1. Section I –Invitation to Bids

1.1 General

1.1.1 The TSTSinvites e-RFP/offers (Technical and Commercial) for providing the services of Duct
level System Integrator with the scope of carrying out PLB HDPE Ductintegration testing, taking
over from Mission Bhagiratha agencies, post execution documentation and maintaining,
handing over the same to blowing agencies for T-FIBER Project.
1.1.2 TSTS is considering the appointment of a System Integrator (herein after referred to as “SI”) to
perform DIT, taking over of the duct and maintain the PLB HDPE Duct in an efficient and
effective manner.
1.1.3 Bidders are invited to submit the Technical and Financial Proposals through the e-RFPing
process. Bid submitted without the RFP fee and EMD or do not otherwise confirm to all the
conditions of this notification shall be treated as invalid and rejected. The Bidder shall bear all
costs associated with the preparation and submission of the bid, including cost of presentation
for the purposes of clarification of the bid, if so desired by TSTS. In no case TSTS will be
responsible or liable for those costs, regardless of the conduct or outcome of the bidding
process.

1.2 Preface

Government of India is committed to leveraging advancements in cost effective communication


technologies, broadband connectivity, etc., for the benefit of citizens. In this process they have
unveiled the National optical fibre network project through Bharat Broadband Network Limited with an
aim to provide broadband connectivity to over two lakh fifty thousand (250,000) Gram Panchayats of
India. The project aims to provide internet through optical fiber from block / Mandal level extending it to
the Gram Panchayats. Further to speed up the execution of this project, it is renamed as BharatNet
project with widening the scope of participation to State Governments and Private companies.

BharatNet project is intended to enable the Government of India to provide e-services and e-
applications nationally. Providing universal and affordable access through broadband to every citizen of
India is one of the most critical and important action item for Digital India which is an another initiative
of union government. Digital India is an exciting and visionary program that through various specific
projects linked to financial inclusion, e-governance and citizen services, can truly transform India. With
almost a billion mobile phones assuring unprecedented reach, the telecommunication revolution and
Aadhaar provide the means to implement many of these services.

BharatNet project will form the basic platform for the provision of a number of services like e-
governance, e-health, e-commerce, e-banking, video on demand, etc. Universal access to the internet
is a must to empower our citizens. It will not only enable them to connect with their friends, family and

communities, but also use the online tools and information to help find jobs, start businesses, access
healthcare, education and financial services. Citizens of Telangana State will be able to effectively
participate in the digital economy.

The T-FIBER Corporation shall be the primary body for the implementation of Telangana Fiber Grid
project. It shall provide end-to-end connectivity right from state headquarters till the household level in
the state of Telangana. The implementation of Telangana Fiber Grid project work scope shall include
rolling out fiber from SHQ to DHQ, DHQ to BHQ, BHQ to GPs, GPs to Households and installing
necessary equipment for provision of high speed broadband connectivity. Underground duct and fiber
laying is planned to be carried out along with the laying of water grid pipelines in Telangana.

Government of Telangana through TSTS invites sealed technical and financial proposals from the
short-listed eligible bidders for selection as Duct level System Integrator to implement the duct
integration testing and associated activities for T-Fiber in the State of Telangana State. The bidder(s)
shall be selected as per the procedures described in this Request for Proposal (RFP).

Pre-qualified bidders are hereby invited to submit, details of pre-qualification, technical and financial
proposals as per the provisions detailed in this RFP.

The last date for submitting the above proposals are 08th June 2017 latest by 15:00 hrs to the following
address which is to be used for all communication in regards to this RFP process is:

2. Section II –Instruction to Bidders

2.1 Instructions

ITE&C Department responsible for Execution of T-Fiber under Government of Telangana


Department

Contract The agreement will be entered into between TSTS and the Bidder, the contract
shall be signed by the TSTS and the bidder.

Bid Offer by the Bidder to fulfil the requirement of the Purchaser for an agreed price. It
shall be comprehensive technical and commercial response to the RFP

Bidder The person or the firm meeting the qualifying criteria stipulated in the RFP for
providing services to T-FIBER project

System The person or the firm who met the qualifying criteria stipulated in the RFP and on
Integrator whom the order for providing the DIT Services, etc., for T-FIBER project is placed
and shall be deemed to include the bidders successors, representatives
(approved by TSTS / ITE&C dept. GoT), heirs, executors, administrators and
permitted assigns, as the case may be unless excluded by the terms of the
contract.

Contract Price The price payable to the Bidder under the contract for the full and proper
performance of his contractual obligations

Equipment All the equipment/resources required for performing the total scope of work shall
be provided by the bidder and the detailed list of the same shall also be submitted
to TSTS along with the bid

Service The entire DIT services, etc., shall include carrying out DIT and other services,
Acceptance of takeover of OFC duct from Mission Bhagiratha Agencies, post execution
RFP documentation, and maintaining & handing over the same to blowing agencies
and all other such obligations of the Bidder covered under the contract. The letter/
e-mail/fax or any memorandum communicating to the Bidder of the acceptance of
his RFP shall be final.

2.2 General

2.2.1 While every effort has been made to provide comprehensive and accurate background
information, and requirements, Bidders must form their own conclusions about the solution
needed to meet the Purchaser requirements.
2.2.2 All information supplied by Bidders as part of their bids in response to this RFP, may be treated
as contractually binding on the Bidders. However,on successful award all RFP conditions are
mandatory.
2.2.3 No commitment of any kind, contractual or otherwise shall exist unless and until a formal written
contract has been executed by or on behalf of Purchaser.Purchaser may cancel this public
procurement at any time prior to a formal written contract being executed by or on behalf of
Purchaser.
2.2.4 Bids shall be received by the Purchaser on the e-Procurement portal before the time and date
specified in the schedule of the RFP notice. In the event of the specified date for the submission
of RFP offers being declared a public holiday by the Government of Telangana, the offers will
be received up to the appointed time on the next working day. The Purchaser may, at its
discretion, extend this deadline for submission of offers by issuing corrigendum and uploading
the same on e-Procurement portal.
2.2.5 Telex, cable or facsimile offers will be rejected.

2.3 Bidding Instructions

Qualification Document and Financial Bid/Proposal should be submitted online through e-


procurement portal.

The bids should be submitted as per the schedule given in the appropriate section.

The Qualification Documents and Financial Proposal shall be submitted in separate parts as
follows:

For participation in the RFP process, it is mandatory for prospective bidders to get registration
on website www.eprocurement.gov.in. Therefore, it is advised to all qualified bidders to get
registration by making on line registration fees payment at the earliest.

RFP documents can be purchased only online and downloaded from website
www.eprocurement.gov.in.in by making online payment for the RFP documents fee. Service
and gateway charges shall be borne by the bidders.

Since the bidders are required to sign their response online using class–III Digital Signature
Certificate, they are advised to obtain the same at the earliest. For further information regarding
issue of Digital Signature Certificate, the bidders are requested to visit website
www.eprocuremnet.gov.in .

Please note that it may take up to 7 to 10 working days for issue of Digital Signature Certificate.
Department will not be responsible for delay in issue of Digital Signature Certificate.

If bidder is going first time for e-procurement, then it is obligatory on the part of bidder to fulfil all
formalities such as registration, obtaining Digital Signature Certificate etc. well in advance.

Bidders are requested to visit our e-procurement website regularly for any clarification and / or
due date extension. Bidder must positively complete online e-procurement procedure at
www.eprocuremnet.gov.in .Department shall not be responsible in any way for delay /difficulties
/inaccessibility of the downloading facility from the website for any reason whatsoever.

2.4 Eligible Bidders

The Bidder can only be a Single entity & should be qualified as per the criteria stipulated in this
RFP as described below.

2.5 Cost of Bid Submission

2.5.1 The Bidder shall bear all costs associated with the preparation and submission of the bid. TSTS
will in no case be responsible for those costs, regardless of the conduct or outcome of the
bidding process.

2.6 Bidders Queries

2.6.1 Pre-bid queries of only those Bidders will be responded who have submitted their queries
before the deadline as per time schedule
2.6.2 The Bidders will have to ensure that their pre-bid queries should reach to TSTS by email (Excel
File only) before the last date for sending pre-bid queries mentioned in Time schedule of this
document through the e-mail. Telephone Queries shall not be entertained.

2.6.4 TSTSshall not be responsible for ensuring that the Bidder„s queries have been received by
them. Any requests for clarifications post the indicated date and time may not be entertained by
the TSTS.
2.6.5 The purpose of these queries is to provide Bidders information regarding the RFP, project
requirements, and opportunity to seek clarification regarding any aspect of the RFP and the
project. However, the TSTS reserves the right to respond to the queries.
2.6.6 Queries received beyond the date mentioned shall not be entertained.
2.6.7 The overall responsiblity of carrying out the bid process up to award and resolution of
contractual issues are of TSTS. ITE&C dept being the beneficiary of the project and will perform
the role of project executing department

2.7 Compliant RFPs / Completeness of Response

2.7.1 Bidders are advised to study all instructions, forms, terms, requirements, appendices and other
information in the RFP documents carefully. Submission of the bid / proposal shall be deemed
to have been done after careful study and examination of the RFP document with full
understanding of its implications.
2.7.2 Failure to comply with the requirements of this paragraph may render the Proposal to be non-
Compliant and the Proposal may be rejected. Bidders must:
2.7.2.1 Comply with all requirements as set out within this RFP.
2.7.2.2 Submit the forms as specified in this RFP and respond to each element in the order as set
out in this RFP.

2.8 Earnest Money Deposit (EMD)

2.8.1 Rs.16, 00,000/- (Rupees Sixteen Lakhs Only) of EMD should be submitted to TSTS in the form
of Demand Draft / Bank Guarantee. Also a scan copy of the EMD to be submitted along with Bid
document online.
2.8.2 EMD of all unsuccessful Bidders would be refunded by TSTS within 60 Days from the award of
the contract to the successful Bidder. EMD of successful Bidder will be returned after the award
of contract and submission of the Performance Bank Guarantee within specified time and in
accordance with the format given in the RFP.
2.8.3 EMD amount is interest free and will be refundable to the unsuccessful Bidders without any
accrued interest on it.
2.8.4 The bid / proposal submitted without EMD, mentioned above, will be summarily rejected.
2.8.5 The EMD may be forfeited:
2.8.5.1 If a Bidder withdraws its bid during the period of bid validity.
2.8.5.2 In case of a successful Bidder, if the Bidder fails to sign the contract in accordance with this
RFP.

2.9 Performance Bank Guarantee

2.9.1 Performance Guarantee should be valid for entire contract period


2.9.2 Performance Guarantee will be 10% of the final order value and should be submitted at the time
of agreement. Format of PBG is as per the Annexure-IV
2.9.3 TSTS may forfeit the Performance Guarantee for any failure on part of Bidder to complete its
obligations under the Agreement.
2.9.4 The Performance Guarantee shall be denominated in Indian Rupees and shall be in the form of
a Bank Guarantee issued by a Nationalized/ scheduled bank located in India with at least one
branch office in Telangana.

2.9.5 The Performance Bank Guarantee shall be returned to the Bidder within 180 days from the date
of successful discharge of all contractual obligations at the end of the period of the Agreement
by TSTS.
2.9.6 In the event of any amendments to Agreement, the Bidder shall within 15 days of receipt of
such amendment furnish the amendment to the Performance Guarantee as required.

2.10 Amendment of RFP document

2.10.1 At any time prior to the last date for receipt of bids, TSTS may, for any reason, whether at its
own initiative or in response to a clarification requested by a prospective Bidder, modify the RFP
document by issuing an amendment.
2.10.2 The amendment will be notified in writing or by fax or hosted on the e-RFPing web site which
can be accessed by any prospective Bidders who have received the RFP document and will be
binding on them.
2.10.3 In order to afford prospective Bidders reasonable time in which to take the amendment into
account in preparing their bids, TSTS may, at its discretion, extend the last date for the receipt
of bids.

2.11 Qualification Criteria

2.11.1 The Bidder must possess the requisite experience, strength and capability in providing the
services necessary to meet the requirements as described in the RFP document. The Bidder
must also possess the technical know-how and the financial wherewithal that would be required
to successfully provide entire scope of services for performance of DIT, taking over, updation of
documentation and post implementation maintenance, handing over of the PLB HDPE duct for
T-FIBER. The bids must be complete in all respects and should cover the entire scope of work
as stipulated in the RFP document. The invitation is for qualified Bidders with the eligibility

3. Section III – Contract Conditions & Service Levels

3.1 Completeness of Response

3.1.2 Bidders are advised to study all instructions, forms, terms, requirements and other information
in the RFP documents carefully. Submission of bid shall be deemed to have been done after
careful study and examination of the RFP document with full understanding of its implications.
3.1.3 The response to this RFP should be full and complete in all respects. Failure to furnish all
information required by the RFP documents or submission of a proposal not substantially
responsive to the RFP documents in every respect will be at the Bidder's risk and may result in
rejection of its Proposal and forfeiture of the Bid EMD.
3.1.4 Bidder to furnish all documents as per section 4 of the RFP along with the technical proposal.
Also, section 4.6 should be covered in detailed, clearly defining the project understanding and
implementation approach. In-case any document is missing or incomplete, the bid shall be
termed as non-responsive

3.2 Modification and withdrawal of Bids

3.2.1 The Bidder may modify or withdraw his bid before the bid‟s submission, provided that a written
notice of the modification or withdrawal is received by TSTS prior to the last date prescribed for
receipt of bids.
3.2.2 A withdrawal notice shall also be sent by fax and a signed confirmation copy, both to be
received before the last date for receipt of bids.
3.2.3 No bid shall be modified subsequent to the last date for receipt of bids.
3.2.4 No Bid may be withdrawn after due date for submission of bids. Withdrawal of a Bid after Bid
submission due date may result in the forfeiture of Bidder's Bid security.

3.3 Signing of Contract

3.3.1 As soon as TSTS notifies the successful Bidder that his bid has been accepted, TSTS will send
the Bidder the contract form, incorporating all agreements between the parties.
3.3.2 On receipt of the contract form, the successful Bidder shall sign with date, the contract form,
and return it to TSTS as per a mutually decided date.

3.4 Opening of Bids by TSTS

3.4.1 Bids will be opend on e-Procurement Portal and bidders shall verify the the same through their
logins on eprocurement portal.
3.4.2 Immediately after the closing time, TSTS shall open the technical Bids and list them for further
evaluation.

3.5 Verification by ITE&C Dept/Third Party

3.5.1 ITE&C department at its discretion, may appoint third party for verification of testing of DIT
parameters (like quality, time schedule etc.) of onsite services.
3.5.2 The roles and responsibilities of Third Party agency will be taied up by ITE&C dept separately

3.6 Assignment

3.6.1 The Bidder shall not assign, in whole or in part, his obligations to perform under the contract, to
any other party or persons, except with ITE&C dept prior written consent. However, the
responsibility of delivery of the work will rest with the bidder.

3.7 Sub Contract

3.7.1 If a Bidder intends to subcontract any items of services, it shall include in the bid details of the
name of the proposed Subcontractor, including vendors, for each of those items and shall be
responsible for ensuring that any Goods or Services components of the DIT System to be
provided by the Subcontractor comply with the requirements of Purchase in accordance to the
relevant requirements. Subcontractor‟s change shall be allowed withprior written approval of the
ITE&C Dept.after submission of bid, however,The bidder would be single point of contact.

3.8 Termination for Default

3.8.1 TSTS may, without prejudice to any other remedy for breach of contract by written notice of
default sent to the Bidder, terminate the contract in whole or in part:
3.8.1.1 If the Bidder fails to deliver any or all of the services within the time period(s) specified in the
contract, or any extension thereof granted
3.8.2 If the Bidder fails to perform any obligation(s) under the contract.
3.8.3 In case for Termination for Default, the Performance Bank Guarantee shall be forfeited.

3.9 Termination for Insolvency

3.9.1 TSTS may at any time terminate the contract by giving written notice to the Bidder, without
compensation to the Bidder, if the Bidder becomes bankrupt or otherwise insolvent, provided
that such termination will not prejudice or affect any right of action or remedy which has accrued
or will accrue thereafter to TSTS.

3.10 Force Majeure

3.10.1 The Bidder shall not be liable for forfeiture of his performance security, liquidated damages or
termination for default, if and to the extent that, his delay in performance or other failure to
perform his obligations under the contract is the result of an event of Force Majeure.
3.10.2 For purposes of this clause, “Force Majeure” means an event beyond the control of the Bidder
and not involving the Bidder and not involving the Bidder‟s fault or negligence and not
foreseeable. Such events may include, but are not restricted to, acts of TSTS either in its
sovereign or contractual capacity, wars or revolutions, fires, floods, epidemics, quarantine
restrictions and freight embargoes.
3.10.3 If a Force Majeure situation arises, the Bidder shall promptly notify TSTS in writing of such
conditions and the cause thereof. Unless otherwise directed by TSTS/ GoT, the Bidder shall
seek all reasonable alternative means for performance not prevented by the Force Majeure
event.

3.11 Force Majeure Events

3.11.1 The Force Majeure circumstances and events shall include the following events to the extent
that such events or their consequences (it being understood that if a causing event is within the
reasonable control of the affected party, the direct consequences shall also be deemed to be
within such party's reasonable control) satisfy the appropriate definition as per this agreement.
3.11.2 Without limitation to the generality of the foregoing, Force Majeure Event shall include the
following classes of events and circumstances and their effects:
a) Any material effect on the natural elements, including lightning, fire, earthquake,
cyclone, flood, storm, tornado, or typhoon;
b) Explosion or chemical contamination (other than resulting from an act of war);
c) Epidemic such as plague;
d) Any event or circumstance of a nature analogous to any of the foregoing.
3.11.3 Other Events (“Political Events”) to the extent that they satisfy the foregoing requirements
including:
a) Political Events which occur inside the State of Telangana or involve directly the State
Government and the Central Government (“Direct Political Event”), including:
b) Act of war (whether declared or undeclared), invasion, armed conflict or act of foreign
enemy, blockade, embargo, revolution, riot, insurrection, civil commotion, act of
terrorism or sabotage;
c) Strikes, work to rules, go-slows which are either widespread, nation-wide, or state-wide
and are of political nature;
d) Any event or circumstance of a nature analogous to any of the foregoing.

3.11.4 Political Events which occur outside the State of Telangana and the Republic of India and do
not involve the State Government and/or the Central Government (“Foreign Political Events” or
“Indirect Political Events”) including, but not limited to:
a) Act of war (whether declared or un-declared), invasion, armed conflict or act of foreign
enemy, blockade, embargo, revolution, riot, insurrection, civil commotion, or act of
terrorism;
b) Strikes, work to rule, go-slows;
c) Any event or circumstance of a nature analogous to any of the foregoing

3.12 Arbitration

3.12.1 TSTSand the Bidder shall make every effort to resolve amicably by direct informal negotiation,
any disagreement or dispute, arising between them under or in connection with the contract.
3.12.2 If, after thirty (30) days from the commencement of such informal negotiations, TSTS and the
Bidder partner have been unable to resolve amicably a contract dispute, either party may
require that the dispute be referred for resolution to the formal mechanism specified below.
3.12.3 In the case of a dispute or difference arising between TSTS and the Bidder relating to any
matter arising out of or connected with this contract, such dispute or difference shall be referred
to the award of arbitrators, which will be appointed by Directorate of Information Technology,
Government of Telangana.
3.12.4 The Indian Arbitration Act, 1940, the rules there under and any statutory modification or re-
enactments thereof made till the date of signing of contract, shall apply to the arbitration
proceedings.

3.13 Governing Language

3.13.1 The contract shall be written in English. All correspondence and other documents pertaining to
the contract, which are exchanged by the parties, shall be written in the same language.

3.14 Deduction

3.14.1 Payments shall be subject to any deductions (such as TDS, penalty as per SLAs, etc.) of any
amount, for which the Bidder is liable under the agreement against this RFP.

3.15 Taxes and Duties

3.15.1 The Bidder shall be entirely responsible for all taxes, duties, license fees, and demurrage
charges etc., incurred until completion of Scope of Work as per this RFP

3.16 Limitation of Liability

3.16.1 Bidder cumulative liability for its obligations under the contract shall not exceed the contract
value and the Bidder shall not be liable for incidental, consequential, or indirect damages
including loss of profit or saving.

3.17 Confidentiality

3.17.1 Bidder understands and agrees that all materials and information marked and identified as
„Confidential‟ are valuable assets of the Owner and are to be considered proprietary
information and property. Bidder partner will treat all confidential materials and information
provided with the highest degree of care necessary to insure that unauthorized disclosure does
not occur. Bidder will not use or disclose any materials or information provided by the owner
without prior written approval.
3.17.2 Bidder shall not be liable for disclosure or use of any materials or information provided or
developed by Bidder which is:
I. Possessed by Bidder prior to receipt, other than through prior disclosure, as
documented by Bidder's written records;
II. Published or available to the general public otherwise than through a breach of
Confidentiality; or
III. Obtained by Bidder from a third party with a valid right to make such disclosure,
provided that said third party is not under a confidentiality obligation; or
IV. Developed independently by the Bidder.
3.17.3 In the event that Bidder is required by judicial or administrative process to disclose any
information or materials required to be held confidential hereunder, Bidder shall promptly notify
to the ownerand allow a reasonable time to oppose such process before making disclosure.
3.17.4 Bidder understands and agrees that any use or dissemination of information in violation of this
Confidentiality Clause will cause the owner irreparable harm, may leave with no adequate
remedy at law and TSTS is entitled to seek to injunctive relief.
3.17.5 TSTS does not wish to receive the Confidential Information of Bidder and Bidder agrees that it
will first provide or disclose information which is not confidential. Only to the extent that TSTS
requests Confidential Information from Bidder, will he furnish or disclose Confidential
Information. Nothing herein shall be construed as granting to either party any right or license
under any copyrights, inventions, or patents now or hereafter owned or controlled by the other
party. The requirements of use and confidentiality set forth herein shall survive the expiration,
termination or cancellation of this RFP.
3.17.6 Confidential Information disclosed under this contract shall be subject to confidentiality
obligations for a period of three years following the initial date of disclosure. Nothing contained
in this contract shall limit the Bidder from providing similar services to any third parties or

reusing the skills, know-how, and experience gained by the employees in providing the services
contemplated under this contract.
3.17.7 The Bidder shall not, without TSTS prior written consent, disclose the contract or any provision
thereof, or any specification, design, drawing, pattern, sample or information furnished by or on
behalf of TSTS in connection therewith, to any person other than a person employed by the
Bidder in the performance of the contract. Disclosure to any such employed person shall be
made in confidence and shall extend only as far as may be necessary for purposes of such
performance.
3.17.8 The Bidder shall not without TSTS prior written consent, make use of any document or
information forming a part of this RFP except for purpose of performing the contract. Any
document forming a part of this RFP, other than the contract itself, shall remain the property of
TSTS

3.18 Bid Evaluation

After the submission of Bid Response,Qualification document will be opened and evaluation will
be done for its completeness and adherence as per the requirement mentioned in Qualification
section of RFP document.

Financial proposal of all qualified bidders will be opened and evaluated on L1 criteria as
mentioned in the section 4.16 of the RFP document.

3.19 Commercial Bid Format

3.19.1 The Bidder should submit a copy of the actual price bid as per the format specified in Annexure
V of the RFP. TSTS reserves the right to reject the bid at the time of commercial evaluation, if
the format of „Commercial Bid‟ does not match with the desired format.

3.20 Award of Contract

3.20.1 The Bidder whose valid commercial offer as per Commercial Bid Format is determined to be the
lowest, will be awarded the contract.

3.21 TSTS Rights to accept / Reject any or all Proposals

3.21.1 TSTS reserves the right to accept or reject any proposal, and to annul the bidding process and
reject all Bids at any time prior to award of Contract, without thereby incurring any liability to the
affected Bidder or Bidders or any obligation to inform the affected Bidder or Bidders of the
grounds for TSTS‟s action.EMD would be returned to the bidder in case of rejection of the
proposal not later than 60 days after the award of contract to the final bidder.

3.22 Local Conditions

3.22.1 Each Bidder is expected to become fully acquainted with the local conditions and factors, which
may affect the performance of the contract and /or the cost.
3.22.2 The Bidder is expected to know all conditions and factors, which may have any effect on the
execution of the contract after issue of letter of Award as described in the bidding document.
The TSTS shall not entertain any request for clarification from the Bidder regarding such local
conditions.
3.22.3 It is the Bidder„s responsibility that such factors have been properly investigated and considered
before submitting the proposal. No claim, what-so-ever, including that for financial adjustment to
the contract awarded under the bidding document will be entertained by the TSTS. Neither any
change in the time schedule of the contract nor any financial adjustments arising thereof shall
be permitted by the TSTS on account of failure of the Bidder to know the local laws / conditions.
3.22.4 The Bidder is expected to visit and examine and study the location of work in Telangana and its
surroundings and obtain all information that may be necessary for preparing the proposal at its
own interest and cost.

3.23 Duration of the contract:

3.23.1 The CONTRACT shall be valid for a period of six months from the date of issuance of letter of
award .TSTS reserves the right to extend on the same terms in case of change in scope.

3.24 Payment Schedule

3.24.1 Payment to the successful Bidder would be subject to timely submission of reports, deliverables
and fulfilment of other contractual obligations. Progress reports are to be submitted along with
the payment invoice. No interest shall be payable in case of delayed payments. Amount
qualified for payment will be arrived, considering progress and will be certified by ITE&C
Dept./Third Party Monitoring Agency as per discretion of TSTS. Milestone wise payment are
indicated in the section 4.14.

3.25 Exit Management

3.25.1 This clause sets out the provisions which will apply upon completion of the contract period or
upon termination of the agreement for any contractual breach. The Parties shall ensure that
their respective associated entities, in case of TSTSor any third party appointed by the ITE&C
Dept and in case of the contractor, the sub-contractors, carry out their respective obligations set
out in this Exit Management Clause.
3.25.2 The exit management period starts from the date of takeover by the fiber blowing agency before
the expiry of contract, or in case of termination of contract, or on the date when the notice of
termination is sent to the Bidder. The exit management period ends on the date agreed upon.

3.25.3 Cooperation and Provision of Information


a) During the exit management period:

The Bidder will allow TSTS or any third party appointed by TSTS, access to information
reasonably required to define the then current mode of operation associated with the provision
of the services to enable TSTS or any third party appointed by TSTS to assess the existing
services being delivered;

b) Confidential Information, Security and Data

The Bidder will promptly, on the commencement of the exit management period, supply to
TSTS or any third party appointed by TSTS the following:

i. All confidential information related to TSTS.


ii. All current and updated TSTS data as is reasonably required by TSTS or any third
party appointed by TSTS for purposes of transitioning the services to TSTS or any
third party appointed by TSTS, in a format prescribed by TSTS or any third party
appointed by TSTS.
iii. All other information (including but not limited to documents, records and
agreements) relating to the services reasonably necessary to enable TSTS or any
third party appointed by TSTS, to carry out due diligence in order to transition the
provision of the Services to TSTS or any third party appointed by TSTS, (as the
case may be). Before the expiry of the exit management period, the Bidder shall
deliver to TSTS or any third party appointed by TSTS all new or updated materials
from the categories set out above and shall not retain any copies thereof.

c) General Obligations of the Bidder


The Bidder shall provide all such information as may reasonably be necessary to
bring into effect seamless handover as practicable in the circumstances to TSTS or
any third party appointed by TSTS and which the Bidder has in its possession or
control at any time during the exit management period.

3.26 Information Security

3.26.1 The Bidder shall not carry and / or transmit any material, information, layouts, diagrams,
storage media or any other goods / material in physical or electronic form, which are proprietary
to or owned by TSTS/ITE&C Dept/GoT , without prior written permission from TSTS/ITE&C
Dept/GoT
3.26.2 Bidder acknowledges that TSTS/ITE&C/GoT Dept business data and other TSTS/ITE&C/Dept
Got proprietary information or materials, whether developed by TSTS/ITE&C Dept/GoTor being
used by TSTS/ITE&C Dept/GoTpursuant to a license agreement with a third party (the foregoing
collectively referred to herein as “proprietary information”) are confidential and proprietary to

TSTS/ITE&CDept /GoTand Bidder agrees to use reasonable care to safeguard the proprietary
information and to prevent the unauthorized use or disclosure thereof, which care shall not be
less than that used by Bidder to protect its own proprietary information. Bidder recognizes that
the goodwill of TSTS/ITE&C/GoT Dept depends, among other things, upon Bidder keeping such
proprietary information confidential and that unauthorized disclosure of the same by Bidder
could damage TSTS/ITE&C/GoT Dept and that by reason of Implementation Agency‟s duties
hereunder. Bidder may come into possession of such proprietary information even though
Bidder does not take any direct part in or furnish the services performed for the creation of said
proprietary information and shall limit access thereto to employees with a need to such access
to perform the services required by this agreement. Bidder shall use such information only for
the purpose of performing the said services.
3.26.3 Bidder shall, upon termination of this agreement for any reason or upon demand by
TSTS/ITE&C/GoT, whichever is earlier return any and all information provided to Bidder by
TSTS/ITE&C/GoTincluding any copies or reproductions, both hard copy and electronic.

4. Section IV – Scope of Work

4.1 Project Background

As the world is moving towards a digitally connected society, various countries across the globe have
deployed, adopted & integrated broadband technologies in their ecosystem for economic & social
development and to promote shared growth. Some of the economic benefits of broadband include job
creation, skill development, acceleration of innovation of applications and services, improved
productivity and increased Gross Domestic Product (GDP). According to World Bank, a 10% increase
in broadband penetration may increase the economic growth by 0.43% in low and middle income
countries, 1.21 % in emerging countries and 1.38% in high income countries. This shows the influence
of broadband in spurring the social development across the modern world.

The BharatNet project is essential to cater to the need of connecting the remotest part of the country
i.e. up to the GP level and providing broadband and internet services to the citizens, in the rural areas.
The vision for BharatNet is:

“BharatNet shall be a project of national importance to establish, by 2017, a highly scalable network
infrastructure accessible on a non-discriminatory basis, to provide on demand, affordable broadband
connectivity of 2 Mbps to 20 Mbps for all households and more on demand capacity to all institutions,
to realize the vision of Digital India, in partnership with States and the private sector.”

The State Government has approved the ICT Policy of Telangana to enable proactive and congenial
environment for IT industry to locate, grow and sustain in the state. This shall have a strong bearing on
the economic development of the state as a whole, since IT establishment in the state shall have a
domino effect on multiple economic activities including creation of employment for the youth,
development of opportunities for IT export, increase in productivity through use of automation etc.
Further with ever increasing number of government services moving to cyber space and internet
becoming the new medium of connectivity between citizens and government, requirement for a robust
IT support eco-system has never been more strongly felt. The ICT policy emphasizes on „Digital
Telangana‟ project wherein the Optical Fiber connection would be provided to each household. The
broadband and internet connectivity in the Telangana may boost:

• Development of Telangana
• Promote Digital connectivity across the state
• Promote eGovernance and mGovernance
• Expansion of IT/ ITES sector
• Improve the access to healthcare via telemedicine
• Promote entrepreneurship
• Improve employment options and reduce youth migration
• Promote inclusion and reduce the information barrier
• Connect with the citizens
• Encourage digital connectivity among educational institutes and knowledge societies
• Strengthen accountability and transparency
• Enhance the quality of living

Government of Telangana is taking big leaps to build and leverage the broadband infrastructure under
BharatNet project. It is in this context that Telangana Government has initiated T-FIBER to provide
broadband connectivity up to the household level and reap its benefits. The State Government has
adopted, „State Led Implementation model of BharatNet project‟ for roll-out of optic fiber infrastructure
across the state. The State has also taken a decision to leverage the infrastructure created under
Mission Bhagiratha such as RoW, digging & trenching etc. T-FIBER piggy backs on the Mission
Bhagiratha Project, which shall enable supply of safe drinking water to every household through water
pipelines, thereby achieving Right of Way (RoW) across the whole state. The network will be deployed
along fresh water supply routes which have been already mapped for the entire state. T-Fiber project
will form the basic platform for the provision of a number of services like e-governance, e-health, e-
commerce, e-banking, video on demand, etc.

The objective of this RFP is to hire a system integrator to take over the already laid duct along RWS
routes, conduct Duct Integration Testing (DIT) for existing as well as OFC duct to be laid during the
course of the project, route monitoring, making as-built drawings and handing over the OFC duct to the
cable blowing agency at the time of installation.

4.2 Scope Coverage

4.2.1 Single PLB HPDE duct is currently being laid along the water supply pipe routes of Mission
Bhagiratha and the total work executed till 20 Apr 2017 is approximately 10000kms. The size of
PLB HDPE Duct is 40/33 mm confirming to relevant QR .This 10000 Kms is laid across 31
districts of Telangana. The detailed scope of work to carry out above mentioned activities has
been articulated in the following sections of the RFP.

4.3 Purpose of DIT

Purpose of duct integrity Test is to ascertain and ensure the suitability of the duct for cable installation
through jetting. It is first necessary to ensure that the duct into which cable is to be installed is
continuous over the length of the duct. Some reasons for lack of continuity are:

• Missing Sections of Duct


• Couplers not connected
• Over lapping of Ducts
The Air Test establishes the duct continuity. Air is introduced from one end of the duct. If air comes out
from the other end of the duct, then it is established that the duct is continuous. If no air emerges, then
the fault is to be identified and corrected before proceeding further.

Second step in the DIT Test is to establish that there is a clear passage for the cable to go through the
duct. Possible reasons for lack of clear passageway are:

• Kink in the Duct


• Blockage in the Duct

These deficiencies are to be corrected before proceeding further. Kink in the duct may be caused at the
duct laying stage when back filling may have been done without taking care to keep boulders out of the
way and out of the trench. A fallen boulder on top of a laid duct can cause the problem. The kink may
also have been caused at the de-coiling stage, when this is attempted without use of a de-coiler. The
kink in the buried duct is located through the shuttle Test. A suitable shuttle is first passed through the
duct. The shuttle will get stuck at the point where the duct is either kinked or blocked. Next a transmitter
is passed through the duct. It gets stuck behind the shuttle. The path of the duct is then tracked with a
receiver. As the receiver passes over the transmitter, the signal from the transmitter is heard loud and
clear. In this way the transmitter, and just a head the shuttle, and just ahead the kink are located. The
spot is marked and the trench has to be dug up again. The boulder responsible for the kink is removed.
The portion of the damaged pipe is cut and replaced with good duct of equal length. Joint with laid duct
is made with push-fit coupler.

Cable installation through jetting can be carried out successfully only under a pressure of 10 bar.
Before cable installation is attempted it is necessary to verify that the duct can hold this pressure. This
is the major purpose of the pressure Test. Possible reasons for failure of DIT pressure test are:

• Leakage at Couplers
• Puncture in Duct

Coupler leakage is caused by improper installation of coupler. A puncture in the duct can result from
improper handling of the duct. A sharp-edged boulder if it should come to rest on top of the buried duct
can also puncture the duct. Air leakage from the leaking coupler or the punctured duct is the tale sign
of the problem which can then be rectified.

The list of processes indicated below are to be ensured before taking up the DIT through coordination
with Mission Bhagiratha Agencies. Similar processes needs at the time of handing-over of the Duct for
blowing agency the costs involved shall be in scope of selected SI.

Thus, in summary, the DIT Test is conducted prior to cable blowing/pulling with a view to check and if
necessary rectify so it is made suitable for cable blowing/pulling. The possible duct faults that may
show up during the DIT Test process are:

• Missing sections of duct


• Couplers not connected
• Overlapping of Ducts
• Kink in the Duct
• Blockage in the Duct
• Leaking at Couplers
• Puncture in Duct

These faults are to be corrected before proceeding further.

4.4 General Description

4.4.1 The objective of this RFP is to invite bids for providing end-to-end services to carry out the duct
integration testing, takeover from Mission Bhagiratha agencies, maintenance and handover of
PLB HDPE duct under the OFC Cable agency.
4.4.2 The proposed approach should include the overall methodology for execution of the work
activities along with the tools and equipment required at each location
4.4.3 The Bidder shall not cause any damage to buildings/other premises/property. If any damage
occurs, the Bidder will perform restoration. Trenches, path/road cutting, etc. will be back-filled
and restored to the original condition immediately after completion of rectification work etc. The

4.4.4 The work shall be subjected to inspection at various stages. The Bidder shall follow all Safety
Regulations and practices
4.4.5 Bidder shall spell out various tests that are being proposed to be carried out for demonstrating
the approach and methodology used
4.4.6 Bids must be complete with all equipment and required accessories for the execution of the
work. Materials required during execution of the work such as machines and other required
hardware shall be arranged by the Bidder
4.4.7 The Bidder shall make arrangement of power supply required for on-ground execution of works
4.4.8 Bidder will have complete responsibility of all the equipment‟s and hardware supplied by the
Bidder. After completion of the work Bidder will take away these equipment
4.4.9 Site Survey
a) Bidder on signing of the contract must undertake assessment /survey of the existing PLB HDPE
duct laid covered under the scope of the RFP at all locations
b) The Bidder should submit the detailed execution plan for each activity/site. Bidder should submit
a clear and comprehensive project plan in line with the priorities of all project stakeholders and
the project objectives to TSTS, Govt. of Telangana
c) Bidder is advised to establish a clear understanding and appreciation for various tracks
identified as part of the project execution, as per the timelines and milestones defined in this
RFP document and accordingly channelize and mobilize the resources at all levels to undertake
the required assessment in form of field study / stakeholder discussions / literature review etc.
Workshops and other such interventions may be planned as per requirement to adequately and
effectively complete the on-ground survey & current state assessment towards creating an
overall implementation strategy
d) The Bidder shall do the site survey at its own cost

4.5 As-Build Drawing (ABD) Data & Drawings

4.5.1 SI to ensure collection and collation of data for updation of ABDs on completion of DIT work
4.5.2 SI to prepare a draft format for data updation and approval on the same taken from TSTS.

4.6 Performing DIT

4.6.1 Duct integration test and de-roping includes the following works:
4.6.1.1 De-roping : Till recently the Duct with 6mm PP rope was installed. Due to theft of this
rope in most of the places, from April 2017 Duct suppliers are asked to supply Duct with-
out rope. Any rope retrieved may be handed-over to dept.
4.6.1.2 Ensure installation of route markers, Chambers/Manholes before completion of DIT
4.6.1.3 Ensure fixing of couplers wherever PLB duct is cut and updation of ABDs
4.6.1.4 Clearing obstructions, if any, by opening Test Pits and reinstatement during handing
over to the OFC blowing agency

4.6.1.5 Testing each Kilometre duct for leakages with pressure (DIT)
4.6.1.6 All contingencies such as dewatering etc should be part of the scope and no extra
claims would be permissible

4.7 Steps for Conducting DIT

4.7.1 SI to pull out the entire PP rope from PLB duct and join the open ends with the couplers in
between the chambers
4.7.2 Duct continuity to be checked with Air blowing test. The of purpose Air blowing test is to ensure
that there are no discontinuities (or missing sections) in the duct
4.7.3 After successful Air blowing test a shuttle of a diameter 80% of the duct inside diameter and of
150 mm length to be passed through the duct. Purpose is to check for bends, kinks, crush and
deformity in the duct.
4.7.4 Then, sponge of a diameter two times the duct inside diameter, and length of 100 mm to be
blown through the duct. Purpose of passing, the sponge through the duct is to clean the duct.
4.7.5 Finally, Pressure test to be conducted at 5 bar pressure for 30 Minutes with maximum
permissible drop of 0.5 bar

4.8 Procedure to be Followed/Specification for Tests for DIT

4.8.1 Air blowing


4.8.1.1 Air is introduced into the duct and a check is made at the end of the 500 meters section
of duct.
a) Possibilities are:
• Normal flow of air is perceived at the other end. so far, so good, proceed further with the
DIT Test
• No flow of air at the other end of the duct. Trouble is indicated, Leakage atcouplers,
puncture in duct, missing duct, duct overlap, blockage in the duct
• Less than normal flow of air. Leakage at couplers, puncture in duct
• If there is no flow of air at the other end, check the pressure at the point where air is
introduced into the duct.
• If the pressure is less than normal this would rule out blockage in the duct. It
wouldindicate leakage from the duct or at a coupler location. Higher than normal
pressure, would indicate leakage in the duct
• The problem can be localized by opening the coupler at the 500 meters point and
introducing air onceagain through the duct. This will help identify whether the problem
exists in the first halfkilometer ofthe duct
• If the duct fails Air test, SI to consult with the respective mission Bhagiratha agency to
get the same rectified

4.8.2 Shuttle Test


• Once the air test has been successfully concluded, a shuttle of a diameter 80% of duct
insidediameter and of 150 mm length is passed through the duct
• If the shuttle passes through successfully this confirms that thebends in the duct are
gradual and there are no kinks or deformity that would hinder the progress ofthe optical
fiber cable during the installation process
• The shuttle should pass through a duct length of500 meters in a span of not more than 2
minutes
• In case there is a problem and the shuttle does not emerge from the other end of the
duct even after 2 minutes, then a transmitter is to be blown through the duct to identify
where the shuttle is stuck
• A receiver at the 500 meters point will pick up the signal from the transmitter as it goes
by, and in this way it will be known that the shuttle is stuck in middle of the duct.
• If the duct fails Shuttle test, SI to consult with the respective mission Bhagiratha agency
to get the same rectified

4.8.3 Sponge Blowing


• Post successful completion of the Shuttle Test a sponge of a diameter twice the
insidediameter of the duct, and approx.100 mm in length, is blown through the duct.
• The sponge to be slightly made wet with blowing lubricant
• The time required for thesponge to pass through the 500 meters. duct length is less than
1 minute

4.8.4 Pressure Test


• The pressure test is conducted at up to 10 bar pressure. Over a 10 minutes period the
pressure loss shouldnot exceed 0.5 bar. Once this pressure test passed, the duct is
pronounced ready and fit for cable blowing/pulling
• If the duct fails DIT tests, SI to consult with the respective mission Bhagiratha agency to
get the same rectified

4.9 Work Certification Procedure

4.9.1 The bidder will send daily progress report to ITE&C Department containing DIT measurement
sheet as per the mutually agreed format containing all the performace measurements of the test to
showcase the desired outcome of the DIT.

4.9.2 ITE&C Department will certify the DIT measurement sheet based on physical verificationwhich
will be based on procedures mentioned in section 4.8 of the RFP document by the the onsite
executives and passed on to maintianance.

4.10 Route Taking over & Maintenance

4.10.1 After successful completion of DIT test & submission of ABD, SI is deemed to have taken over
the respective route (duct, chambers & route markers) for maintenance
4.10.2 From the date of taking over the defined route, SI will be fully responsible in all respects for the
PLB HDPE duct along the complete route
4.10.3 SI to deploy patrolling teams to monitor & safeguard the route and will be responsible for the
following:
a) Any damage to the duct, chambers & route markers
b) Repair at his own cost if there is any damage to the duct, chambers & route markers
c) Submission ofweekly reports on condition, status of all routes being monitored to the concerned
nodal officer assigned by TSTS, GoT
d) Any penalty / amount to be collected from any third party for damaging the assets of TSTS, GoT
4.10.4 ITE&C dept may be approached for help bySI if there is any facilitation required for lodging
FIRs, sending notices to any third party etc.

4.11 Route Handing over

4.11.1 The SI is responsible for handover of PLB HDPE duct routes to the Optical Fiber Cable blowing
agenciespost submission of Inspection report of the work executed by Mission Bhagiratha
agency and subsequent approval the nodal officer in-charge for the respective route
4.11.2 SI to provide manpower support and facilitate in rectification of any issue found at the time of
blowing of Optical Fiber Cable. Post completion of blowing of Optical Fiber Cables along the
respective route the SI shall not be responsible for any further activity with respect to
maintenance or monitoring to be carried out on that route.
4.11.3 In case if any damage occurs due to exigency of Govt Agency/Private Agency with proper ROW
if damaged the T-Fiber duct, cost incurred for rectification of damages will beborned by agency
who caused the damages and the required co-ordination is in the scope of the successful bidder
.

4.12 Project Head

g) Shall review quality of project deliverables to ensure compliance with the agreed quality
measures and standards
h) Shall ensure compliance to the terms and conditions of the Contract signed with TSTS

4.13 Project Implementation Timelines

4.14 Payment Schedule as per milestones

4.14.1 Payments will be made to the Bidder as per the invoice raised on monthly basis for the
completion of DIT & ABDs.
4.14.2 For DIT & ABDs 80 % of the invoice amount would be paid to the bidder, rest 20 % would be
paid after handing over to the fiber blowing agency.

4.14.3 Payment shall be made on submission of invoice, progress report, acceptance report for the
length of Duct by the Bidder.
4.14.4 Penalty, if any, as per the timelines defined in RFP shall be calculated on monthly basis and
shall be adjusted against the monthly payment.
4.14.5 O&M payment would be done on monthly basis.
4.14.6 Please note that the section 4.16 only talks about evaluation criteria for identifying L1, the
payments however would be made as per the actual work accepted.

4.15 SLA’s& Penalties

The following are the details for the indicative SLA for the project:

4.15.1 Delays in the contractor‟s performance:

a) The time allowed for completion of the work as entered in the RFP, shall be strictlyadhered by the
contractor and shall be deemed to be the most important aspect of the contract on the part of the
contractor and shall be reckoned from the issue ofwork order by TSTS. The work shall, throughout the
stipulated period of contract, beproceeded with all due diligence to achieve the desired progress
uniformly, and thecontractor shall pay as penalty an amount equal to 0.5 (half) percent of the
contractvalue on the delayed execution of work for every week delayin completion of work, subject to a
maximum of 10 (ten) percent of the cost of the workawarded.

b)On any date the penalty payable as above, reaches 10 (ten) percent of the estimated cost of the
work, the contractor should proceed with the work further only on getting a written instructions from the
TSTS that, he is allowed to proceed further with the work. It will be in the discretion of the TSTS to
allow the contractor to continue with the work on the basis of any written agreement reached between

the contractor and the TSTS, one of the conditions of such agreement may be stipulation for the
contractor to agree for realization of penalty for delay at a higher rate as may be agreed between the
representative of TSTS and the contractor.
