TRAVEL SERVICE AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This AGREEMENT made and executed by and between:

5 Angels Travel and Tours, a juridical business entity duly recognized by Philippine laws, herein
represented by its Proprietor, Merlie Salvador Gretler, with office address of 1629B. Blumentritt Ext.,
Brgy 495, Sampaloc NCR, City of Manila, herein called as the “SUPPLIER”

-and-

Justin B. Borja (4) PAX with home/office Zone 3, San Agustin Pili Cam Sur -herein after
called as the “CLIENT”,
That the above rate shall be applicable only for a minimum of (4) Four participant(s) and that any
reduction/addition on the number of participants shall subject such rate to a RE-COMPUTATION / RE-
COSTING;

That once the bookings are finalized, the NON REFUNDABLE / NON REBOOKABLE / NON
ENDORSEABLE policy of any airline tickets, shipping lines, unused tours, entrance/guide fees, meals,
hotel accommodation & transfers shall apply and that the whole amount shall be charged even if there
is/are any cancellation/s or any amendments/s made;

That the CLIENT carefully understood the following REMARKS as advised by the SUPPLIER:

1. Pax are protected with a similar class hotel/pension/inn due to conditions or situations
beyond our control or if above mentioned accommodations are not available. Check In time –
2:00PM . In case of brownout and the hotel has no generator, The Management is not liable to
refund and to transfer the guests to other hotel/pension/inn.
2. No Refund for any unused tours, airline tickets, hotel accommodations, meals or other
services.
3. 100% of the whole amount will be charged from the CLIENT in case of clients cancellation/No
show.
4. Confirmed reservations are strictly non-refundable if the cancellation is received less than
15days before the tour, but is considered transferable to the third party designated by the client
otherwise the participant’s group will be responsible for the payment of his/her balance.
5. Child policy: Maximum of one 4yrs. Old and below is free of charge, sharing bed and no seat
6. Baggage policy: 1 Bag only. Trolleys are not allowed.
7. Pet policy: Pets are not allowed
8. Don’t forget to bring a valid ID as you present your deposit slip to the assigned Tour
Coordinator/Driver.
9. All trip/tour details and itinerary may be altered or cancelled due to hazardous conditions,
uncontrollable circumstances or any fortuitous event which may arise. We always put your safety
first. In the event that a tour gets cancelled due to these reasons, you may opt to reschedule your
tour to a different date.
10. Please be at the pickup point on or before the designated time. An allowance of only 30
minutes will be given for late comers. The company has the right to depart without waiting for
other participants. In this even, no refunds will be given for registered participant(s) that does not
come in time.

11. FULL AMOUNT will still be charged for all no show bookings. We take the subject of no
shows/cancellations very seriously. Other interested clients could have been booked if you had
given proper notice. Give us at least 2 weeks advance notice if you want to reschedule your travel
date (subject to availability). Should the cancellation notice be received in less than 15 days. It
will be equivalent to a No-Show and full amount will be charged. Cancellation of the whole tour if
there are No Show clients. We will be forced to take legal action for unsettled payments.

12. 5 Angels Travel and Tours, its employees, representative, and tour coordinators shall not be
responsible and liable for any accident, loss, injury, and damage to property in connection with
any accommodation or other services resulting directly or indirectly from any occurrence or acts
of God, strikes, civil disturbances, theft, delay or cancellation or change in the itinerary.

13. 5 Angels Travel and Tours reserves the right to terminate servicing to any participants who in
its opinion is prejudicing the harmony of the tour group by being abusive and disruptive, a burden
to the group or for any reason by his/her conduct hinders the successful operation of the tour and
affects the other guests as well as the employees.

14. All accommodation/lodging quoted and covered by the tour package are considered as
budget accommodations. It is not operated by or owned by 5 Angel Travel and Tours but were
carefully selected though classified as budget accommodation. These accommodations have
standardized and limited services thus being offered at a cheap price. 5 Angels Travel and Tours
will not be held responsible for any refund, either fully or partially, any amounts paid due to
unsatisfactory services by the concerned establishment. Client acknowledge and accept that 5
Angels Travel and Tours will arrange the room booking for the guest according to the room
availability among the list of accommodations that is covered by the tour package. PLEASE
NOTE that this is a BUDGET TOUR, accommodations are under pension/inn/homestay/transient
categories. However basic amenities are provided.
15. 5 Angels Travel and Tours Services has the right to cancel any tour that does not reach the
required minimum number of participants (at least 12 pax per van). You may opt to (1) rebook the
tour to a different date (subject to van and room availability) or (2) ask for a full refund or (3)
transfer to other tour operator (subject to availability and their prevailing rate)(JOINERS ONLY)
16. 5 Angels Travel and Tours has the right to alter, amend, change or modify the tour package
and itineraries before or during the tour.
17. Call time should be strictly followed. Guests are not allowed to make any changes on the
itinerary.
18. Seating arrangement is first come, first serve basis. (Reservations not allowed)
19. Toyota GL Grandia for 13-14 Persons and Toyota Hi Ace Commuter or Nissan Urvan for 13-
14 Persons
20. We will only book the accommodation (1) once the signed agreement has been forwarded to
us and (2) if 12 Persons/Van has been completed (for Joiners Tour).
21. At 5 Angels Travel and Tours, we welcome your feedbacks. Should you have any complaints
or face any problem during your tour, please bring it to the attention of the Tour Coordinator, while
on board, in order for him or her to provide you with an immediate solution rectifying the problem
whilst on tour. It is only if you do this, that 5 Angels Travel and Tours has the opportunity to put
matters right, on the spot. We can also learn from what you’ve told us – and improve what we do
in the future.

That the SUPPLIER shall not cancel or reschedule the tour, EXCEPT by reason if minimum
number of participants per van was not reached (12 participants per van), No Show of other
participants, cancellation of flights, and fortuitous events force majeure beyond its foresight or
control. (FOR JOINERS ONLY)

That in any case of natural calamities or any occurrence beyond the control of the
SUPPLIER and the CLIENT e.g. typhoon, hold departure order/s of any of the participants from
airline, shipping line management. Counter, the SUPPLIER shall not be held liable therefore,
such risks being simply part and parcel of the operation of the tour; you may opt to rebook the
tour to a different date (subject to van and room availability)
That in connection with said natural calamities or airline cancellation due to airline
operational requirements/vessel technical problems, the SUPPLIER shall try, without the absolute
assurance, however, to make arrangements from the hotel / airlines / vessels new schedule, but
the CLIENT shall shoulder the fare/penalties IF ANY for the said rearrangement.

That the CLIENT agreed and shall pay the required deposit of Php 1200.00 (Php300.00
x 4 persons) DECEMBER 7, 2018 and the balance of Php 10,720.00 Will Be Collected On The
Date Of Departure April 4, 2018 upon pick up at MOA and that any individual participant who
shall not be able to make the full payment on the same date shall not be accommodated and
shall place the CLIENT under the pain of the re-computation clause OR cancellation of the
whole tour if schedule of payment is not followed and if Receipt of Payment, Travel
Service Agreement and Gov’t ID are not submitted.

That the SUPPLIER shall act and be responsible as a travel agency and provide the
services stipulated above for this particular tour;

That the SUPPLIER, however, shall not assume any responsibility in connection with any
damage to or loss of jewelries, passports, luggage’s, personal things etc., damage, sickness,
injury or travel accident, which shall be the sole responsibility and lookout of the client. (As a
travel agent, we have a professional responsibility to strongly recommend the purchase of travel
protection for both you and your vacation. 5 Angels Travel and Tours is limited to advising you of
the need for such coverage. By declining this protection, you acknowledge and accept the
responsibility for arranging and paying for any medical treatment in case of medical emergency
and accident while travelling; and

That the parties hereby agree to abide by the terms and conditions of this agreement.

IN WITNESS WHEREOF, WE have hereunto set our hands this (7th day of December 2018) at
