"Star Sanjeevani Scheme" FY-2019-20


For recovery in Small NPA Accounts
upto Rs.100 lakh, in Doubtful / Loss /
Written Off Accounts

The Bank's Board in its meeting dated 28.05.2019 approved scheme for approving
sacrifice / OTS known as "Star Sanjeevani Scheme" with certain modifications in last
FY-2018-19 Scheme.

As the Scheme provides delegation for approving sacrifice / OTS in Doubtful / Loss and
Written Off Accounts with outstanding up to Rs.100.00 lakh, please make full use of the
Scheme to reduce small NPAs / Recovery in Written-Off accounts having direct bearing
on the Bank's profitability. The Scheme provided guidelines for maximum sacrifice,
which delegatee can approve. The main objective of the scheme is to save time as well
as resources at Branches and enable hassle-free generation of OTS proposals, mainly
based on ledger outstanding without considering the value of security and worth of the
Borrower/Guarantor/s.

The salient feature of scheme is as under:


A. Eligibility:
i. The accounts with outstanding upto Rs.100.00 lakhs under Doubtful/Loss and
Regular written Off category as on 31.03.2019 will be eligible under the
Scheme.
ii. Sacrifice in OTS involving Fraud / Malfeasance and Wilful Defaulter shall be as
under:
ZLCC - upto Rs.10.00 lakhs
NBGLCC - above Rs.10.00 lakhs
iii. Staff loans / Loans against TDRs / NSCs / LIC Policies/Gold Loans etc. will be
ineligible under the Scheme.

B. Delegation:

The Branch Manager can settle dues of Category 1, 2 and 3, whereas Category 4
(Ledger 0/s above Rs.50 lakhs up to Rs.100 lakhs) would be considered at SZLCC
level, subject to the following:
i. The powers are to be exercised by the Chief Incumbent / designated Branch
Manager at the Branch. The official approving the compromise proposal should
not have sanctioned the facilities earlier in his personal capacity. In such
cases, it would be referred to the next higher authority (AMO/AMLCC is not
treated as next higher authority) for approval with specific details.
ii. The Branch to conduct latest inspection report of Unit/Borrower/Co-
Borrower/Guarantor.
iii. In Regular Written Off accounts, the Branch Managers in Scale-I and Scale-II
are restricted to approve OTS up to ledger outstanding of Rs.5.00 lakhs only,
whereas accounts of more than Rs.5.00 lakhs of such branches would be
considered by the SZLCC.
iv. Liquid securities, if any, in the form of pledge of Bank's TDR, credit balances, if
any, in any deposit or loan account in same capacity and one Cust ID, assigned
Life Insurance Policies, NSC/KVP/Shares etc. must be appropriated in the
account by following the due procedure before accepting OTS proposal. Such
securities should not form the part of OTS amount. Similar treatment should be
made for subsidies, if any, in the account in consonance with conditions
attached for appropriation of such subsidies and OTS shall be considered on
the residual amount after appropriating subsidies received eligible for credit in
the account.
v. CGTMSE / CGFMU /CGSSI / CGFSEL / CGFSSDL or other Guarantee
covered schemes covered account are eligible and while doing OTS, adhere
to the terms and conditions advised by the Bank and such Guarantee
Corporations' from time to time.
vi. Monthly Reporting of OTS under Star Sanjeevani Scheme to the next higher
authority.

C. Payment Terms:
i. For ledger outstanding/written off amount upto Rs.10.00 lakhs entire
compromise amount will be payable in one lump sum at the time of approval or
latest within 90 days of approval, with minimum 10% of the approved amount to
be paid up front.
ii. For ledger outstanding/written off amount above Rs.10.00 lakhs minimum 10%
of the approved amount to be paid up front and balance amount within 6
months' of approval subject to PDCs being obtained for instalment amount.
iii. No interest if, full OTS amount paid within 90 days of conveying approval of
OTS. Beyond 90 days simple interest will be charged @ 1% above 1 year
MCLR on reducing balance from the date of approval of OTS till full payment,
but not more than 1 year from the date of approval, beyond 1 year from the
date of approval OTS will be treated as revoked and all earlier payments
forfeited against normal recovery..
iv. OTS can be approved for maximum 1 year and period will be counted from the
date of approval.

D. General Condition of the Scheme:


i. In accounts where suits have been filed, a consent decree/application be filed
- before the appropriate Court incorporating inter alia the OTS terms.

ii. The authority approving OTS would concurrently approve interim waiver of
legal action. In other words legal remedies are not barred by limitation in
OTS failed accounts. Hence it is advised to obtain a renewal document from
the borrower \ co-borrower/Guarantors at the time of accepting OTS request.
iii. SAR should have been dealt with while considering the OTS. If, however, for
any reason SAR has not been dealt with, the branch must submit SAR to Zonal
Office within 30 days and ZO to deal SAR within 30 days from the date of
submission.
iv. While issuing No Dues Certificate, the branch should incorporate following
clause:
a. Undertaking to be obtained against the future claims, statutory dues
against the Borrower, bank will not be liable for Borrower's responsibility
against such dues.
b. Any legal dispute due from other would be at the risk and responsibility of
the Borrower and the Company and Promoters has to undertake that the
Bank has no liability with regards to any dispute/ claims/ injunction etc.
c. In future, if any fraud is found, the same will be dealt with as per Bank's
policy.
v. The scheme is non-discretionary and non-discriminatory in nature.
vi. The Scheme is effective from the date of board approval and will remain in
force up to 31.03.2020.

E. Conditions for doing OTS in Fraud I Malfeasance reported cases:


i. With regard to Fraud/Malfeasance reported cases, Branch should inform the
investigating authorities, such as, CBI/Police etc. as per Para 7.5.6.f & g of
NPA Management Policy, 2018 and compromise be entertained upon
completion of the above requirements.
ii. Post settlement, criminal case should not be withdrawn by Bank. All assistance
required by the Investigating Agency or Court to take the case to logical
conclusion of the criminal proceedings should be provided. Proper briefing
should be given to the officials of the bank appearing in the courts when such
cases come up for hearing so that the officials depose appropriately in terms of
the agreement in the settlement.
iii. After settlement, file relating to the account should not be destroyed or sent to
old records. The same should be kept safely/properly till the conclusion of
criminal proceedings.
iv. NO DUES CERTIFICATE: Branch to add a clause in the 'No Dues
Certificate' to be issued to the borrowers/guarantors as under —
"Account closed under Compromise, this 'No Dues Certificate' is issued
without prejudice to any criminal cases initiated against the borrowers
and/or guarantors and/or third parties irrespective of whether the offence
is compoundable or not and Bank intends the law to take its own course
till logical conclusion of such criminal cases as compromise is
entertained as a commercial prudence to recover the money without
prejudice to such criminal actions."
F. Deviation:
Deviation in sacrifice and payment terms for accounts below the level of SZLCC
will rest with the respective SZLCC, whereas those under delegation of SZLCC
will rest with ZLCC.

G. All branches are advised to scan NPA portfolio and find out eligible accounts
under Asset code 31, 32, 33 & loss, as well as regular write-off accounts also.
The Branches should take maximum advantage of the liberal delegation of
powers under the scheme and maximise the recovery to bring down the NPA
level by :
i. Organising minimum two Recovery camps per Branches every month /
participation in more Lok Adalats.
ii. No eligible Borrower is left out for contact for recovery.
iii. Use of Recovery Agents / BFs / BCs for enhancing recovery. Charges for
recovery agents will be over and above the OTS amount.
iv. The Branch to maintain proper record of contacted Borrower with
acknowledgement for this scheme.

Please bring to the notice of all staff members, particularly who are involved in
recovery work. The Zonal Managers may discuss the salient features of the scheme,
during the course of Managers' Conference to give thrust to recovery through " Star
Sanjeevani Scheme".

The Scheme is effective from 28.05.2019. Simplified Format for approval of OTS, as
per Annexure 'A' for considering OTS under the Scheme and Reporting of Monthly
Progress as per Annexure 13' are annexed.
