ADDENDUM TO THE MEMORANDUM OF FAMILY SETTLEMENT

This Addendum is to the existing Memorandum of Family Settlement, dated October 12, 2015,
executed between Dr. (Mrs.) Ina Bhan, daughter of late Dr. Prem Chandra Dhanda & wife of
Dr. Atul Kumar Bhan, resident of 119, Sunder Nagar, New Delhi-110003 and Mrs. Nilima
Sheikh, daughter of late Dr. Prem Chandra Dhanda & wife of Prof. Gulam Mohammed Sheikh,
resident of 121, Sunder Nagar, New Delhi-110003 on this 12th day of April, 2016.

WHEREAS, the said Parties now wish to extend the time defined in Paragraph O (i) in the
Memorandum of Family Settlement and therefore the said paragraph is being replaced vide this
Addendum and shall be read as stated below:

“In case the Party of the Second Part is not able to obtain requisite sanctions for construction on
Plot B within one and half years of the execution of the present deed, the Parties may mutually
alter/modify the terms of their family settlement.”

WHEREAS, the said Parties now wish to include the following paragraphs in the Memorandum
of Family Settlement and therefore the following paragraphs shall be construed as part of the
Memorandum of Family Settlement and shall have effect from the date of its execution:

“AND WHEREAS the second party in order to make the portion of the aforesaid existing
superstructure / building on her plot no. 121 habitable, intends to carryout additional
construction and/ or alterations in building on her plot bearing no. 121, Sunder Nagar, New
Delhi, in terms of the family settlement and for the purpose has applied for the requisite
approval from The South Delhi Municipal Corporation (SDMC) / the concerned authorities for
the aforesaid construction and alterations in terms of the applicable Bye Laws.”

“AND WHEREAS the First party and Second party being joint owners of the superstructure are
required to file a joint application for the aforesaid additions and alterations.”

“AND WHEREAS the First Party agrees to the aforesaid joint application subject to the following
terms and conditions: -
1. That the Second party shall obtain the necessary approvals for carrying out the aforesaid
construction / alterations in terms of the Family Settlement;

2. That the Second party shall submit/furnish to the concerned authorities a site plan / any other
requisite documentation/letter/application distinctly showing therein the respective portions of
the building along the plot lines / boundaries of the respective plots of the parties.

3. That the Second party shall bear and pay all the current and future taxes, fees, penalties, costs
and charges for the aforesaid purpose to Municipal/ concerned Authorities/Others on account of
the aforesaid construction/alterations or for mutation/ sub-division of the said aforesaid
construction/alterations in the name of the Second Party;

4. That if, in addition to the costs and the manner of bearing/sharing such costs agreed to in terms
of the Family Settlement, the First Party suffers or pays / incurrs any additional cost, on account
of a penalty / claim by any governmental authority / a neighbour, solely due to and/or on account
of the aforesaid additional construction / alterations on Plot no. 121, the Second party
undertakes to indemnify the First Party for the same.

All terms and conditions of the Memorandum of Family Settlement, other than stated here-in
shall remain the same.
