I. FACTS OF THE CASE:

Muntinlupa City Police Station is practicing of discipline, loyalty, and integrity


this also involves the safety of the policemen and women in taking custody of the
arrested individuals. Custodial facility is a place where the arrested people taken into
custody to isolate them and deprived their freedom. During the stay of the
researchers in the facility, they observed Police Personnel using motorcycle or
renting tricycle to be their source of transporting a detainee during court trial.

Almost everyday they need to escort detainee for court trial this symbolize that
they need to have a police mobile car available as always. The Police Personnel
using their own motorcycle or sometimes they need to rent a tricycle just to escort
the detainees for court trial.

The Hall of Justice of Muntinlupa is just a walking distance from Muntinlupa City
Police Station but it is not a reason to let the detainee walk together with the police
personnel. Escorting a detainee is need to be safe and proper to avoid unexpected
circumstances and to avoid danger.

In this case, the Police Personnel cannot perform their job well, it will be hussle
for them to go to tricycle parking to rent a tricycle while the detainee are waiting
inside the custodial facility. Sometimes they have to escort three to five detainees
and tricycle is the only way to transport them to Hall of Justice.

Also the detainees are exposed to the public while transporting to hall of justice,
instead of having a mobile car that is well secured and police personnel is the only
people they are with. It is much safer and it is good for the image of the Policemen
because they perfom their job well.

II. PERIOD COVERED:

The period of the study was conducted at Muntinlupa City Police Station at
Centennial Avenue National Road Barangay Tunasan Muntinlupa City From
February 11, 2019 to April 15, 2019. The study and research was limited to
Muntinlupa City Police Station where we deploy as Criminology Interns in
become the temporary part of the Police Personnel at Muntinlupa City Police
Station.

III. STATEMENT OF THE PROBLEM:

The study aims to asses the Availability of Police Mobile Car in custodal unit
Muntinlupa City Police Station. In order to answer the main problem, the following sub
questions are formulate;

1. What is the problems encountered to availability of police mobile car in


custodial unit in terms of;
1. Transporting of detainees using their motorcyle and private vehicle.
2. Lack of budget in renting a tricycle.
3. Possible danger may occur.

2. What is the proposed solution in availability of police mobile car in


transporting of detainees for court trial in terms of:

1. Make a request to local government to have additional police mobile


car.
2. Make a request to the Chief of Police of Muntinlupa City Police Station
to assigned a stable police mobile car in custodial facility.

Transporting of detainees using their motorcyle and private vehicle

Transporting of detainees for court trial using motorcyle or private vehicle of


the police personnel is not safe. One reason Motorcycle is a vehicle that invovles balance of
the driver riding a motorcyle if the detainee wants to escape he or she can jump into the
motorcyle anytime she or he wants. The road in the custodial facility is upward and they are
in the intersection that’s why they have the chance to escape because the motorcyle needs
to stop and wait for the traffic enforcer to sign to go.

Also in using a private vehicle of the police personnel its sound safe because
it is enclosed but what if the detainees get anything pointed inside the car of the police
personnel they can used this to unlock their handcuffs to harrass the police personnel
because he is driving.

Lack of budget in renting a tricycle

Detainees are the one who pay the tricyle in order for them to be transported
to Hall of Justice, but sometimes not all detainees are capable of paying a tricylce for that
reason Police Personnel need to pay it.

One hundred pesos back and forth to the custodial unit is the payment for the renting
of tricyle. One hundred pesos depends on the number of detainees that need to transport in
one day. Sometimes three to five detainees are need to transport each day, where they can
find the money in transporting detainees if all of them can’t afford to pay.

Possible danger may occur

Unavailability of Police Mobile Car may cause possible danger number one
in the life of Police Personnel and also the life of detainee. Danger in the life of police
personnel because what if somebody is spying the routine of police personnel in escorting a
detainee they learn how to attack the weakest point of police personnel because they know
where and when to get the detainee. They know that one police personnel escort the one
detainee may be in walking or in motorycle.

Second the life of detainee will be put to danger because what if the
complainant will revenge to the detainee and tried to kill him because he or she knows that
there is no mobile car that will be used in transporting a detainee, anytime while transporting
he or she can attack the detainee and worst can kill the detainee.

Make a request to local government to have additional police mobile car

Make a letter of request to local government of Muntinlupa for additional police


mobile car because based on the researchers estimate in Muntinlupa City Police Station
Headquarters they are only 3-5 mobile cars in the station. The Chief of Police of Muntinlupa
City Police Station should coordinate to the local government and give the exact number of
mobile cars in the headquarters. He should also help the Police Personnel in custodial unit
to have atleast one mobile car. The local government of Muntinlupa should gave additonal
mobile car specifically in the headquarters because it is the main Police Station in
Muntinlupa.

Make a request to the Chief of Police of Muntinlupa City Police Station to assigned a
stable police mobile car in custodial facility.

Police personnel should make a letter of request to Chief of Police in


Muntinlupa Police Station for having stable mobile car in custodial facility. But before
that the researchers should consider the parking area in the custodial facility, there
is no parking for mobile car beacause the health center besides custodial facility
uses the parking area and park their vehicle there that’s why police mobile car the
COP should put an action to have a parking area for police mobile car.

Muntinlupa City Police Station must coordinate to all the PCPs in Muntinlupa City to
have an access in providing Police mobile cars. This Strategy helps the Police
Officers to solve the problem not to use unauthorized vehicles. Custodial Chief must
request to the COP of Muntinlupa City Police Station to provide enough Police
vehicle to maintain the proper, safe and fast transporting of detainees for attending
Court Trials.

The custodial unit is the one who should have atleast one stable police mobile
car in the facility. Because it is always needed in escorting a detainee for court
apperances. Almost everyday the police personnel escorted two to three detainees
with handcuffs using only one tricyle and one police personnel, but if the facility have
stable police mobile car the transporting of detainee is safe and secure.

IV. METHODS USED TO ANALYZE DATA/ FACTS:

A SWOT ANALYSIS

Internal Factors

Strength

1. Sufficient Number of Police Personnel in Custodial Facility

The Muntinlupa City Police Station has sufficient number of police personnel
especially in custodial unit. They all do their job well and accomodate every person
in a very pleasant way. They helped the family of the detainee in how to file an
application for bail and help them in documents for the application.

2. The Custodial Facility is well secured.

The Custodial Facility and the entire headquarter is secured by CCTV


cameras. The Custodial Facility is having 3-4 CCTV cameras installed, they have in
men’s cell and also in female’s cell to monitor the area and see if detainees has
doing something unecessary and to avoid them from escaping. It also monitored the
persons especially the visitors who in and out in the custodial facility especially in
men’s cell because it is very congested.

3. Well secured in safe keeping of detainees.

The Custodial Facility make sure that all cell is locked and the keys of the cell
should be in a safe place. During visiting hours, the police personnel make sure to
implement the do’s and don’ts in visiting a detainee. Visitors should wear proper
attire, surrender all the prohibited things inside the cell like cellphone, any pointed
objects, and any illegal things. The female police personnel should conduct frisking
to check if the female visitor is hiding something in her body, while the male visitor is

also undergo body searching. The police personnel always checked the numbers of
detainee every 2-3 hours to check if they are still complete, they also make sure to
write the names of detainee if arresting officer need brought out the detainee for
court trial.

Weaknesses

1.Congestion of detainees in Custodial Facility.

Almost everyday they bought almost 2-3 suspect arrested especially in drug
cases. The male cell is 51.82 sq meters, the population of male detainee in custodial
facility is almost two hundred male detainees the male cell is very congested. Some
of them use hammock in the ceiling of the cell because there is no space for
sleeping on the floor. Because of congestion, some of them has sickness that can
infect other detainee because they are lying side by side. It is very alarming because
they can also infect the visitors of them and also the police personnel in the custodial
facility.

2. No issued Police Mobile car in custodial facility.

This is the most weakest point of custodial facility because no issued police
mobile car in custodial facility. This is always needed in transporting a detainee for
court trial but if there is no available mobile car in other prescint to be borrowed the
motorcyle or renting a tricyle is used by the police personnel in escorting a detainee
which is not safe and proper.

3. No standard operating procedure when it comes to escorting


police mobile car.

The custodial facility should have a standard operating procedure related to


proper way of escorting a detainee. In fact, if the police personnel has no choice he

will walk together with detainee along susana heights footbridge which is not safe
because they are many vehicles on the highway anytime the detainee can run or ride
a jeepney to escape.But if the custodial unit has their own standard operating
procedure they have the right to demand a mobile car in escorting a detainee.

B. External Factors

Opportunities

1.The Police personnel and detainee can save money.

Thru having a police mobile car the personnel and detainee can save money
because first the motorycle no need to use and also the payment for renting a
tricylcle. Having a police mobile car is a great help financialy and make their job
easily. The detainee is no need to pay for tricyle because it will cost 50 pesos from
police station to hall of justice. And also it can save gas from motorcyle or vehicle of
the police personnel.

2. Escorting of detainee is safe.

Thru having a mobile car escorting a detainee is well secured because they
are inside the mobile car and more detainees can escort in a single period of time. It
is much safer because detainee are not really exposed to the public the main person
they are with is only police personnel. They are much safer because the mobile car
can transfort them very fast unlike tricycle, mobile car can be a priority in crossing
the way.

Threats

1. Escaping of detainees.

Renting a tricycle or using a motorcycle in escorting a detainee for court trial


can be he/she her way of escape why? Anytime he/she can tell someone or one of
his visitor that he/she will need to go to hall of justice and someone will pick up them.
Or anytime he/she can run very fast away from the tricycle. Or jumped while riding a
motorcycle.

2. Escorting a detainee using a motorcyle may result to an accident.

Riding a detainee in a motorcycle is not safe because they are possible


accident may happen motorcycle accident, hit and run, and anything related to
accident because of riding a motorcyle. Anytime if uneccessary things will happen
may result to injury of detainee and police personnel.

3. Danger to the life of Police personnel.

Renting a tricycle with a detainee will be a risk to a life of police personnel,


because anytime while in the highway if someone wants to kill the detainee they also
will kill the police personnel, or if they want to help the detainee escape they also kill
police because tricycle is not well secured vehicle in transporting a detainee. Also in
riding a motorcyle detainee can have the opportunity to kill the police because he is
in the back ride anytime he can get the police gun or make uneccesarry movements
resulting to the unbalanced of the police that may result to accident.

V. ALTERNATIVE COURSES OF ACTION:

These are the alternative way if there is no possible police mobile car in
custodial facility.

First, the police personnels were using their own vehicle if there is no
available police mobile car in transporting detainees for court appearances.
Secondly, They were also using, if any, the vehicle of the detainees in transporting
for court appearances. This helped out the police personnel for less expenses in
transporting the detainees. The police personnels were using motorcycles and also
renting tricycle in transporting detainees for court appearances. And lastly, the police
personnel were able to borrow if there is available police mobile cars in other PCPs
to used in transporting of the detainees during court trial.

VI. ANALYSIS OF THE COURSES OF ACTION:

Unavailability of police mobile cars in custodial unit in transporting detainees for


court appearances was not a hindrance to be unable to perform their job. There are
many ways to transport detainees during court trials such as; First, was using the
private vehicle of police personnel to transport detainees to court safely and without
any unexpected circumstances. But using this kind of way is not suitable for
transporting detainees causing of unexpected accident for both the police personnel
and detainees.

Second, was using the detainee’s personal vehicle in transporting detainees


to court helped the police personnel having a problem in availability of police mobile
car. But using the personal vehicle of detainee is very dangerous for not knowing
there is someone tailing them while transporting the detainees causing thge
detainee’s escaped and the safetyness of the police personnel.

Using motorcycles in transporting a detainee for court trials helped the police
personnel to transport a detainee fast and easily. But using motorcycles could risk
the life of both the police personnels and detainees.

Renting tricycles in transporting detainees during court trials could solve the
problem of unavailability of police mobile cars. It helped both the police and
detainees in transporting for court trials. But this made the police personnel tolerate
to always rent tricycles for transporting causing them for solving the problem of
unavailability of police mobile cars.

And lastly, borrowing the police moble cars, if available, in any PCPs in
Muntinlupa City. This helped the police personnel to transport detainees in court
appearances in time, fast and safely. But still, not solving the problem on having a
personal police mobile cars in custodial facility of Muntinlupa City Police Station.

VII. FINAL CHOICE OF COURSE OF ACTION:

The researchers chose for the final choice of course action is; the borrowing
of the police mobile car in other PCPs if there is available will be used in transporting
the detainees for court appearances. This will helped out the police officers to escort
their detainees safely. And also for the safety of the detainees and they would be
attending in exact time.

VIII. CONCLUSION:

Therefore, the researchers concluded that Muntinlupa City Police Station


especially the custodial unit could borrow police mobile cars, if available, in other
PCPs in Muntinlupa City for transporting detainees for court appearances. And this
would be the best way in solving the unavailability of police mobile cars that would
save the efforts of all the police personnel in custodial facility.

Using the personal vehicle of the police personnel was too risky in
transporting detainees for court trials.

Using personal vehicle of the detainee was too dangerous for the police
personnel lives. And could cause unexpected accident.

Using motorcycles in transporting a detainee could also cause accidents for


both the police personnel and detainees causing their lives might loss.

Renting tricycles in transporting the detainees could tolerate the police


personnel their laziness and would always rent tricycles for transporting the
detainees during court trial easily.

IX. RECOMMENDATION:

The following were the recommendation used on findings of the study. And
we believe that our recommendations can be used for possible changes for the
Unavalability of Police Mobile Car in Custodial facility at Muntinlupa City Police
Station. To request to the Local Government for having enough police mobile car in
transporting detainees for court appearances. The researchers’ recommendatons
can be effective throughout the Muntinlupa City Police Station; however, there are
some possible aspects in the research study that will improved the research and
yield more accurate and strong data and conclusions.

1. The Police Personnel in the higher units should pay attention regarding to
the request from the custodial facility for having enough poolice mobile car that can
be use in transporting detainees during court trials.

2. The Chief of Custodial Facility should request to the Local Government of the
Muntinlupa Police Station for approving their request.

3. Aside from borrowing police mobile car in custodial facility, The Custodial
should issued police mobile car for transporting detainees use only and not for
transferring detainees to BJMP use only.
