Background for Participants

You are participating in a mock trial.

For this exercise, assume that all procedural requirements are met.

The case is being heard before the Supreme Court of the TJ Republic.

TJ Republic is relatively new. Its jurisprudence is still in the development stage. Most
of its laws, particularly its Obligations and Contracts Laws, are patterned from the
laws of the Philippines. The decisions of the Philippine Supreme Court are persuasive
in TJ courts.

The Supreme Court in TJ Republic normally holds oral arguments on novel cases.

The case before the court is novel.

Facts of the Case

SpaceX designs, manufactures and launches advanced rockets and spacecraft. The
company was founded in 2002 to revolutionize space technology, with the ultimate
goal of enabling people to live on other planets.

As the world’s fastest growing provider of launch services, SpaceX has secured over
100 missions to its manifest, representing over $12 billion on contracts. These include
commercial satellite launches. SpaceX’s Dragon was designed from the outset to
carry humans to space and will soon fly astronauts under NASA’s Commercial Crew
Program.

SpaceX is working on a next generation of fully reusable launch vehicles that will be
the most powerful ever built, capable of carrying humans to Mars and other
destinations in the solar system.

SpaceX’s target of bringing humans to planet Mars is year 2020. The Company is
confident that it will be able to bring the first five (5) persons to Mars before the end
of next year. All that SpaceX is waiting for is the government’s approval. SpaceX has
submitted all the requirements for the issuance of the permit to launch.

Joey Hofi is a billionaire from France. He was the first individual to buy a ticket to
Mars. He bought the ticket in 1995 at the time that SpaceX was still planning to
launch by 2020. The amount of the ticket is USD 10 Million.

In TJ Republic, it is the Solicitor General who represents the Republic. TJ Republic

feels that, at this point, it is not safe to allow an exploration to Mars. It is not inclined
to issue a permit for SpaceX’s exploration.
FlyLater Corp. is a direct competitor of SpaceX. It is opposing the efforts of SpaceX
to launch a rocket on 2020 because (1) it is of the opinion that the human race is not
yet ready to explore and live in other planets; and more importantly, (2) its space
craft shall only be available to launch by 2025.

There shall be a legal controversy - which shall be heard by the Supreme Court of TJ
Republic.

Your task

Your group will represent one of the parties in this controversy:

1. SpaceX
2. Joey Hofi
3. The Republic of TJ, through the Solicitor General
4. FlyLater Corp.

Additional important facts shall be given to you before the start of the trial.

You will know who your group shall represent after the additional facts are disclosed.

All shall be called to argue.

For now, ensure that you have mastered all the concepts in Obligations and Contracts
Law as these shall be crucial in your effective representation of your client.
