The Right to Information Act - 2005

The is an Act made by the parliament giving the citizens


India access to the records of CG & SG. Came into force
12th October 2005.

Objective of the Act :


1. Provide secure information to citizens
2. Access information under public authority.
3. Promote transparency, accountability and openness
in the working of every pubic authority.

Sec.1: Applicability of the Act : This Act applies to whole of
India except J&K.

Sec. 2(b) Central Information Commission : Constitute by CG

Sec. 2(k) State Information Commission : Constituted by SG

Sec. 2(f) Information :

Any material in any form, including records,


Documents, emails, opinions, advices, press releases,
circulars, orders, logbooks, contracts, reports, papers, model etc
Sec. 2(f) Right to Information : means
any information under the public authority , that includes

Inspection of work, documents, records

Taking notes, extracts or certified copies of documents or reco

Obtaining information in the form of floppies, tapes or other ele


devices.
Sec.3: Right to Information:
All the citizens have the right to Information.
Sec. 4: Obligations of Public Authorities.

 Every public authority shell have maintain all its records.

Publish with in 120 days from the date of enactment of this Act:

1. Particulars of the org., functions, duties.


2. Powers and duties of its officers and employees
3. Procedures followed in the decision making
4. Rules, regulations, manuals and records.
5. The other documents under their control.
Sec. 6 : Request for Obtaining Information.

A person who wants to obtain any information under this Act shall m
a request in writing or through electronic means in English/hind/ a
Language with a prescribed fee to CG/SG public information
Officer, specifying the particulars sought by him.

Fee is 10/-

Rs.2 /- per page and

Rs.5/- for each hour of inspection.


Sec. 7: Disposal of Request

The CG/SG provide information with in 30 days from the date of


payment of Prescribed fees.

Where the request has been rejected, the officer has to give rea
for rejections.
What is not to be disclosed

Sec. 8 : Exemption from the disclose of Information

Information which damages sovereignty & integrity of


India

Information which is forbidden by court of Law

Information which ceases breach of privilege of parliament


or state legislature

Information regarding trade secrets

Information received in confidence from foreign govt.


Section : 12 Central Information Commission

Chief Information Commissioner and Central Information


Commissioners were appointed by the President of India.

The CG by a notification in the official gazete constitute a body to


known as central information commission.

The Central Information Commission consists of

The Chief Information Commissioner


Central Information Commissioners (not exceeding 10)
Sec. 13: Term of the office:

The chief information commissioner and Information


Commissioners shall hold the officer for a period of 5
years or 65 years Which ever is earlier.
Sec.15. Constitution of State Information Commission.

The state Information Commission shall consist of

a) the State Chief Information Commissioner, and


b) such number of State Information Commissioners, not exceedin

same as Central Information Commissioner.

Receiving the evidence
Requesting any public to produce record or copies thereof.

Section 19.
Any person who does not receive a decision within the
specified period may go for appeal to The higher authorities.

Section: 20. Penalties

If anybody not given the information within the time/ given


information is incorrect/Incomplete information can impose a
penalty of Rs.250/- for each day of information furnished
and recommend for disciplinary action.
