AGREEMENT BETWEEN SENDING ORGANIZATION

AND TECHNICAL INTERN TRAINEE

This Contract made and entered into by and between PRUDENTIAL EMPLOYMENT AGENCY
INC., a corporation duly organized and existing under Philippine laws with office address at
Units C, D, E, F & H, 2nd Floor, and Units F & G 3rd Floor Miki Mari Building, Sta. Cecilia Road,
Talon 2, Las Piñas City, Metro Manila, Philippines, represented herein by its Chairman and
President, MS. MARIA GINA G. FUJIMOTO, hereinafter known as “Prudential” and
MS. JAVILLONAR, VALERIE ACOSTA, of legal age, single and a resident of LANTAG SANTA
CRUZ, ILOCOS SUR, selected Prudential Technical Intern by KUSHIRO OHTA AGRICULTURAL
COOPERATIVE, under POEA-OTIT Technical Intern Training Program (TITP) hereinafter known as
the “Technical Intern”;

1. That in connection with the Philippine Overseas Employment Administration (POEA) and
Organization for Technical Intern Training (OTIT) Technical Intern Training Program (TITP),
Prudential has signed an Agreement Concerning Technical Intern Training Program with
KUSHIRO OHTA AGRICULTURAL COOPERATIVE with address at 19-1 OHTA
GONOTORI AKKESHI-CHO AKKESHI-GUN HOKKAIDO JAPAN.
2. That the duration of the technical intern training shall be from MARCH 22, 2018. The
technical intern training shall be for a period of 12 months, including about 1 month
lectures after entry to Japan. The contract duration is initially valid for one year and
allowable extension of two (2) more years. However, the contract may not be renewed
depending on the or cannot renew the contract due to a downturn in business performance.
Technical Intern trainees who enter Japan after February 1, 2018 are to be allowed to extend
the technical intern training for two years under the new law, but in this case, supervising
organizations, organization implementing technical intern training (enterprise which accepts
trainees) and the technical intern trainee must qualification to extend respectively. Even in
that case, the technical intern trainee must return home staying for at least one month after
completing the 3-year technical intern training.
3. That the Technical Intern, after having been-duly pre-qualified by Prudential and
interviewed by representative of Implementing Organization/Supervising Organization and
was selected for technical intern training for LIVESTOCK AGRICULTURE (DAIRY) which
the Technical Intern accepted under the following conditions:
3.1. That the Technical Intern shall submit valid and true information and genuine
documents required under the technical training, a complete list of which is hereby
attached as “ Annex A”;
3.2. That the Technical Intern must be medically and psychologically fit as required;
3.3. That the Technical Intern shall complete a total of 368 hours over of classroom lecture in
Japanese Language, general knowledge of life in Japan and other knowledge useful for the
smooth acquisition of skills;
3.4. That the training shall in no way be construed as normal employment and for which the
trainee shall be paid a regular salary and may likewise be provided with other benefits as
provided in the employment contract for technical intern training of which is hereby
attached as “Annex B”.
4. That the Technical Intern’s Philippine Employer VILLA LAURENCIA, STA.CRUZ FARMERS
ASSOCIATION, INC. with address BRGY. VILLA LAURENCIA, STA.CRUZ, ILOCOS SUR
has approved of the technical intern training in Japan and has agreed to rehire/reinstate to the
position last held in the Company without demotion in rank and diminution in salary and
benefits as the Intern further agrees to free his/her employer from any responsibility or
obligations for the duration of his/her overseas technical internship training and hereby waives
any salaries or benefits from Philippine Employer/Sending Company for the duration of the
overseas technical internship program;

5. The Technical Intern hereby confirms that Prudential Employment Agency Inc., the
Philippine Overseas Employment Administration (POEA), nor his/her Philippine
Employer/Sending Company, their respective Trustees, Directors, management officers,
staff or employees have not charged nor collected nor intending to claim nor request any
fees, charges, bond or guarantee whatsoever in connection with his/her application and
acceptance of this technical internship program for skills upgrading in Japan.
6. Treatment during the period of lectures shall be as follows.
6.1. During the period of lectures at the beginning of entry into Japan, the supervising
organization shall pay directly on a designated day, actual living expense as an allowance
that can maintain the living standard of the average Japanese. The amount of this lecture
allowance per month shall be ¥70,000 (including food expenses) per person and if it is
paid in cash, the receipt seal or receipt signature of the technical intern trainee
himself/herself shall be required. In case transportation fees for lectures occur in Japan,
actual expenses shall be paid to technical intern trainees, in addition to the allowance for
lectures.
6.2. Regarding the accommodation during the period of lectures, the supervising organization
shall secure and provide it to technical intern trainees free of charge. Accommodation
shall be furnished with equipment which are necessary for daily life.
6.3. The hours of lectures shall not exceed 40 hours a week and it shall not be given during the
time and days other than designated in advance.
6.4. Supervising organization shall take out private accident insurance such as comprehensive
insurance for foreign technical intern trainees and take security measures for the case of
death, injury or illness during the period of lectures.
7. Treatment during the period of technical intern training (except for the period of lectures, the
same in the following paragraph) shall be as follows.
7.1. After completion of the lectures, technical intern trainees shall engage in the activities of
technical intern training under the employment contract with the implementing
organization and the said employment contract shall be concluded in connection with
procedures of entry into Japan and become effective after completion of the lectures. In
addition, notification of employment terms and conditions for technical intern trainees
shall be delivered to them both in their own language and in Japanese when the
implementing organization concludes the employment contract.
7.2. The implementing organization shall pay wage to technical intern trainees directly in full,
on a designated day every month. However, it can deduct taxes and social insurance
stipulated in the laws and regulations in Japan as well as certain amount of deduction from
the wage within the limit of the agreement between labor and management if such
deductions are approved by both parties provided that the amount to be deducted under
such agreement shall not exceed actual expenses. Furthermore, in case of paying wage
in cash, the implementing organization shall provide technical intern trainees with pay slip
and receive the receipt seal or receipt signature of the technical intern trainees for the
payroll book. In case of bank transfer, the implementing organization shall conclude an
agreement on bank transfer between management and labor, obtain consent of technical
intern trainees and provide them with the pay slip. In addition, if moving expenses occur
in Japan during the period of technical intern training, the implementing organization shall
pay allowances such as travel expenses, etc. pursuant to the provisions of the rules of the
implementing organization.
7.3. Regarding the accommodation during the period of technical intern training, supervising
organization or implementing organization shall secure and provide it to technical intern
trainees free of charge or with charge.
7.4. Designated working hours during the period of technical intern training shall not exceed
40 hours a week and eight hours a day in principle, except for break. However, if an
agreement is concluded between the management and labor, the implementing
organization may have technical intern trainees work overtime and on holidays within the
limit of such agreement paying additional cost. In addition, even in the case where the
implementing organization wants to have technical intern trainees work overtime on

holidays or at midnight, the implementing organization shall give consideration so that
technical intern trainees may not work for long hours according to the purpose of the
TITP and establish a system where the implementing organization can guide technical
intern trainees.
8. As a Technical Intern in Japan, the Technical Intern hereby undertakes and guarantees to
strictly adhere to the following obligations and responsibilities:
8.1 To faithfully participate and complete the program in Japan without giving problem to the
implementing organization, supervising organization, sending organization, Prudential,
POEA, OTIT and Japan Immigration Office;
8.2 To promptly return to the Philippines after completing the technical intern training and
report immediately to National Reintegration Center for OFWs-OWWA (NRCO-OWWA),
Prudential, to the Sending Company/Employer and be reinstated to his/her former
position and share the technology acquired to contribute to the development of his
company and country without any thought of further compensation or monetary
considerations;
8.3 Comply with all the terms and conditions of the training program;
8.4 Fully and faithfully obey Japanese laws and regulations, rules and ordinances during the
training period, maintain and keep the regulation of the Japanese
Supervising/Implementing Organizations and must not engage in any part-time jobs
(sideline) other than the technical internship program;
8.5 Faithfully comply and abide with all policies, rules and regulations of the
Supervising/Implementing Organizations and also to respect all customs and traditions,
practices and religion of the host country;
8.6 Supervising organization or implementing organization shall bear the travel expenses when
it becomes necessary for the technical intern trainee to return home prematurely before
the termination of the contract, If the technical intern trainee wishes to return home
temporarily while staying in Japan, he/she shall be allowed to return home temporarily for
a period of less than 10 days in principle when implementing organization and supervising
organization deemed it proper after giving notice to sending organization with the
assumption that a re-entry permit is processed (or upon issuance of a re-entry permit by
the Bureau of Immigration in Japan). Technical intern trainee, sending organization,
supervising organization and/or implementing organization shall discuss and decide on
who is to bear the expense taking into account the reason for the temporary return.
8.7 If technical intern trainee is not able to continue the employment contract due to the
causes (e.g. bankruptcy of company, poor performance, administrative disposition against
misconduct, etc.) attributed to Japanese side (supervising organization or implementing
organization), implementing organization and supervising organization shall try to
secure a new implementing organization and sending organization shall not be responsible
for the payment of lecture allowance and salary.
9. The following reasons are grounds for sending the Technical Intern back to the
Philippines:
9.1 The Technical Intern breaks/violates Japanese law;
9.2 The Technical Intern was afflicted with sickness and complication prior to start of training
period which only manifested during the training;
9.3 If the sickness would require rest for more than a month or other sickness not previously
declared which manifested only during training;
9.4 The Technical Intern disobeyed company regulations;
9.5 Technical Intern who does not perform his duties satisfactorily;
9.6 Technical Intern who does not follow safety regulations which results to accidents;
9.7 Technical Intern who does not follow and obey house rules and have done damage to
housemate;

9.8 Technical Intern who has been found to be pregnant prior to her departure for training to
Japan;
9.9 Technical Intern who has falsified information and documents required under the Technical
Internship Program and withheld information/condition not covered by medical evaluation
prior to his/her departure to Japan

10. If supervising organization decided it is not possible or fit for the technical intern trainee to
continue the training program due to the reasons in the previous section (Section 9), supervising
organization shall cancel the program after listening to his/her explanation and having a talk
among the parties concerned and he/she shall be sent home to the Philippines immediately.

11. Sending organization, implementing organization and supervising organization shall settle the
matter properly in accordance with the applicable laws and regulations if it becomes hard for the
parties concerned to continue the technical intern training for the following causes.
11.1 Cessation of business, bankruptcy, or any other industrial disturbance
11.2 Force majeure
11.3 Fire, unavoidable accident
11.4 Riot or rebellion
11.5 War, trade embargo
11.6 Other unavoidable circumstances beyond the control of the Implementing Organization

12. The Technical Intern has agreed with employment/placement under the business tie-up of
Prudential and the Supervising Organization.
