1)There are certain ways through which the international law can become a part of

domestic law. Your task is to discuss and provide 2 examples of international law that later
becomes the part of domestic law with reference to Pakistan.

As far as the scope of international law is concerned it is expanding with the passage of time.
Examples:
1) Dangerous Cargos Act and Maritime Zone Act 1996 of Pakistan aim at translating its
international obligations into domestic laws. This act to provide for declaration of territorial
waters and Maritime Zone in Pakistan. Similarly United Nations convention on Law of the Sea
has been ratified by Pakistan and ensure its enforcement in Pakistan corresponding to domestic
legislation.
2)In Pakistan the foreign capital and foreign private investment has been protected by Foreign
Private Investment Act, 1976 whose preamble states that to provide the protection and promotion
of Foreign Private Investment in Pakistan. This Act extends protection from takeover by
Government of foreign Capital or foreign Private Investment except under the due process of
Law. The foreign private investment has been given further protection under protection of
Economic Reforms Act, 1992 which shall have an overriding effect to anything contained in the
Foreign Exchange Regulation Act 1947, The Custom Act 1969, The Income Tax Ordinance
1979.

2)What is the difference between reservation and declaration? Give one example.
Reservation
It enables a state to participate in a treaty in which it would not be able to participate due to an
unacceptable provision or provisions.
It is the statement made upon signature, acceptance and approval of a treaty. In many cases
reservation is merely to adjust the States obligation under the treaty to conform to its domestic
law for political, cultural or social reasons
Declaration
A state may make a declaration about its understanding of a matter contained in or the
interpretation of a particular provision in a treaty.
If the Declaration excludes or modifies the legal effect of certain provisions of treaty in their
application to the State in question, it is reservation.
Some treaties specifically prohibit all reservations for example
Statue of the International Criminal court.
