MEMORANDUM OF DEPOSIT OF TITLE DEEDS

THIS IS MEMORANDUM Executed at Chennai on this day ______th ______ 2016

by Mr. ___________ S/o ___________________ aged About ____ years

(hereinafter collectively referred to as “Mortgagors/owners”) (which expression

shall, unless it be repugnant to the context or meaning thereof shall mean and

include his/her heirs, executors and administrators) on the First Part;

IN FAVOUR OF

YES BANK LTD., a Company within the meaning of the Companies Act, 1956, and

a banking company within the meaning of section 5 © of the Banking Regulation

Act, 1949 having its Registered office at Nehru Centre, 9th floor, Discovery of India,

Dr.Annie Besant Road, Worli, Mumbai 400 018, hereinafter called "the Bank"

(which expression shall unless it be repugnant to the context or meaning thereof

mean and include its successors and assigns) of the Other Part, AS UNDER:

1. Mr.__________________ handed over to Yes Bank Ltd, the title deeds,

evidences, writings and documents more particularly enumerated in the First

Schedule hereunder written (hereinafter collectively called the "Title Deeds")

relating to the immovable property owned by himself as more particularly

described in the Second Schedule hereunder written (hereinafter called the

"Immovable Property") with an intention to create an equitable mortgage in

favor of YES Bank Limited on the said Immoveable Properties to secure

repayment of aggregate Sum of INR ________________/- (Rupees

___________________________________________ only) together with interest,

costs, charges, expenses, premium on pre-payment granted by the Bank to

to as “Borrower”).

2. While handing over the said title Mr._____________ , acting for self-stated that

the Title Deeds are deposited with the Bank with an intention to create an

equitable mortgage on the Immoveable Property to secure the due repayment

and discharge by the Borrower to the Bank of the following amounts :-

Borrower facilities – Loan Against Property for an Loan Amount INR

__________________/- (Rupees ____________________________) together with

interest thereon at the agreed rate, compound interest and/or additional

interest in case of default, liquidated damages, commission, commitment

charges, premium on prepayment or on redemption, costs, charges, expenses

and all other monies payable by the Borrowers to the Bank under the Loan

Agreement/other Agreements respectively.

3. Mr._______________ acting for self-stated that the Immoveable Property is free

from all the encumbrances and owner is in a position to create mortgage and

charge in favors of the Bank in respect of the Immoveable Property more

particularly described in the Second Schedule hereunder written.

4. Mr. ______________ acting for self-further stated that the Title Deeds have

been so deposited were the only title deeds relating to the Immoveable

Property in his possession, power and control and the title of the Mortgagor

/the Owner over the Immoveable Property is clear and marketable and free

from all the encumbrances and further stated that there are no other

document(s) of title to the said Immoveable Property.

5. The Bank accepted such deposit of the said title deeds Mr._____________ as

listed in the First Schedule.
