COMMISSIONER REPORT
Comes now the Commissioner for the plaintiff in the above-entitled case unto this
Honorable Court most respectfully submits:
1. On the basis of this appointment the undersigned Commissioner, together with the
other Commissioners of the TRANSCO AND THE COURT, were tasked by the court to gather
evidence in so far as the location of the property, its present classification and valuation base
on official records of proper government offices and to conduct an ocular inspection and
thereafter to submit report;
2. On April 11, 2019, the court appointed commissioners led by the OIC Clerk of Court
Atty. Anisah Dimaporo Madum as Chairman, Engr. Venencio B. Joyno, Jr. as Defendants
Representative and the undersigned Engr. Manumbilao M. Magondacan, as Plaintiffs
Representative, conducted an ocular inspection on the properties affected by Agus 2-Kibawe
(formerly Abaga-Kibawe) 138 KV Transmission Line.
The properties subject to this report are located in Barangay Apar Fort, Municipality of
Bumbaran, Province of Lanao del Sur, as described below:
The above findings of the Commissioner of plainiff is hereby adopted in so far as the
factual issues are concerned.
The property of the plaintiff were traversed by the Agus 2-Kibawe (formerly Abaga-
Kibawe) 138 KV Transmission Line and the National Road, Wao, Bumbaran, Maguing,
Molundo Road concreting undertaken by the DPWH. These area now being upgradgraded by
the Municipality of Amai Manabilang Lanao del Sur (Formerely Bumbaran) into an Agro
Industrial Land thus increasing its Fair Market Values to P250.00 per square meter based on
the Sangguniang Bayan Resolution upgrading the valuation . A copy of the BIR Certification
with Zonal value of P 120.00 per square meter is enclosed as ANNEX A and the ordinance as
ANNEX B. Under the principle of uniformity in the payment of just compensation by the
government or it instrumentalities including government owned and controlled corporation
like TRANSCO, the latter is bound by the valuation made in the DPWH accepted valuation
through negotiated sale. A copy of Deed of Sale involving the adjacent portion of the property
of the heirs of Pacasum Doro signed by DPWH and Abel Pacasum at a price of P 250.00 per
square meters, the court has already this file because the payment of that property was
processed thru court order of the Regional Trial Court of Lanao del Sur, 12 th Judicial Region,
Branch 26, Wao , Lanao del Sur.
Along this line and consideration, the undersigned Commissioner for the plaintiff
hereby recommend the following just and reasonable compensation of the following affected
properties as follows:
