUCT.

Exclusive Remedies

The remedies provided herein are Buyers sole and exclusive remedies. STI shall not be liable for any direct,
indirect, special incidental or consequential damages (including loss of profits or use of product) whether
based on contract, tort, or any other legal theory.
