2, 2019 at approximately 6:00 AM inside of 438 EAST 141ST STREET Apt# 2, County
of the Bronx, State of New York,

THE DEFENDANTS, ACTING IN CONCERT, COMMITTED THE OFFENSES OF:

1 (F) P.L. 125.20(1) Manslaughter 1^ DQO
2 (F) P.L. 125.15(1) Manslaughter 2^ DQO
3 (F) P.L. 125.10 Criminally Negligent Homicide DQO

IN THAT THE DEFENDANTS, ACTING IN CONCERT, DID: cause the death of a person,
while acting with intent to cause serious physical injury to that or another
person; recklessly cause the death of a person and with criminal negligence,
cause the death of a person.

THE GROUNDS FOR THE DEPONENT'S BELIEF ARE AS FOLLOWS:

Deponent states, based upon official investigation, defendant's statements,

that, at the above time and place, the defendants, acting in concert with each
other, did cause the death of Lawrence Leathers, in that defendant Aguilar did
place Lawrence Leathers in a chokehold for approximately thirty minutes while
defendant Harris sat on Lawrence Leathers' chest and punched him several times
in the face.

 Deponent is informed that Medical Examiner Annie Laib of the Office of the
Chief Medical Examiner performed an autopsy on the body of Lawrence Leathers and
listed his cause of death as homicidal asphyxia with compression of neck.
