Abstract

The Philippines has long been particularly vulnerable to extreme


weather. In the recent years, our nation has been strucked by violent storms
which caused loss of human lives and major damages in infrastructures and
agriculture, the scientists believe climate change is the cause. The geography
and development of our country have combined to exacerbate both this threat
and its devastating consequences.
The inability to enforce building planning laws and ignorance by the
property owners on the application of these relevant laws contributes
immensely to the identified issues on sustainable development. The problem
ranges from uncontrolled change of use of property, non-compliance with
space standards and approved design, unguided and ineffective enforcement of
building regulations. Therefore, there is an urgent need for the successful
implementation of a comprehensive redevelopment plan towards the ultimate
goal of a sustainable and disaster resilient environment in order to combat
climate change.
It is in light of this context that this study seeks to evaluate the legal
implications that may arise in the exercise of eminent domain to transfer land
from one private owner to another private owner to further sustainable
development and disaster resiliency.
