AFFIDAVIT OF ADVERSE CLAIM

I, LEONARD G. ESPINOSA, of legal age, Filipino, married and a resident of

Consuelo Village, Basak, Mandaue City, Cebu, duly represented herein by MARILOU
B. ESPINOSA, after having been duly sworn to in accordance with law, depose and
state:

1. That I am co-owner of a certain parcel of land covered by TCT 14873, more

particularly described as follows:
TCT 14873
A parcel of land (lot 13, Block 1 of the consolidation and
subd. Plan, Pcs-13271, being a portion of the consolidation of
Lot 1905-A of the subdivision plan (LRC) Psd-107070 and Lot
1911 plan II-5121 Amd. 2 (Hacienda Mandaue), LRC rec. Nos. N-
29722 & N-39354, situated in the Barangay of Basak, City of
Mandaue, Island of Cebu. Bounded on the NW., along line 1-2 by
Lot 1905-C (LRC) Psd-107070; on the NE. along line 2-3 by Lot
12, Block 1; on the SE. along lines 3-4-5-6-7 by Road Lot 1; and
on the SW. along line 7-1 by Road Lot 2, all of the consolidation
and subdivision plan, containing an area of THREE HUNDRED
ELEVEN (311) square meters, more or less.

2. That I am the son of the registered owners of the said parcel of land, the
Spouses Jose Espinosa and Valeriana G. Espinosa;

3. That on December 3, 1999, my father, Jose Espinosa, died intestate. A copy of

his Certificate of Death is hereto attached as ANNEX “A” and made an integral part of
this Affidavit;

4. That I am in possession of the said parcel of lot. I have made several offers to
my mother, Valeriana G. Espinosa, to buy the lot but it turned futile. I have also
negotiated with my mother and my sister to partition the properties of my father
but still it remain unheeded. My mother reasoned out that the entire property is
hers alone;

5. That my mother is in the act of transferring the entire parcel of land to the
name of my sister and thus excluding me from the property;

6. I am therefore executing this Affidavit for the purpose of attesting to the

truthfulness of the foregoing allegations and in support of my request for the
annotation of an adverse claim over the parcel of land covered by the Transfer
Certificate of Title No. 14873.
 IN WITNESS WHEREOF, I have hereunto set my hand this 8th day
