LEAVE AND LICENCE AGREEMENT.

THIS AGREEMENT of LEAVE AND LICENCE made as Ahmedabad this 05th Day and
month of March 2019 by Nidhi Rathi, Age 39, PAN No AHVPR8164L residing at 14
Abhilaxmi Apartments, Opp Balaji Apartment, Lad Society Road, Vastrapur,
Ahmedabad 380015( hereinafter called the “LICENSOR / S” which expressions shall
unless repugnant to the content include his / her / their hits, successors, executors,
administrators, legal representatives and assignees) of the ONE PART ; Shashank
Shyambahadur Chauhan, Age 39, PAN No. BFYPS0892A residing at 63 Neelkanth Green
Bunglows, Near Panjrapole, Ring Road Vastral, Vastal Darkoi Ahmedabad 382418
herein called the “LICENSEE” (which expressions shall unless repugnant to the content
include his / its , successors and assignees) of the OTHER PART.

THAT THE `LICENSOR/S’ hereby allow the `LICENSEE’ to use the following described
premises 14 Abhilaxmi Apartments, Opp Balaji Apartment, Lad Society Road,
Vastrapur, Ahmedabad 380015. Municipal Tax Bill Tenament No 06722509010001Q
having 3 Bedroom Apartment ( 2 bedroom given on rent) , Torrent Power Electric
Meter Service no 868530.
WHEREAS

a. The LICENSOR is the exclusive owner and is fully seized and possessed of and are
otherwise well and sufficiently entitled to the residential premises admeasuring
1260 Sq. ft. carpet area located on the 3rd Floor House No 14 Abhilaxmi
Apartments, Opp Balaji Apartment, Lad Society Road, Vastrapur, Ahmedabad
380105, along with all the fittings & furniture, more Particularly described in the
SCHEDULE – 1 written herein (hereinafter referred to as “the said licensed
Premises”).
b. At the request of the LICENSEE, the LICENSOR has agreed to allow the LICENSEE
to use the said licensed Premises on a bare Leave & License basis on the terms
and conditions hereinafter appearing.

NOW THIS AGREEMENT WITNESSETH AND IT IS HEREBY AGREED BY AND


BETWEEN BOTH THE PARTIES HERETO AS FOLLOWS:

1. The LICENSOR has allowed the LICENSEE on a bare Leave and License basis,
to make use of the residential premises admeasuring 1260 Sq. ft. carpet area

known as Unit No. 14 Abhilaxmi Apartments, Opp Balaji Apartment, Lad Society

Road, Vastrapur, Ahmedabad 380105., along with all the fittings & furniture, for
a term of 11 (eleven) months & 29 Days commencing from 15th March 2019
to 14th March 2020, without granting and/or transferring any right and/or
interest of tenancy or without granting any other right or interest of any nature
whatsoever except mere permissible use of the said licensed Premises for
residential purpose at the monthly Leave & License charges / license fees
including maintenance of Rs. 15000/- (Rupees Fifteen Thousand only)
which includes maintenance and municipal tax.

2. That the licensee shall pay to the Licensor/s of the premises, the Licensee Fee of
Rs. 15000/- (Rupees Fifteen Thousand only) which is including Society
Maintenance per month payable in advance in favour of Nidhi Rathi on or before
the 01st Day of Each English Calendar Month for this Agreement. The mode of
payment would be only thru NEFT.

3. That the Licensee shall pay to the Licensor a non interest bearing security deposit
Charges of Rs 30000/- (Rupees Thirty Thousand only) vide cheque no. 561555;
Drawee Bank Axis Bank Ltd Branch which will be refunded by the Licensor against
vacating the premises duly repaired or compensated towards damages or
breakages (if any) caused to fixtures, furniture and premises clearing all the
outstanding towards Electricity etc. whichever applicable as per this Agreement
and producing the copies of payment made to the concerned authorities to the
Licensor.

4. That the Licensee shall pay the Electricity charges at actual during the contract
period only and will not be liable for pending arrears if any. In case of default, in
any of the above the licensee shall have to bear all the costs, interest, penalties
arising out of the reconnection / restoration of services and incidental items if
any. The electricity charges would be not part of the rent and would be exclusive
of the License Fee.

5. If however through an oversight or inadvertence the fees / compensation is not


paid as stipulated. The LICENSEE shall within 7 days of LICENSOR/S demand in
writing in that behalf pay the same. Failure to pay within the said period of 7 days
will amount to default of licensee’s part.
6. All payment related to the Society / Association Common Maintenance would be
paid by the Licensor. Parking charges if any would be paid by the Licensee.

7. All payments related to Municipal Tax would be paid by the Licensor.

8. Notwithstanding the period hereinabove agreed upon:

(a) The LICENSOR shall be entitled to terminate this agreement in case of the
LICENSEE committing breach of any of the terms and conditions of this
agreement and the LICENSOR shall be entitled to enter upon the said licensed
Premises and the LICENSEE shall not be entitled to object or restrict the
LICENSOR under any circumstances.
(b) The LICENSOR may terminate this agreement by giving a 1 (one) month
advance notice in writing about their intention to do so, to the LICENSEE,
without giving any reasons whatsoever. Thereupon the LICENSEE shall stop
using the said licensed Premises on or before the expiry of the notice period.

9. The LICENSEE shall use the said licensed Premises only as LICENSEE and shall
neither be nor deemed to be in possession of the said licensed Premises or any
part thereof. The LICENSOR shall have throughout the term of this license full
control over the said licensed Premises. The Licensee shall not transfer or assign
or sub-let the premises in part or whole to anybody. Transfer or assignment or
sub-let of the premises or any part thereof will automatically result in termination
of this Leave & License agreement from the date of such transfer or assignment.

10. That the Licensee shall not carry out any structural additions / alterations to the
building layout fittings or fixtures without the written consent of the LICENSOR/S.

11. That the Licensee shall not keep any hazardous or inflammable items/ goods etc
in the said premises which is prohibited by Law.

12. That the Licensee shall not carry out any antisocial activity prohibited under the
prevailing Act of Law.

13. That the Licensee shall not create any kind of nuisance / annoyance or hindrance
in the said premise or its surrounding neighborhood and the Society / Association
norms, rules and regulations will be binding to the Licensee and its occupant.

14. That the Licensee shall not to throw any dirt or rubbish in the passage or
compound or open space of the said Society.

15. That the Licensee shall permit the Licensor/s his / her/ their agents etc to enter
upon the demised premises for inspection and carry out repairs as and when
necessary.

16. That the Licensee shall bear the current day to day minor repairs and
maintenance to the said premises.
17. That the Licensee shall not by himself or through anybody cause or allow to be
caused any
(a) Unlawful or illegal activity / activities.
(b) Activity / Activities prejudicial.
(c) To the peace harmony and tranquility of the neighborhood.
(d) To the general law and order.
(e) To the public peace etc.

18. It is expressly agreed and understood by the LICENSEE that this is a bare, non-
exclusive revocable license and nothing herein contained shall be ever construed
to create or intended to be created any right of tenancy, sub-tenancy, lease or
sub-lease, etc or otherwise any other right save & except bare Leave & License in
favour of the LICENSEE and the juridical possession of the said licensed Premises
shall at all times remains vested with the LICENSOR and the LICENSEE shall, at no
time, claim, any share, right, title, interest or benefits in the said licensed
Premises or any part thereof either by the way of tenancy, sub-tenancy, lease or
sub-lease, etc or otherwise in any other manner whatsoever and it is fully
recognized that it has only a bare license to use the said licensed Premises.

19. Licensor and the Licensee shall have an option to renew this Agreement further
period of 11 months and 29 days with mutual consent. And if this Agreement be
renewed further the License Fee will be increases 10% or by mutual
understanding and consent.

20. Upon expiry or sooner termination of this Agreement to remove itself, entities to
use the said premises in terms of this Agreement from the said premises and also
to remove all its furniture and other articles and things brought in or up to the
said premises by the Licensee in pursuance of this Agreement and to ensure to
return the said premises to the Licensor in the same state and condition (subject
to however to any improvement made with the consent to the Licensor) as they
were on the date of this Agreement. Simultaneously Licensor reserves all the
rights to get the said premises vacated availing Police Protection and it would be
binding the Licensee.

21. Jurdiction for this premise will be in Ahmedabad,

22. Upon Expiry OR Premature Termination of this Agreement and Before Vacating
the premises:
a) Licensee shall clear all the dues towards Licensee Fee payable to the
Licensor, Electricity Charges etc whichever is applicable as per the
agreement.

b) Licensee shall also clear all the dues and or charges towards any indirect
services or amenities like Cable TV, Telephone, Mobile, Internet
Connection, Newspaper Bill, Magazine Bill (which are not part of the
agreement) but are availed by him for personal use by making use of this
document and its receipts as his address proof of the said premises so that
the Licensor or next Licensee don’t suffer or face any harassment due to
such negligence.
c) It will be the responsibility of the Licensee to ensure that all the dues
towards various small vendors / service providers like Provision Stores,
Paper/ Magazine Vendor, Cable TV, etc are cleared to avoid unnecessary
harassment to the next occupant or the Licensor in future. It is agreed that
the LICENSEE shall keep the LICENSOR indemnified against any action,
proceeding, claims or demands arising out of any act or omission or
default of the LICENSEE or any person claiming through LICENSEE, against
all costs, charges and expenses which the LICENSOR may have to pay or
incur or sustain or suffer as a result of such action, proceedings, claims or
demands whatsoever.

d) Licensee shall provide his new/next address and contact information to the
Licensor take care of any discrepancy arising in future pertaining to this
Agreement and the duration he occupied the said premises.

23. That the original copy of the agreement will be retained by the Licensor/s.

24. That the Licensor hereby warrants to the Licensee that he is entitled to enter into
and execute this Agreement and collect the monthly License Fee as well as the
security deposit as per this agreement.

25. The Licensor shall deliver the said premises to the Licensee complete in all
respects with Fixtures, Furniture, Fittings and other amenities as agreed at the
time of finalizing the subject premise along with electricity supply and water
connection and clearing all dues towards Electricity etc. Commencement of this
Agreement, Failing to which; the Licensee shall clear such dues on behalf of the
Licensor and will deduct that much from the Licensee Fee payable to Licensor.

26. In the event of completion of the term specified 11 months and 29 days from
15th day of March year 2020 or premature termination of the agreement as the
case may be with Licensee shall hand over the possession of the premises to the
Licensor in a good condition as accepted at the time of taking the possession as
may be agreed up on.
