P E T I T I O N

COMES NOW, the Petitioner, unto this Honorable

Court, most respectfully alleges:

1. That Petitioner is of legal age, married and a

resident of Brgy . Haligui Silangan, Batangas City, on the
other hand, respondent is being impleaded in her official
capacity as the City Civil Registrar of Batangas holding office
at the said City, and at which given addresses, the parties
may be served with notices and other Court processes;

 2. That the petitioner was born on September 13,
1952 at Bo. Haligui, Batangas City as evidenced by his
Certificate of Live Birth and made part of this petition as
ANNEX “A”;

3. That certain errors were committed in his

Certificate of Live Birth, particularly LCR No. 0160, upon
registration of his birth with the Office of the City Civil
Registrar of Batangas, to wit:

a. The SEX or GENDER of petitioner AMADO

BALMES MANALO was erroneously entered
as FEMALE instead of MALE;
b. His FIRST NAME was erroneously entered as
AMADA instead of AMADO;

4. That on August 9, 2012, petitioner has undergone

medical examinations before Dr. Teresita Gonzales of Golden
Gate General Hospital and Dr. Renato B. Tibayan of the
Batangas Regional Hospital and their respective findings
disclosed that petitioner has “Ultrasonically Normal
Testicles”, and “Male by Ultrasound of the Testes” copy
of the UltraSound Report and Medical Certificate are
hereto attached as Annexes “B” & “B-1”;

5. That the true and correct FIRST NAME of

petitioner is AMADO, as evidenced by the following
documents, to wit:

a. SSS identification card Annex “C”

b. Philhealth ID Annex “D”

c. Certificate of Marriage Annex “E”

d. Police Clearance Annex “F”

 6. That the erroneous entries in the Certificate of Live
Birth of petitioner have caused confusion, and are still
causing confusion on his true identity.

7. That this Petition was not filed by the petitioner to

deceive any legal authority or evade any criminal or civil
liability.

PRAYER

WHEREFORE, it is most respectfully prayed that after

due notice, publication and hearing, an Order be issued,
directing the City Civil Registrar of Batangas, to correct
and/or amend the entries in the Registry of Births of
Batangas City particularly LCR Registry No. 0160
referring to the record of birth of petitioner AMADO
BALMES MANALO, as follows:

a. The SEX or GENDER of petitioner AMADO

BALMES MANALO be changed to MALE
instead of FEMALE;
b. His FIRST NAME be changed to AMADO
instead of AMADA;

Other reliefs, just and equitable under the premises are

likewise prayed for.

and a resident of Brgy. Haligui Silangan, Batangas City, after
having been duly sworn to in accordance with law, hereby
depose and state:

That I am the petitioner in the above-entitled Petition

and that I have caused the preparation of the same;

That no other action or proceeding involving the same

issues has been hereto commenced in the Supreme Court,
the Court of Appeals or any other tribunal or agency;

That to the best of my knowledge, no such action or

proceeding is pending in the Supreme Court, the Court of
Appeals, or any other tribunal or agency;

That If I should thereafter learn that a similar action or

proceeding has been filed or is pending in the Supreme
Court, the Court of Appeals or any other tribunal or agency, I
undertake to report the fact within five (5) days therefrom to
the Honorable Court.
