AFFIDAVIT OF DESISTANCE
I, _____________________ , Filipino citizen, widow, of legal
age and a resident of Brgy. 62, Sagkahan, Tacloban City, Leyte, after
being duly sworn to an oath in accordance with law hereby depose and
state:

1) That I am the private complainant in the case for SLIGHT

PHYSICAL INJURIES against _________________________,
now pending before the Municipal Trial Court in Cities (Branch 2)
under Criminal Case No. M-TAC-17-00183-CR;
2) That I am no longer interested to pursue the case considering that I
have already been apprised of the circumstances obtaining in this
instant case;
3) That this case, upon my own re-evaluation of the incident, is purely
a product of misunderstanding and misappreciation of facts and that
the herein accused has apologized for the incident, therefore, we
have agreed to amicably settle the matter;
4) That the accused has promised to refrain from any acts that may
further violence against my person;
5) That in view thereof, and in order to buy peace, I am requesting for
the dismissal of the aforementioned case;
6) That I am executing this instrument likewise, with full knowledge of
its consequences, that the said case may be dismissed, that I can no
longer file the same case based on the same cause and the accused
shall be relieved from criminal liabilities thereof;
7) That this Affidavit has been read and translated to me in Waray-
waray, a language I know and understand; and
8) That I attest to the truthfulness of the foregoing.
