PROPOSED RESOLUTION NO. ______

COMMENDING THE PERSONNEL OF THE CITY ENGINEERING’S OFFICE AND THE MASBATE
CITY TRAFFIC MANAGEMENT AND FRANCHISING OFFICE (MCTMFO) FOR THE SUCCESSFUL
DISMANTLING OF ILLEGAL STRUCTURES ALONG MASBATE NATIONAL COMPREHENSIVE
HIGH SCHOOL (MNCHS) ANNEX ROAD, BRGY. KALIPAY, CITY OF MASBATE

WHEREAS, Section 16 of RA 7160, otherwise known as the Local Government Code of 1991 (LGC),
provides that Local Government Units shall exercise the powers expressly granted, those
necessarily implied therefrom, as well as power necessary or appropriate to maintain peace
and order, and preserve the comfort and convenience of heir inhabitants;
WHEREAS, reports indicate that a number of informal settlers and illegal vendors have come to the City in
search of shelter and livelihood opportunities;
WHEREAS, in view of the foregoing, the setting up and construction of illegal structure in both public and
private lands may increase to the prejudice of the public and legitimate landowners deprived of
their right to peacefully utilize, possess and enjoy the same, similar structure without the
necessary permits may pose a danger to the life and limb of the member of the community as
they have not passed through the necessary sanctions and controls;
WHEREAS, Section 444, Article I, Chapter 3 of the LGC grants authority to the mayor to cause the
demolition of illegal structures stating that:
“(2) Enforce all laws and ordinances relative to the governance of the municipality and the exercise of its
corporate powers provide for under Section 22 of this Code implement all approved policies, programs,
projects, services and activities of the city and, in addition to the foregoing, shall:
(vi) Require owners of illegally constructed houses, buildings or other structures to obtain the necessary
permit, subject to fines and penalties as may be imposed by law or ordinance, or to make necessary
changes in the construction of the same when said construction violates any law or odrninance, or to
order the demolition or removal of said house, building or structure within the period prescribed by law
or ordinance;
WHEREAS , the City aims to clear both public and private lands, streets and sidewalks of all obstructions
and illegal structures, so as to ensure that property rights are protected and that traffic of
pedestrians and vehicles remain safe and unimpeded;
WHEREAS, reports shows that there are existing illegal structures along MNCHS Annex Road, Brgy.
Kalipay, City of Masbate; and
WHEREAS, on __________ more than ___ structures made of light materials have been dismantled by the
demolition team of the City composed of the personnel from the City Engineering’s Office and
MCTMFO which resulted to the successful clearing operation, hence this resolution.

NOW THEREFORE, on motion of the Hon. Rodolfo C. Abella, duly seconded and concurred by all the
members present, BE IT:

RESOLVED , as it is hereby resolved, to commend the personnel of the City Engineering’s Office and the
Masbate City Traffic Management and Franchising Office (MCTMTFO) for the successful
dismantling of illegal structures along Masbate National Comprehensive High School (MNCHS)
Annex Road, Brgy. Kalipay, City of Masbate.

RESOLVED FINALLY, to furnish copy of this resolution to Office of the City Mayor and all other concerned, for
information and appropriate action.
