2. Security Deposit for this work is Rs.11,31,483/- (Rupees Eleven lakhs thirty one thousand
four hundred and eighty three only), which shall be recovered at the rate of 10% of each bill
amount till the full Security Deposit is recovered. No interest will accrue on the Security Deposit
lodged by you with the Railways.

3. Please remit within 30 (Thirty) days from the date of issue of this letter, a sum of Rs.11,31,483/-
(Rupees Eleven lakhs thirty one thousand four hundred and eighty three only), as “
Performance guarantee” in any of the following form with valid up to 60 days beyond Stipulated
date of completion of work.
(i) Cash Deposit.

(ii) Irrevocable Bank guarantee.
(iii) Government securities including state loan bonds at 5% below the market value.
(iv) Deposit receipts, Pay orders, Demand drafts and Guarantee Bonds. These forms of
Performance Guarantee could be either of the State Bank of India or of any of the
Nationalized Banks.
(v) Guarantee Bonds executed or Deposits Receipts tendered by all Scheduled Banks.
(vi) A Deposit in the Post office saving Bank.
(vii) A Deposit in the National saving certificates.
(viii)Twelve years National Defense certificates.
(ix) Ten years National Defense Deposits.
(x) National Defense Bonds.
(xi) Unit Trust certificates at 5% below the market value or at the face value whichever is less.
3a.Failing which, a penal interest of 15% per annum for the delay in submission of PG beyond 30
days from the date of issue of LOA will be levied up to 60 days.
3b. Any failure to submit the requisite PG even after 60 days from the date of issue of LOA, the
contract shall be terminated duly forfeiting EMD and the other dues, if any, payable against the
contract.
3c. The failed contractor shall be debarred from participating in re-tender.
3d. This Letter of Acceptance is the due notice for submission of PG and that no further
Communication will be sent to you reminding for submission of PG. In case of failure to
submit PG within the stipulated date, action taken under clause 16(4) of GCC is final and binding
4. An amount of Rs.2,72,610/- (Rupees Two lakhs seventy two thousand six hundred and ten
only), has been paid by you towards EMD vide DD.No.437280 dated 13.04.2015 issued by
Indian Bank, Vellore will be adjusted with security deposit.
5. You are further directed to contact ADEN/CTR/MAS for further directions and the work shall
commence within 7 (seven) days from the date of receipt of this letter.
6. Completion period of this work shall be 9 months.
7. The sales tax at source as per section 13 OF TNVAT 2006 Act will be deducted of source from
your running bills, as per extent instructions.
8. Please note that the Income Tax (Including surcharge and Education Cess charge) as notified
from time to time by the Govt. of India will be deducted at source from your bills.
9. You are also advised to chalk out a program of work and submit the same to this office if not
already submitted along with the tender.

10. You are also advised to attend this office for signing up the agreement for this work within 30
(Thirty) days of issue of this letter.
11. You may please note that until a formal agreement is executed this letter of acceptance will be
binding contract between you and the Railways and this will be merged into the agreement to be
executed.
12. Any amount involved on account of vitiation in the present tender due to variation in the
agreement quantity during the execution of work will be recovered from the bills due to you.
13. Price Variation Clause is applicable only for those works where tender of value [contract
agreement value] is more than Rupees Fifty lakhs.
14. In case of disagreement of any clause in the LOA with the Agreement, the latter shall “prevail “
