AFFIDAVIT OF DESISTANCE
I, LENELYN, minor, single, Filipino citizen and a resident of
Maura,Aparri, Cagayan assisted by my mother MELY, of legal age, single and a
resident of Maura, Aparri, Cagayanafter having been duly sworn to in
accordance with law, do hereby depose and state THAT:

1. I am the private complainant in Criminal Case No. II-14007entitled “People

of the Philippines vs. MARCELINO, for Violation of Republic Act No. 9262” is
now pending before the Regional Trial Court, Branch 06 of Aparri, Cagayan;

2. After a careful and thorough evaluation of the events which transpired on

NOVEMBER 28, 2017 and the facts and circumstances attendant thereto, I
have come to realize that what transpired was merely blown out of
proportion and a product of a clear misunderstanding with the accused
MARCELINO;

3. Also, after having a heartfelt conversation with the accused who is my

father, we have already settled our differences and decided to put an end to
whatever misunderstandings we had;

4. Moreover, my supposed witnesses have already turned hostile and

uncooperative to my cause. Hence, to proceed with the instant complaint is
a mere exercise in futility;

5. In view of the foregoing, I hereby manifest that I am no longer interested in

the prosecution of the above-captioned case and hereby moves for its
dismissal;

6. I was not paid, coerced, forced, threatened or intimidated by anybody in the

execution of the foregoing affidavit. I am fully aware that in the execution of
the foregoing, I can no longer file the same case again;

7. I am executing this affidavit to attest to the truth of the foregoing and in

support of my prayer for the dismissal of the above-captioned complaint;

AFFIANT FURTHER SAYETH NAUGHT.

IN WITNESS HEREOF, we have hereunto affixed my signature this
