Defendant, TRISTAN TORALBA, by counsel, unto this

Honorable Court, respectfully state:

1. That undersigned hereby enters his appearance for

defendant TRISTAN TORALBA, in the above captioned
case and HENCEFORTH prays that he be furnished with
all the writs and processes relative to this case.

ADMISSIONS/DENIALS

2. Paragraphs 1 and 2, so far as parties’ personal

circumstances are admitted.

3. Paragraph 3 of the Complaint is admitted.

 4. Paragraph 4 of the Complaint is admitted, it being
factually true that plaintiff has not received or borrowed
any make-up kits from Ganda Ka at any occasion.
Defendant also admit that the alleged proof of plaintiff to
have borrowed Ganda Ka’s make-up kits with her
purported signature is not her signature. That of the
matter was that it was made by Ganda Ka so that the
plaintiff’s reputation be tarnished.

5. Paragraphs 5 to 8 are admitted. In fact, on 1 October 2018,

herein defendant personally talked with plaintiff Malia
Rodriguez and profusely apologized to his perjurious acts
towards her name. And that plaintiff Malia Rodriguez
accepted her apology and request that herein defendant
must clean her name before her family, friends and even
in her office, where she currently works.

6. However, it is respectfully submitted that defendant

should not be made liable for damages, moral, actual,
compensatory or exemplary, since plaintiff Malia promised
him that she will not pursue this action against him with
conditions/requests stated above.

RELIEFS

WHEREFORE, it is prayed for that the foregoing ANSWER

be favorably noted and that the defendant be adjudged as not
liable for Damages claim by the plaintiff.
