AFFIDAVIT OF DESISTANCE
I, JESIL GARCIA PESQUERA, of legal age a resident of Purok 5, Brgy. Nangka, Consolacion,
Cebu, after having duly sworn to in accordance with law, hereby depose and state that:

1. A complaint for Rape in relation to R.A. 7610 against ROGELIO R. CABAHUG in

the case entitled “JESIL G. PESQUERA versus ROGELIO R. CABAHUG”, I.S. No.
VII-03-INV-17 A-0051, is pending before the Office of the Provincial
Prosecutor. Attached in the worksheet complaint, among others, is
purportedly an affidavit executed by herein affiant as the victim of the said
crime;

2. There is no truth to the allegations contained in the sworn statement executed

on January 19, 2017 by Jesil Garcia Pesquera at the Cebu Provincial
Prosecutor's Office. In fact, I disown the said sworn statement because the
signature therein is not my signature. I have never executed any sworn
affidavit against Rogelio R. Cabahug. I can remember that I went to the
Municipal Hall of Consolacion accompanied by my father and sister. However,
I never met with Prosecutor Raymund A. Aller;

3. I, therefore, respectfully request that the above-mentioned case filed against

said ROGELIO RONDENA CABAHUG be dismissed as in fact I now withdraw the
complaint against him and I further manifest under out that I am now desisting
from testifying against him in Court or in any other government entity or
agency in connection with the said criminal case.
