22 Pursuant to A.R.S. §§ 12-2021 et seq., and 19-122(C); Arizona Rule of Procedure
23 for Special Actions 1; and Arizona Rule of Civil Procedure 7.3, the Plaintiffs challenge the
24 People’s Defense Committee, Marion Chubon, Steve Diamond, and Joel Feinman’s effort
25 to include on the November 5, 2019, general election ballot the Tucson Families Free and
26 Together initiative measure (the “Initiative”) and further challenge the Defendants’
27 certification thereof for inclusion of the measure the November 5, 2019 general election
28

ballot. Said certification by Defendants is ultra vires in that the Mayor and Tucson City
2
Counsel do not have the authority to adopt or submit the Initiative to a vote of the people
3
because the petition failed to meet the requirements set forth by Article 4, Part 1, Section
4
1(8) of Constitution of the State of Arizona and A.R.S §§ 19-121.01, 19-121.03, 19-141,
5
and 19-143(A), and for the other reasons stated herein.
6
For their Verified Complaint, the Plaintiffs allege the following:
7
JURISDICTION AND VENUE
8
1. Plaintiff Benny White is a qualified elector and registered voter residing at 1715
9
East Kleindale Road, Tucson, Arizona, 85719 which is located within the boundaries of
10
the City of Tucson.
11
2. Plaintiff Ann Hollis is a qualified elector and registered voter residing at 8900
12
East Bears Path, Tucson, Arizona, 85749 which is located within the boundaries of the
13
City of Tucson.
14
3. Plaintiff Mike Ebert is a qualified elector and registered voter residing at 4001
15
East 17th Street, Tucson, Arizona, 85711 which is located within the boundaries of the City
16
of Tucson.

4. Defendant Roger Clark (the “City Clerk”) currently holds office as the City
18
Clerk for the City of Tucson and is named herein as a nominal defendant. The City Clerk
19
is the filing officer for city initiative petitions pursuant to A.R.S. § 19-143(B). The City
20
Clerk is also charged by A.R.S. § 19-141(A) with the duties of removing facially invalid
21
petition signatures per A.R.S. § 19-121.01, transmitting a random sample of any remaining
22
valid signatures to the county recorder for verification, distributing pamphlets to registered
23
voters, and publishing the general election ballots for use in the City of Tucson.
24
5. Defendant F. Ann Rodriguez (the “Recorder”) currently holds office as the Pima
25
County Recorder, and is named herein as a nominal defendant. The Recorder has the duty
26
of maintaining the general county register of voter records for Pima County, which
27
includes all of the City of Tucson. The Recorder is charged by A.R.S. § 19-121.01(B) with
28

verifying that all signatures in the random selection are from qualified electors, and
2
certifying the petition results.

6. Defendant Jonathan Rothschild (the “Mayor”) currently holds office as Mayor
4
for the City of Tucson, and Defendants Regina Romero, Paul Cunningham, Paul Durham,
5
Shirley Scott, Richard Fimbres, and Steve Kozachik (collectively the “Tucson City
6
Council”) currently hold office as Councilmen for the City of Tucson. The Mayor and
7
Tucson City Council are named herein as nominal defendants in their official capacities.
8
The Mayor and council are charged by Part I, Chapter XIX, Section 4 of the Charter for
9
the City of Tucson with adopting a valid initiative petition or submitting the proposed
10
initiative to a vote of the people.
11
7. Defendant Brad Nelson is currently the Elections Director for the Pima County
12
Elections Department (the “Elections Director”). The Elections Director is named herein
13
as a nominal defendant in his official capacity. The Elections director certifies all county-
14
wide election ballots prior to elections.
15
8. Ally Miller, Ramon Valdez, Sharon Bronson, Steve Christy, and Richard Elias,
16
(collectively the “Board of Supervisors”) currently hold office as the Pima County Board
17
of Supervisors. The Board of Supervisors is named herein as nominal defendants in their
18
official capacities. The Board of Supervisors certifies all county-wide election ballots prior
19
to elections.
20
9. Real Party-in-Interest People’s Defense Committee (the “Committee”) is a
21
political committee and an unincorporated association that filed its Statement of
22
Organization with the Office of the City Clerk for the City of Tucson on November 27,
23
2018, and filed petition signatures for the Initiative with the City Clerk on July 3, 2019.
24
10. Real Parties-in-Interest Marion Chubon, Steve Diamond, and Joel Feinman
25
(collectively the “Petitioners”) are the individuals identified by the petition as the parties
26
to be notified of all proceedings and actions taken in reference to the petition.
27
11. This Court has jurisdiction under Article 6, Section 13 of the Arizona
28

Constitution, and A.R.S. §§ 12-123(A); 12-1801 et seq.; 12-1831 et seq.; 19-122(C); the
2
Arizona Rules of Procedure for Special Actions; and Rules 57 and 65 the Arizona Rules
3
of Civil Procedure.

12. Injunctive, mandamus, special action, and other relief sought is proper because
5
Plaintiffs and other City of Tucson taxpayers will suffer irreparable injury unless the
6
requested relief is granted, and there exists no other equally plain, speedy, and adequate
7
remedy. The City of Tucson has already incurred significant expenditures to date by
8
receiving, counting, and processing petitions for the Initiative. More expenditures will be
9
incurred by the City of Tucson to prepare a voter publicity pamphlet per A.R.S. § 19-123.
10
13. Declaratory relief is appropriate here because, among other things, this action
11
seeks a declaration of rights, status, and other legal relations between Plaintiffs and
12
Defendants with respect to the constitutionality and applicability of Part I, Chapter XIX,
13
Section 4 of the Charter for the City of Tucson.
14
14. Venue is proper in Pima County under A.R.S. § 12-401 and 19-121.03.
15
FACTUAL ALLEGATIONS
16
15. Article IV, Part I of the Constitution of the State of Arizona reserves to the
17
people the right to propose laws and amendments to the state constitution through the
18
power of the initiative.
19
16. Under the power of the initiative fifteen per centum of the qualified electors may
20
propose measures on local, city, town, or county matters.
21
17. As of the previous general election in 2017, there were 241,495 registered voters
22
in the city of Tucson.
23
18. The Constitution allows cities, towns, and municipalities to determine the
24
“basis” (that is, a selected office or offices up for election) upon which fifteen per centum
25
of qualified electors is calculated until the State Legislature provides, by general law, an
26
alternative basis on which said percentages shall be computed.
27
19. A.R.S. § 19-143, which is a general law, provides that the basis upon which the
28

number of qualified electors is computed for a city initiative is the general election wherein
2
a mayor or councilman was chosen last.
3
20. The election in the City of Tucson at which a mayor or councilman was chosen
4
last was the 2017 general election held on November 7, 2017.
5
21. In the 2017 general election, 85,468 votes were cast. Fifteen percent of the votes
6
cast is 12,821.
7
22. Although the general law allows cities to determine an alternative basis (i.e., the
8
office up for election) upon which the number of qualified electors is computed, A.R.S. §
9
19-141(D) requires municipal legislation to be as nearly as practicable the same as the
10
procedure relating to initiatives provided by the Legislature for the state at large.
11
23. Part I, chapter XIX, section 1 of the Charter of the City of Tucson prescribes a
12
substantially more limited procedure than the general law for calculating the number of
13
qualified electors, which only counts votes cast for candidates for mayor at the last
14
preceding general municipal election at which a mayor was elected, rather than all votes
15
cast. Therefore, the portion of the city charter that modifies the procedure for calculating
16
the number initiative signatures is invalid.
17
24. The election in the City of Tucson at which a mayor was chosen last was the
18
2015 general election held on November 3, 2015.
19
25. In the 2015 general election, 82,420 votes were cast. Of votes cast, 65,685 votes
20
were cast for the Democratic candidate and write-in candidates for mayor. No Republican,
21
Green Party, Libertarian, or any other candidates for mayor appeared on the 2015 ballot.
22
Fifteen percent of the votes cast for the Democratic candidate and write-in candidates is
23
9,853. This figure excludes all undervotes and overvotes cast in the 2015 election.
24
26. On December 4, 2018, the Committee submitted to the City Clerk an Initiative
25
Petition Application for Serial Number. The City Clerk issued serial number 2018-I001
26
and indicated that 9,241 valid signatures needed to be submitted by July 5, 2019. The
27
number of signatures indicated as required by the City Clerk is less than 15% of votes cast
28

for candidates for mayor in the 2015 election, and is only 3.83% of the total number of
2
registered voters in the City of Tucson as of the last general election.
3
27. On July 3, 2019, the Committee filed 18,200 signatures with the City Clerk.
4
28. A.R.S. § 19-121.01, read in conjunction with A.R.S. § 19-143(A), requires the
5
City Clerk to review every petition sheet and petition line, then cross out and invalidate all
6
facially invalid petition signatures and signature sheets, compile a random sample of five
7
percent of the remaining petition signatures, and transmit the random sample to the County
8
Recorder to verify that the signatures are from qualified electors. The percent of valid
9
signatures in the random sample is then applied to the total number of facially valid
10
signatures, and the County Recorder shall certify the total number of valid signatures.
11
29. Instead, the City Clerk only conducted a cursory review of the signatures
12
submitted by the Petitioners, failed to satisfy his statutorily defined duties, and only
13
disqualified 798 signatures despite thousands of facially invalid signatures.
14
30. The Secretary of State generated a random sample of 871 signatures that were
15
transmitted to the Recorder.
16
31. On July 15, 2019, the Recorder certified 12,488 signatures submitted by the
17
Committee.

32. The preceding paragraphs, as well as the following paragraphs, are incorporated
23
herein by reference.
24
33. The City Clerk required an insufficient number of petition signatures in order to
25
present the Initiative to the Mayor and Council because Part I, Chapter XIX, Section 1 of
26
the Charter of the City of Tucson is unconstitutional.
27
34. Article 4, Part 1, Section 1(8) of the Constitution of the State of Arizona requires
28

city and town initiatives to be supported by fifteen percent of the qualified electors, but
2
allows the State Legislature to prescribe the basis on which the percentages shall be
3
computed.
4
35. Part I, chapter XIX, section 1 of the Charter of the City of Tucson provides that
5
the basis for computing the number of qualified electors for a city initiative is the election
6
in which the mayor was chosen last. Additionally, the charter changes the procedure for
7
calculating qualified electors to be only fifteen percent of the votes cast for candidates for
8
mayor rather than total votes cast at the election in which the mayor was elected last.
9
36. Part I, chapter XIX, section 1 of the Charter of the City of Tucson violates the
10
Constitution of the State of Arizona because it excludes those voters who chose not to cast
11
a vote for the single candidate for mayor from inclusion in the procedure for calculating
12
the number of qualified electors required to sign an initiative petition, thereby artificially
13
reducing the pool of qualified electors in contradiction of the requirement that fifteen
14
percent of all qualified electors be calculated.
15
37. Because Part I, chapter XIX, section 1 of the Charter of the City of Tucson is
16
unconstitutional, A.R.S. § 19-143 applies, which requires 12,821 signatures for an
17
initiative in the City of Tucson to be submitted to the Mayor and City Council for possible
18
inclusion on the November 5, 2019, general election ballot.
19
38. As the City Clerk only verified 12,488 signatures, Petitioners failed to submit
20
sufficient valid signatures for the Initiative to be submitted to the Mayor and City Council
21
for possible inclusion on the November 5, 2019, general election ballot.
22
39. The Plaintiffs have no plain, speedy, and adequate remedy at law. Accordingly,
23
the Plaintiffs are entitled to declaratory relief, injunctive relief, a writ of prohibition, and/or
24
a writ of mandamus preventing the Initiative from appearing on the November 5, 2019,
25
general election ballot.

41. The City Clerk required an insufficient number of petition signatures in order to
6
present the Initiative to the Mayor and Council because Part I, Chapter XIX, Section 1 of
7
the Charter of the City of Tucson is preempted by Title 19, Chapter 2, Article 4 of Arizona
8
Revised Statutes.
9
42. A.R.S. § 19-143 provides that the basis on which the percentage for computing
10
the number of qualified electors required to sign a petition for a city initiative is fifteen
11
percent of the whole number of votes cast at a city election at which a mayor or councilman
12
was chosen last.
13
43. The statute provides that cities may provide an alternative basis for computing
14
the number of necessary signatures, but A.R.S. § 19-141(D) requires the procedure with
15
respect to municipal and county legislation to be as nearly as practicable the same as the
16
procedure relating to initiative and referendum provided by the Legislature for the state at
17
large.
18
44. Cities and towns are provided the opportunity to provide an alternative basis
19
because not all cities and towns have a mayor or council. For example, A.R.S. § 9-284
20
allows a city to adopt a Charter Government wherein the city elects a board of freeholders
21
rather than a mayor or council. The general law related to initiatives and referendums
22
provides a mechanism for these towns and cities to take part in the initiative process by
23
amending the basis for the computation to be an official other than mayor or councilman.
24
45. “While the Arizona Constitution gives localities broad initiative and referendum
25
powers, when a local law conflicts with a state statute, the local law is invalid.” Fleischman
26
v. Protect Our City, 214 Ariz. 406, 409, ¶ 15 (2007); Ariz. Const. art. 4, pt. 1, § 1(8).
27
46. A.R.S. § 19-143 provides that the basis on which the number of qualified
28

electors is computed for a city initiative is the election at which a mayor or councilman
2
was chosen last. Additionally, the procedure for calculating the number of qualified
3
electors is to multiply the total number of votes cast at the previous general election by
4
fifteen percent. Under the statute, the number of petition signatures required for an
5
initiative in the City of Tucson for this election cycle would be 12,821.
6
47. Part I, chapter XIX, section 1 of the Charter of the City of Tucson provides that
7
the basis on which the number of qualified electors is computed for a city initiative is the
8
election at which the mayor. The city charter also modifies the procedure for calculating
9
the number of qualified electors is to multiply the number of votes cast for candidates for
10
mayor at the previous general election by fifteen percent. Under the charter, the number of
11
petition signatures required for an initiative in the City of Tucson for this election cycle is
12
only 9,853.
13
48. Part I, chapter XIX, section 1 of the Charter of the City of Tucson is preempted
14
by A.R.S. § 19-143 because the City Charter wrongfully mandates an improper procedure,
15
for computing the number of qualified electors in violation of A.R.S. § 19-141(D), and
16
dramatically and wrongfully deflates the number of signatures required for an initiative in
17
the City of Tucson for this election cycle. Therefore, the local law is preempted by state
18
statute and invalid.
19
49. Because Part I, chapter XIX, section 1 of the Charter of the City of Tucson is
20
preempted by A.R.S. § 19-143, the statute should apply, and the Court should declare that
21
12,821 signatures are required for an initiative in the City of Tucson to be submitted to the
22
Mayor and City Council for possible inclusion on the November 5, 2019, general election
23
ballot.
24
50. As the City Clerk only verified 12,488 valid signatures, Petitioners failed to
25
submit sufficient valid signatures for the Initiative to be submitted to the Mayor and City
26
Council for possible inclusion on the November 5, 2019, general election ballot.
27
51. The Plaintiffs have no plain, speedy, and adequate remedy at law. Accordingly,
28

the Plaintiffs are entitled to declaratory relief, injunctive relief, a writ of prohibition, and/or
2
a writ of mandamus preventing the City Clerk, Mayor, and City Council from placing the
3
Initiative on the November 5, 2019, general election ballot.

52. The preceding paragraphs, as well as the following paragraphs, are incorporated
8
herein by reference.The City Clerk required an insufficient number of petition signatures
9
in order to present the Initiative to the Mayor and Council, even if the City Charter is held
10
to be constitutional and not preempted by statute, because the City Clerk’s interpretation
11
of Part I, Chapter XIX, Section 1 of the Charter of the City of Tucson causes an absurd
12
result.
13
53. An absurd result is one “so irrational, unnatural, or inconvenient that it cannot
14
be supposed to have been within the intention of persons with ordinary intelligence and
15
discretion.” State v. Estrada, 201 Ariz. 247, 251, ¶ 17, 34 P.3d 356, 360 (2001).
16
54. Article 4, Part 1, Section 1(8) of the Constitution of the State of Arizona
17
mandates that initiative petitions for city and town initiatives must be supported by fifteen
18
percent of the qualified electors.
19
55. In the 2015 general election, 82,420 votes were cast. Of votes cast, 61,358 votes
20
were cast for the Democratic candidate for mayor, 4,327 votes were cast for write-in
21
candidates, 22 overvotes were cast, and 16,713 undervotes were cast.
22
56. When calculating the number of required signatures, the City Clerk added the
23
number of votes for only three write-in candidates—totaling 245 votes—to the 61,358
24
votes for the Democrat candidate, and multiplied by fifteen percent, which equals 9,241.
25
The City Clerk then published this as the number of signatures required to submit an
26
initiative to the Mayor and City Council for consideration. The City Clerk did not include
27
any undervotes or overvotes by qualified electors that were caused by the lack of a
28

preferred candidate on the ballot, and the resulting calculus causes an absurd vote.
2
57. The City Clerk’s interpretation of the City Charter would only require the
3
signatures of 3.83% of registered voters to submit an initiative to the Mayor and City
4
Council, discounting the votes of qualified electors that cast a vote for a “non-qualified
5
candidate;” qualified electors that cast ballots in the election, but did not want to vote for
6
the Democratic candidate or a write-in candidate; and qualified electors that erroneously
7
filled in two options for mayor.
8
58. The Arizona Constitution requires fifteen percent of qualified voters to pass
9
initiatives, but the City Clerk’s interpretation discounts known qualified voters by only
10
recognizing the qualified electors that happen to have a candidate from their political party
11
on the ballot, or that lodged a write-in vote for a “qualified candidate.”
12
59. The City Clerk’s interpretation of the City Charter, which discounts a significant
13
percentage of known qualified voters, creates an absurd result that is so irrational and at
14
odds with both the Constitution of the State of Arizona and state statutes, that it cannot
15
have been the intended result.
16
60. The only interpretation of the City Charter that produces a sound result is for the
17
City Clerk to consider all write-in votes, overvotes, and undervotes as votes for a candidate
18
for mayor. Fifteen percent of qualified electors computed based on this rational procedure
19
is 12,363.
20
61. As the only rational interpretation of the City Charter requires 12,363 for an
21
initiative in the City of Tucson to be submitted to the Mayor and City Council for possible
22
inclusion on the November 5, 2019, the City Clerk only verified 12,488 valid signatures,
23
and, as outlined in Counts 6 and 7 below, several thousand of the signatures verified by
24
the City Clerk are actually invalid, Petitioners failed to submit sufficient valid signatures
25
for the Initiative to be submitted to the Mayor and City Council for possible inclusion on
26
the November 5, 2019, general election ballot.
27
62. The Plaintiffs have no plain, speedy, and adequate remedy at law. Accordingly,
28

the Plaintiffs are entitled to declaratory relief, injunctive relief, a writ of prohibition, and/or
2
a writ of mandamus preventing the City Clerk, Mayor, and City Council from placing the
3
Initiative on the November 5, 2019, general election ballot.

63. The preceding paragraphs, as well as the following paragraphs, are incorporated

64. A.R.S. § 19-121.01, read in conjunction with A.R.S. § 19-141(A) and (D),
10
requires the City Clerk to review every petition sheet and every signature line on every
11
sheet in order to remove facially invalid petition signatures prior to generating a random
12
sample of signatures that are to be transmitted to the Recorder for verification.
13
65. The City Clerk failed to review every petition sheet and every line, thus, the City
14
Clerk violated the requirements of the statute and the certification by the City Clerk and
15
the Recorder is invalid.
16
66. The City Clerk disqualified only 798 facially invalid petition signatures based
17
upon its limited review, despite there being thousands more facially invalid petition
18
signatures.
19
67. Because the City Clerk did not meet its statutory obligation of removing all
20
facially invalid petition signatures prior to producing a 5% sample for verification by the
21
Recorder, the Recorder’s certification rate is invalid and must be overturned.
22
68. Accordingly, the City Clerk’s certification that the Petitioners submitted
23
sufficient petition signatures for the Initiative to be submitted to the Mayor and City
24
Council for possible inclusion on the November 5, 2019, general election ballot is also
25
invalid and must be overturned.
26
69. The Plaintiffs have no plain, speedy, and adequate remedy at law.
27
Accordingly, the Plaintiffs are entitled to declaratory relief, injunctive relief, a writ of
28

prohibition, and/or a writ of mandamus preventing the City Clerk, Mayor, City Council,
2
Elections Director, and Board of Supervisors from placing the Initiative on the
3
November 5, 2019, general election ballot.

71. A.R.S. § 19-121.01, read in conjunction with A.R.S. §§ 19-141(A) and (D),
10
requires the City Clerk to review every petition sheet and every signature line on every
11
sheet in order to remove facially invalid petition signatures prior to generating a random
12
sample of signatures that are to be transmitted to the Recorder for verification.
13
72. After facially invalid signatures are removed, five percent of the remaining
14
signatures are randomly selected and transmitted to the Recorder for verification. The
15
Recorder is charged with removing signatures that are, inter alia, not qualified electors.
16
The recorder then calculates the percentage of signatures in the random sample that were
17
removed, and removes the same percentage of signatures from the list of signatures created
18
by removing facially invalid signatures.
19
73. Here, the City Clerk performed only a cursory review of the petition sheets and
20
only removed 798 facially invalid signatures. The Secretary of State then selected a
21
random sample of signatures, including signatures that were facially invalid because the
22
City Clerk did not fully comply with his statutorily required duties, and the City Clerk
23
transmitted the sample to the Recorder.
24
74. The Recorder’s subsequent verification is invalid because the Recorder verified
25
signatures that should have been removed prior to the Clerk transmitting the sample to the
26
Recorder. The certification is also invalid and must be overturned.

75. The Plaintiffs have no plain, speedy, and adequate remedy at law.

97. The Plaintiffs challenge four thousand two hundred forty-eight (4248)

A.R.S. § 19-121.01 requires the Secretary of State to identify the County of the majority
13
of lines on each sheet, then remove any lines for other counties. This is so that the
14
Secretary of State can quickly identify the signatures that are outside the required
15
jurisdiction and determine if the signatures are facially valid. A.R.S. § 19-141(A)
16
requires the City Clerk to perform the functions of the Secretary of State in city and town
17
initiatives. A.R.S. § 19-141(D) requires the procedures for municipal initiatives to be as
18
nearly as practicable the same as the procedure for the state at large. Because all of the
19
City of Tucson falls within Pima County, the City Clerk includes a space for petition
20

98. As set forth above, 6,249 signatures6 are invalid, and Petitioners failed to
8
submit a sufficient number of valid signatures for the Initiative to be submitted to the
9
Mayor and City Council for possible inclusion on the November 5, 2019, general
10
election ballot.

99. A copy of each petition sheet, front and back, is attached hereto as Exhibit 2.

100. The Plaintiffs have no plain, speedy, and adequate remedy at law.
13
Accordingly, the Plaintiffs are entitled to declaratory relief, injunctive relief, and/or a
14
writ of mandamus preventing the City Clerk, Mayor, City Council, Elections Director,
15
and Board of Supervisors from placing the Initiative on the November 5, 2019 general
16
election ballot.
17
WHEREFORE, the Plaintiffs respectfully demand that the Court enter judgment
18
granting the following relief:
19
A. Declaring that Part I, Chapter XIX, Section 1 of the Charter of the City of
20
Tucson is unconstitutional;
21
B. Declaring that Part I, Chapter XIX, Section 1 of the Charter of the City of
22
Tucson is preempted by A.R.S. § 19-143;
23
C. Declaring that the City Clerk incorrectly calculated the number of required
24
signatures required by the same provision;
25
D. Declaring that the certification made by the Recorder is invalid;
26
E. Declaring that Petitioners failed to submit a sufficient number of valid signatures

ballot that includes the Initiative;

H. Issuing an injunction permanently enjoining and preventing the City Clerk from
8
printing or preparing a publicity pamphlet or an official ballot that will include
9
the Initiative;

I. Issuing an injunction permanently enjoining and preventing the Mayor and City
11
Council, in their official capacities, from passing the ordinance, calling a special
12
election pursuant to Part I, Chapter XIX, Section 4 of the Charter of the City of
13
Tucson, or placing the initiative on the November 5, 2019 general ballot;
14
J. Awarding Plaintiffs’ attorneys’ fees under A.R.S. §§ 12-348(A)(4), 12-2030,
15
the private attorney general doctrine, and any other applicable rule, case or
16
statute;
17
K. Awarding the Plaintiffs’ court costs against the Committee pursuant to A.R.S.
18
§§ 12-341 and 12-1840; and
19
L. Awarding the Plaintiffs all other relief as is just, proper, or equitable under the
20
facts and circumstances of this case.
