TO WHOM IT MAY CONCERN:

1. complainant was actually already 14 and 15 years old, during those

respective dates. While still a minor, he was then already of the age that
he can knowingly answer questions pertaining to the commission of the
offense. The Transcript of Stenographic Notes (TSNs) pertaining to his
direct examination and cross examination attached as Annexes “G”
and “H” would show that private complainant was competent to
answer the questions asked of him. It is apparent that he does not
suffer from any mental disability. It was just really plain and simple
that he never mentioned of any pushing and slapping incident in his
entire testimony. The private complainant’s independent, candid and
spontaneous testimony which even categorically stated that nothing
else happened when his mother arrived negates Josie Largo’s testimony
on the alleged pushing and slapping incident which allegedly transpired
after her arrival.
