TENDER NOTICE
Sealed percentage rate tenders are invited for the work of “ARC of operation and
maintenance of CHP, Oil Transfer Pumps at Sikka TPS.” from experienced & registered
contractors with GSECL / GETCO / DISCOM / CENTRAL / State Government / Railway /
Semi Government and who has executed works of similar nature and magnitude as per pre-
qualification criteria of work successfully. Tenderer should down load the tender documents
from the web site www.gseb.com, www.gsecl.com.& n-procure.com (In case of e-
Tender) Tender documents will not be issued in physical form from this office and submit the
same (in soft & hard) as per instruction therein by RPAD. Courier service & Hand delivery will
not be allowed.

Technical Bid
No tender shall be accepted / opened in any case received after due date & time of receipt of
tender, irrespective of delay due to postal services/network services or any other reasons
and the GSECL shall not assume any responsibility for late receipt of tender.
Tenderer should quote the reference of payment of EMD & Tender Fee i.e. DD No.
& Date for EMD - DD No. & Date for Tender Fee on cover page of Technical Bid
otherwise Bid will not be considered for opening. Tenderer should also certify as
“unconditional tender” on tender cover it self.
B. EMD at 1 % of the estimated cost is to be paid by D.D. in favour of Gujarat State
Electricity Corporation Ltd. payable at State Bank of India, Sikka. Tenders without
EMD are liable for rejection. The SSI / NSIC will be accepted for exemption of
EMD for supply of subjected material only, otherwise tender / offer will be ignored.
The Xerox copy submitted for SSI / NSIC shall be notarized only. SSI / NSIC
submitted other than indented material will not be accepted for waival of EMD / SD
and without payment of EMD, tender will be rejected out rightly without intimation
to the party. No correspondence will be entertained further in the matter.
The exemption in payment of EMD shall be given to the small, cottage & Tiny
Industrial Units registered under small scale industries of Gujarat State and holding
subsequent registration with CSPO/NSIC/DGS&D registration certificates for the
item under tender.
C. Security Deposit : Lowest party shall have to pay Security Deposit as, 5 % in case
of Works & 10 % in case of Supply of order value before placement of order.
(a) Small, Cottage and tiny industrial units of Gujarat State having the registrations
numbers for production of goods and having the registration numbers from
Govt. of Gujarat to submit Security Deposit and performance guarantee as
under.
(01) Wherever in the purchase policy, the Security Deposit and Performance
Bank Guarantee rate of 5 % is stipulated, the same be considered at 3
% for Small, Cottage & tiny industrial units of Gujarat State.
(02) Wherever the rate of Security Deposit & performance Bank Guarantee of
10 % is stipulated in the purchase policy, the same be considered as 6
% for Small, Cottage & tiny industrial units of Gujarat State.
(03) Security Deposit and Performance Bank Guarantee shall not be insisted
concurrently and therefore Security Deposit may be converted into
Performance Bank Guarantee or once PBG is submitted, SD will be
refunded
L1 contractor has to pay Security deposit as per prescribed time limit mentioned in LOI. if
successful bidder not paying SD in time, necessary action will be taken against firm as
per GSECL norms.
Tender Cover Packing ( EMD + Tender Fee+ Other documents)
1. Technical Bid : The technical bid shall comprise of all the technical details of the
stores / materials offered in accordance with the Corporation guaranteed technical
particulars and conditions, etc.
The Technical Bid shall be opened on Due Date as mentioned in tender Notice (If
Possible), in the presence of those tenderers who wish to be present. If the
Authorized Representative is likely to be present then he must submit the
authorization letter of the representing company at the time of opening of Bids
and this is compulsory. Only One authorized Representative shall be allowed.
2. Price Bid
For E-Tender
Bidders are requested to submit Price Bid (Schedule-B) on-line only and not to submit
the price bid in physical form. This is mandatory. If price bid is submitted in physical
form, same will not be opened and only on-line submitted price bid will be considered
for evaluation. Further if the quantity quoted differs in the any of the technical bid

forms and in price bid forms, it is discretion of Committee – GSECL to consider the
quoted quantity.
For Web-Tender
The Price Bid must be submitted strictly as per Schedule-B and shall be submitted in
the separate envelope (dully sealed) super scribed Price Bid with subject and shall be
submitted simultaneously with the Technical Bid
The time and date for opening of the Price Bid shall be determined by the Corporation
and shall be communicated to the tendering firms after technical bids are analyzed
and the intimation will be sent only to the technically qualified tenderers.
Any technical questions information and clarifications that may be required pertaining
to this Tender should be referred to The Chief Engineer, GSECL, TPS, Sikka, who
also reserves the right to reject any OR all tenders without assigning any reasons
thereof.
The “Technical & Price Bids” shall contain adequate cross reference wherever
necessary to ensure clear and proper co-relation of the two bids without ambiguities
whatsoever.
Any technical questions information and clarifications that may be required pertaining
to this Tender should be referred to The Chief Engineer, GSECL, TPS, Sikka, who
also reserves the right to reject any OR all tenders without assigning any reasons
thereof.

and supported with copy of work orders with an evidence of
executed minimum value of about 15 to 20 Lacs.
Details of minimum tools, tackles and equipments in possession
relevant to the job. Site – In – Charge should be of minimum

Diploma Qualification and having relevant experience for
operation and maintenance of Coal Handling plant.
3 Details of P.F. Code no. from appropriate authority
Latest Bank Solvency Certificate of minimum 20% of estimated

cost from any Nationalized Bank
Certified copies of last three years audited annual account i.e.
profit & loss account and Balance sheet if the estimated cost of
the tender exceeds Rs.100 lacs (for ARC tender). If the party is a
5 proprietary party and not required to get annual account audited
under the law, a copy of Income tax return or certificate from
practicing Chartered Accountant certifying the “Profit & Loss
account” should be submitted
Wherever applicable, as per stay order of the court of law, as may
be in forced from time to time, the bidder will have to give consent
and confirm that he will engage same labours and supervisory

staff working with the presently working contractor. Presently 18
nos of IT protected Labours have to be engaged for associated
proposed work.
Copy of contract labour license from the appropriate authorities,

Conditional tender is liable to be rejected. Withdrawal or insertion

Non submission of above criteria the technical bid is liable to be rejected. After acceptance of the
Technical Bid the Price Bid will be considered for opening.

SCOPE OF WORK
Name of the work: ARC of operation and maintenance of CHP, Oil Transfer Pumps at Sikka
TPS.
The scope of work consists and includes of any type of Operation and Maintenance works of
coal handling plant as per requirements of Gujarat State Electricity Corporation Ltd., Thermal Power
Station, Sikka.
In generalized view operation part of work consists and includes of running of coal handling
plant equipment for shifting of the coal unloaded from wagons and fill the coal into the bunkers or to
Stack into coal stock yard. As per the requirement of GSECL TPS Sikka. This is a round the clock
shift duty works.
The Maintenance parts of this contract consists and includes of running repairing, routine
check, preventive, emergency break down work of annexure A,B & C equipments to be carried out as
per requirement of GSECL, Sikka. These works are to be carried out in all shift round the clock & also
in wagon period like as below.
The detailed scope of works and relative terms and conditions of operation of CHP are listed
here after in special terms and condition. Scope of work Part-I & Part-II of this tender document.
In generalized view this contract covers the safe, smooth economical and efficient operation
and all type of related maintenance works of CHP at Sikka TPS. As scope of works for contractor are
consists, and includes any types of works related to operation and maintenance works of coal
handling plant equipment it will automatically, fall in the scope of works as per instruction of EIC, even
if it is not described.
Incase of any dispute of discrepancy in above O&M scope of work, the decision of the Chief
Engineer, GSECL, TPS, Sikka will be final and binding to the tenderer, in all means.
The copy of O&M manual from manufacturers of CHP equipment are available at office of the
Executive Engineer (Fuel) will be handed over to successful tenderer as and when needed for work
only. The contractor can not keep this manual permanently with him / them.
This part of work contract consists and includes of running of coal handling plant
equipments by his operators and carryout the safe, smooth, economical and efficient operations,
starting, stopping and running of coal handling plant equipments for unloading of receiving coal rakes
in time and bunkering of coal in to Coal bunkers. For unloading of coal rakes, all the essential
equipments like WT, AF, SRC, Conveyors, CR, RS, BFD, TC etc. and for bunkering BFD, conveyors,
TT IMS etc. are require to operate either in single stream running or both the stream running, change
over of RPG, FG, etc. as per requirements of plant are also fall under scope of works of contractor.
All the above works are to be carried out as per requirement of GSECL Sikka TPS, site
conditions. The all above operations of plant are to be carried out round the clock by operating single
stream OR both streams at a time as per the site conditions and instructions from the GSECL
authorized representative. This part of contract also includes and consists of keeping all equipments
neat and clean. Record the running behavior of the plant equipment, starting and stopping, Time of
plant, vibration, running sound of equipments, healthiness of equipment etc. what so ever is

applicable to each equipments / system at present and amended in future.
In short, the contractor is bound to operate, all the equipment presently available and installed
at CHP and also the equipments which may be installed in future shall also be operated by contractor
with his /their staff.
In addition to general descriptions, T&C mentioned else where, in this tender documents below
listed special terms and conditions pertain to operations part of CHP.
01. The contracotr shall have to keep his / their operating staff round the clock in shift duty.
02. The contractor shall have to keep their operators at following locations during unloading of
coal wagons or reclaiming the coal from reclaiming hopper in shift wise.

The contractor will submit shift wise [location wise] presence report of his staff to EIC. For the non
availability of the operator at specified location or supervisor Rs.1,000/- will be recovered from
monthly R.A. Bill as his absence lead to plant equipment damage. Maintenance Staff should not
be used for Operation.
03. The contractor plant operator shall have to entirely check all the plant equipments and its
accessories in every shift before starting of plant and record / report his observation to plant
supervisor and then to EIC of plant every day in writing.
04. The contractor have to check all the parameters of running equipments like bearing temp.
vibration, abnormal noise, Run out of belts, wear out of Rollers, breakage of Roller stands,
chute punctures, worn out of skirt-rubbers, scrappers, damage on conveyor belts, oil levels in
gear boxes, fluid couplings, brakes etc. and keep them in safe working conditions.
Contractor‟s operator have to check crusher hammer rings for if any damage after unloading
of coal rake and give the report to EIC.
05. During unloading reclaiming and bunkering of coal, operator should be vigilant and carryout
the operations so that uniform and maximum belt capacity handling of coal can be achieved.
06. Plant operator should not run the equipments idle except for checking and testing.
07. The contractor shall have to prepare and submit a operation report of each and every starting
and stopping of plant equipments (The specimen format for such report is enclosed with
tender documents (Format-A)) The same format should be submitted by site in charge at
8.30 am on next working day at coal control room of CHP and got verified with GSECL
officer. The printing charges of format will be borne by contractor.
08. The contractor plant operator should report the any defect observed developed occurred OR
any complaint / fault / wear and tear etc. to the site in charge immediately and site in charge
shall have to arrange for rectifying / attending. A defect book in this regards to be maintained
regularly as per instruction of EIC.
09. Incase of damage caused either to plant equipments it self OR its accessories OR to the
GSECL properties and belongings due to mal operation carelessness or negligence etc. of
contractors operator, same should be rectified / repaired / replaced by contractor at his own
cost and report of such occurrence should be made immediately to GSECL authority.
Otherwise amount equivalent to loss / damages occurred to the GSECL + 15% service
charges will be deducted from contractors bill or recovered earliest from contractors any
balance amount with GSECL.
10. At any instant / incident the contractor operators is / are not available for works, the GSECL
has every right to carryout these works, either departmentally or by deploying other agency at
all risks and cost.
11. The contractor shall have to maintain up to date records of operations of plant equipments.
Report should be submitted daily regarding running hrs, plant equipments behaviors,
Availability of equipments etc. in a format approved by GSECL otherwise RA bill will not be
accepted. The penalty of Rs.150/- per incident of non-submission of operation report as
per format “A” in time will be deducted from contractors RA Bill.
12. Before commencement of operations works contractor shall have to make protocol in which
particulars of plant equipments are handed over to him.
13. All the stationery materials required for keeping operational records i.e. log book, defect book,
format etc. should be arranged by contractor at his own cost.
15. The payment will be made on monthly basis after completion of full month and bill raised by
contractor as per accepted tender rates of work order Schedule “B” Item at Serial No.1 after
deducting any type of recoveries penalties or dues.
16. Due to operation problem by operation mal function/negligence of operator, if coal rake
is not unloaded in scheduled time, rake demurrage payable to railway authority has
been recovered from the contractor’s bill.
For keeping CHP equipments ready for service at any time. This part of contract covers
running, repairs, emergency breakdown maintenance works, preventive maintenance works, and
emergency overhauling works of all the equipments related to coal handling plant at Sikka TPS.

Mainly following plant equipments / systems will be covered under this contract:
1. Total preventive & emergency break down maintenance of all essential, supporting and
seasonal equipment listed in annexure A & B.
2. Regular checking & emergency replacement of broken, loosen coupling bolts, rubber insert,
pin bushes, Skirt rubber etc in each shifts.
3. Regular preventive & emergency break down maintenance & replacement of all type of slow
speed & high speed coupling of CHP are covered in contractor‟s scope of work
4. Regular preventive & break down maintenance /replacement of all bearings & pedestal
blocks of CHP auxiliaries like all conveyor pulleys, SRC, Ring Granulator, roller screen
,dribble conveyors are covered in contractor‟s scope of work. Every three month
contractor has to submitted all essential bearing clearance report to EIC
GSECL TPS Sikka Page 13 of 38
5. Regular hard facing of roller screen rollers, flanged rollers of apron feeder & SRC rotor teeth
hard facing.
6. Repairing and replacement of any type of fluid coupling of coal plant equipment.
7. Attending oil leakages from gear box and fluid coupling and other equipment and
8. Attend all Small Chute Punctures and other leakages form all equipment .
9. Any type of maintenance work (Overhauling/rectification/modification/replacement) related to
coal handling plant as per instruction of EIC
In short, any type of maintenance works, are requires to be carried out in any of coal
handling plant equipments, briefly narrated above, and related works will automatically fall in the
scope of work or contractor and all those essential works are to be carried out by deploying
sufficient maintenance staff.
The maintenance works should be carried out as per the instruction and directives of GSECL
EIC Who will be called and engaged for any specialized job, by the GSECL.
All Maintenance works should be carried out in such a manner that all the equipments
remain in adequate available conditions / to have an efficient coal handling and thus no interruption
is cause in power generation for want of coal handling system.
APPENDIX _A
GENERAL GUIDELINES TO CONTRACTOR FOR O&M WORKS.
6. BELT FEEDER 1A, 1B, 1C, 2A, 2B, 3A, 3B, 4A AND 4B :-
Location :- Below MUH belt feeder 2A,1B and 12C below Reclaim Hopper, Belt feeder 2A,2B
below crusher, Belt feeder 3A, 3B below conveyer belt 6A, 6B, 4A, 4B
Scope of work :-
1. Checks gear box oil level and make-up oil level regularly.
2. Weekly arrange the greasing of bearings, cleaning of pedestal.
3. Adjust/replacement of skirt rubbers and scrappers rubbers to prevent coal spillage.
4. Adjust bolt for central running.
5. As per requirement of coal feeding operate Rack and pinion Gate.
6. Flap gate operation as per requirement of coal flow stream selections.
7. Replacement of Bearing Pedestal, Flexible Couplings as per necessity.
8. ROLLER SCREEN.
Location :- Below conveyer belt 5A / 5B.
Scope of work :-
1. Greasing weekly.
2. Daily checking of gear boxes oil level.
3. Male female coupling rubber element.
4. Bolt nuts tighting regularly.
5. Fluid couplings oil and its fusible plugs.
6. Coal flow if less then designed capacity, replace or filling the materials by welding or roll
bodies hard facing].
7. Doors, guards etc. To be close and check regularly.
8. Check all equipments are available to operate i.e. gear box, oil, fluid coupling, male female
coupling etc. In all respect.
9. Give the clearance to coal plant control room after starting check its vibration. If any
problem stop and rectify the same. If all is OK give the clearnce for feeding and timely
inspect the bearing temperture, Vibration and coal flow etc.
10. All are as per elecon operation and maintenance volume.
11. Hard facing and material refilling with welding on roll bodies of roller screen is to be carried
out by contractor without any extra cost.
12. Replacement of Damaged Bearing Housings, Gears, Bevel Gears, Oil seals,etc.
9. TELESCOPIC CHUTE.
Location :- Below conveyor 8A, 8B on stock pile.
Scope of work :-
1. Use weekly cordium compound on its rope, also check rope if it is damage replaced arrange
for replacement immediately.
2. Greasing weeky all bearings and bearing servicing cleaning of coal etc.
3. Clean the telescopic chute ducts pedestal, gear box etc. Which may be from coal etc. Daily.
4. Gear box oil level check and if its quality is poor replace it.
5. If any chute jam made free for smooth operation.
6. It comes up and down on Auto if it is not working on auto make switch on manual and down
opertion made such type by which it tough the coal heap and coal dust spread out to
atmosphere.
Scope of work :-
1. Greasing of bearing ropes, gear box , brakes to be check regularly.
2. If bearings ropes are found damage replace.
3. Cleaning and replacement of oil in gear box etc.
4. Before starting of cranes check gear box oil etc.
5. Opertions to be with carefully if any item will be damage during wrong operation all
responsibility will be of contractor.
6. Replacement of Brake Liners.
7. Complete overhauling work if necessary.
15. MAINTENNACE OF LDO, LSHS, AND SUMP PUMP IN LDO PUMP HOUSE FOR
UNLOADING OF ROAD TANKERS.
Cleaning of all filters as and when required but at least in a week time.
Overhauling of Complete FO and LDO pumps.
Replacement of spare pump with required rectification and modification.

09. Incase of damage caused either to plant equipments it self OR its accessories OR to the
GSECL properties and belongings due to mal operation carelessness or negligence etc. of
contractors operator, same should be rectified / repaired / replaced by contractor at his own
cost and report of such occurrence should be made immediately to GSECL authority.
Otherwise amount equivalent to loss / damages occurred to the GSECL + 15% service
charges will be deducted from contractors bill or recovered earliest from contractors any
balance amount with GSECL.
10. At any instant / incident the contractor operators is / are not available for works, the GSECL
has every right to carryout these works, either departmentally or by deploying other agency at
all risks and cost.
11. The contractor shall have to maintain up to date records of operations of plant equipments.
Report should be submitted daily regarding running hrs, plant equipments behaviors,
Availability of equipments etc. in a format approved by GSECL otherwise RA bill will not be
accepted. The penalty of Rs.150/- per incident of non-submission of operation report as
per format “A” in time will be deducted from contractors RA Bill.
12. Before commencement of operations works contractor shall have to make protocol in which
particulars of plant equipments are handed over to him.
13. All the stationery materials required for keeping operational records i.e. log book, defect book,
format etc. should be arranged by contractor at his own cost.
15. The payment will be made on monthly basis after completion of full month and bill raised by
contractor as per accepted tender rates of work order Schedule “B” Item at Serial No.1 after
deducting any type of recoveries penalties or dues.
16. Due to operation problem by operation mal funciton/negligence of operator, if coal rake
is not unloaded in scheduled time, rake demurrage payable to railway authority has
been recovered from the contractor’s bill. Decision of CE (G) STPS will be final in the
matter.
17. Cleaning of all equipment’s on daily basis and to keep equipment coal dust and
oil/grease free otherwise penalty of Rs 100/equipment will be deducted from the R A
bill.

SPECIAL TERMS AND CONDITIONS AND DESCRIPTION (Related to maintenance work of coal
handling plant and equipment):
This part of works contracts consists and includes of routine preventive & emergency break
down maintenance works are to be carried out or requires to be carried out. For keeping CHP
equipments ready for service at any time. In details this part of contract covers running, repairs,
emergency breakdown maintenance works, preventive maintenance works, puncture welding work of
chutes, and complete overhauling works of gear box in emergency and other o & m works shown in
APPENDIX A of all the equipments related to coal handling plant at Sikka TPS. Mainly following
plant equipments / systems will be covered under this contract:
3. Regular preventive & emergency break down maintenanace & replacement of all type of
slow speed & high speed copling , fluid coupling of CHP are coverered in contractor‟s scop of
work
4. Regular preventive & break down maintenance /replacement of all bearings & pedestal
blocks of CHP auxiliaries like all conveyor pulleys, SRC,crusher,roller screen ,dribble
conveyors are covered in contractor‟s scope of work.
5. Regular hard facing of roller screen rollers, flanged rollers of appron feeder & SRC rotor
teeth hard facing.
6. Any type of maintenance work related to coal handling plant as per instruction of EIC
8. The maintenance works should be carried out as per the instruction and directives of GSECL
EIC. Who will be called and engaged for any specialized job, by the GSECL.
9. All Maintenance works should be carried out in such a fashion / manner that all the

equipments remain in adequate available conditions / to have an efficient coal handling and
thus no interruption is cause in power generation for want of coal handling system.
10. The scope also consists and includes of all the maintenance works as per under listed
special terms and conditions related to mechanical maintenance works (Maintenance Part)
and Brief guide lines printed in Appendix - A.
11. The contractor shall have to employee qualified (Minimum Diploma) and experienced
persons as supervisor and Site Incharge who have adequate experience of operation
and maintenance of coal handling plant.
12. The contractor shall have to engage sufficient man power over & above those deployed for
operation work to carryout the maintenance works in all shift.
13. For Maintenance works 1 Technician, 3 Helpers, 1 Welder to be available in each Shift.
Non-availability of any one of them leads to non–availability of machines under
maintenance or Machines under sudden breakdown during unloading of rakes or
reclaiming Coal to bunker. Penalty Charges of Rs 1000/- per person will be deducted
from monthly R.A. Bill for non-availability from maintenance staff.
14. Contractor has to engage additional manpower for maintenance in emergency and as per site
requirement for attending the work in minimum possible time.
15. The works involves and consists of transportation and handling of maintenance materials and
equipments, new parts, spares etc. from GSECL main Stores OR Departmental store and
from one place to another place as per necessity for transportation of Heavy / Bulky items /
components possible help shall be extended from GSECL if available. However contractor
shall have to make his own arrangement for material handling.
16. Incase of planned preventive maintenance / overhauling 5 Hrs. advance notice will be given
to contractor. However contractor shall have to follow up normal routine works without giving
any notice.
17. During routine maintenance, If it is requires to carryout the maintenance work on any
equipment / auxiliaries / accessories it should be brought to the notice of EIC & after receiving
work permit / line clear, maintenance work shall be started.
18. The maintenance of CHP and equipments / systems shall be carried out by the contractor,
deploying full strength of manpower and tools tackles etc. No interruption in progressive,
maintenance work shall be granted that means work should be completed at a stretch.
19. In case of equipment failure, contractor will have to restore same within least possible time as
directed by EIC.
20. All job shall be carried out as per instruction under indirect supervision and to the entire
satisfaction of EIC or his representative and CHP equipments under maint. shall be
brought back to operation within shortest period so that power generation may not be affected
for the want of coal.
21. Any deviation, omission and alternative as per the situation and instantaneous site condition
and to suit operational condition, shall be carried out by the contractor within quoted rate. The
quantum and frequency job to carry out or to be attended on each equipments can be
increased or decreased as per operational conditions. Payment will be made strictly as per
accepted tender rate in Schedule “B” Item Sr. No. 2.
22. The contractor shall be allowed to use crane, monorail chain pulley blocks, Hoist
provided in CHP area and specialized tools tackles available with the GSECL. The
special tools tackles requires for works,if available and can be spare free of cost.
However it should be used without any damage. Any damage shall have to be repaired
by contractor at his own cost otherwise; recoveries for the same will be made as per
GSECL TPS Sikka Page 22 of 38
GSECL rules.
23. To carryout the work in well planned manner, Necessary scaffolding / jugaars shall have to be
prepared by the contractor for which material like bullies, Kathie‟s rope, wooden board etc.
shall be arranged by the contractor. After completion of work the contractor shall have to
dismantle scaffolding / jaguars etc. clean oil dirt mud-dust cotton waste etc. spread out at
working area and shall not be left our haphazardly and all scape should be credited to main
store after compilation of work.
24. a) Consumables like kerosene / rustolene, oil, grease, Shellac, M seal, jointing packing
sheets, nut and bolts, special welding electrodes like SS, cutrod, Hardening Rod likewise
other consumable materials diesel for cleaning works etc. Optimum quantity of consumables
shall be issued to the contractor free of cost by the GSECL for attending the maintenance
works as mentioned in Schedule.
b) Party will have manage for Welding Rod For MS (Any sort of
Fabrication/puncture/welding),Oxygen and Acetylene gases, Cotton waste, Hacksaw blades,
grinding wheel, allen keys, chain pulley block of suitable capacity to cary out job, grinders,
cutting tools, welding machine, spanner sets, Hydraulic Jack with Pump etc. Measuring
instruments or any required Tools and tackles for maintenance of CHP.
c) All the spares require for the replacement of worn-out parts such as bearings,
bushes etc. (for which old worn-out spares can be return) shall be provided by the
GSECL free of cost. The material shall be issued to the contractor from GSECL main
store or CHP store. However contractor has to submit the material requirement in
advance so can be processed early.
25. Any repairing, testing, calibration, checking, machining like turning, milling, shaping,
manufacturing of any items, which are not possible at site and in general view considered as
different natured works than maintenance at site, than the GSECL will arrange for such works
and cost of such works shall be born by the GSECL.
26. At any instant / occasion particularly for equipments like wagon Tippler etc. OR some very
precise works in which the expert services of OEM or their authorized agency is needed and
found essential, expenses will be born by the GSECL. The GSECL shall arrange for the same
and contractor shall have to work as per instruction and guidance of expert of OEM or their
authorized agency.
a. However, the contractor has NO RIGHT to demand for expert services for any
work. Means it solely depends upon the descrination of the GSECL to call the expert
services. In self-interest contractor can do so at his / their own cost and risk. The
GSECL will extend possible help for arranging expert services i.e. provide Address,
Phone no, Fax. Nos, Email etc.
27. During maintenance work, any damage to the valuable parts or damage to the equipments
due to mishandling, excessive wastage of material will be viewed seriously and appropriate
amount will be deducted from the bill. The amount will be decided by CE [Gen] STPS and
binding to the contractor.

All equipment including supporting equipment should be kept ready for service. Non
availability of any equipment due for more than 2 [two] days of its notice of failure,
penalty of Rs.1,000/- per day will be imposed.
Non availability of equipment due to maintenance, after providing sufficient spare and
sufficient time for maintenance, and leading railway demurrages then penalty of rake
demurrage payable to railway authority has been recovered from the contractor’s bill.

29. The electric supply for welding machine and lighting for maintenance works of CHP shall be
provided free of cost by the GSECL. However, for any other purpose it should be on
chargeable base and for that the contractor will have to observe all the required formalities for
obtaining power connections.
30. Maintenance of CHP equipments does not mean only replacement of old parts by new one
but contractor has to carryout maintenance / repair when over the possible as per opinion of
EIC.
31. During execution of works by contractor if it is found and observed, delay in attending defects

or unsatisfactory progress of work the same shall be got done either departmentally or by
deploying other agency at all risk and cost of contractor in view to avoid loss to the GSECL.
32. The maintenance works of equipments / systems shall be treated as completed only after the
satisfactory working performance and taken in to service. Any defect noticed
subsequently shall have to rectify immediately.
33. Each equipment system should be kept in readily available for services condition.The
preventive maintenance are to be carried out during idle plant condition when unloading or
bunkering of coal is not going on or in emergency they have to manage for repairing during
unloading or reclaiming also.
34. To keep equipments / systems in safe working and healthy running conditions
preventive checks and schedule maintenance, Non implementation of such check and
maintenance work. The penalty of Rs. 1500/- per incidence shall be deducted.
35. The preventive and scheduled maintenance as per Appendix-A are for smooth safe
economical and efficient services and performance of equipments. Repeating
breakdowns of particular equipments or part of contractor shall be considered as
negligence on part of contractor. It is viewed seriously after due notice to the
contractor, the penalty of Rs1500/- per incidence shall be deducted.
36. All items materials requires for keeping maintenance record i.e. maintenance records book
material issued to and consumed etc. to be arranged by contractor at his own cost.
37. Incase of any dispute discrepancy difference of opinion under standing recoveries deductions
made about this contract the decision of the CE(G), GSECL, Sikka shall be final and binding
to the contractor.
38. The payment shall be made on monthly basis after completion of full month and bill raised by
contractor as per accepted tender rate of work order Schedule “B” items after deducting any
type of recoveries penalties or dues.
39. For the requirement of spares and other materials contractor shall have to put demand
note in advance, 2 months before the actual use of material to facilitate the
procurement action from GSECL side. In special case certain liberty will be given to
contractor as in this work contract need of spares, quantity and size etc. can be will
accessed after dismantling of particular equipment. However in case of emergency if
material not available at store contractor has to purchase directly from the market of
celling Rs 10000/month as per instruction of EIC and bill raised in monthly RA bill.
40. The up to date record of consumables / spares parts received from GSECL and actual usage
of material shall be maintained by the contractor and shall be shown to the competent
authority on demand at any time.
41. The contractor shall have to prepare monthly material statement received from the store and
actual usage and should be attached with monthly RA bill, without which, the bill will not be
processed.
42. The contractor have to credit all the worn out, broken or damaged unserviceable spare parts
to GSECL main store at Sikka TPS site through specific credit note. The amount of new spare
part supplied to the contractor should tally with the unserviceable parts credited to GSECL
main store immediately after compilation of work.
43. For the material to be issued by the GSECL, the contractor shall have to furnish indemnity
bond for authorized person on stamp paper of Rs.100.00 or appropriate value.
44. The time limit for completion of this contract works, if awarded is one year from
commencement of work. The G.S.E.C.L can extend contract for further period of six months
after expiry of time limit, if desired by the G.S.E.C.L, at the same rate, terms & conditions of
awarded order of this tender, and quantity will be enhanced proportionately.

contract & after certification by the concern Superintending Engineer / Chief Engineer (C&O)
SIKKA TPS after deducting any dues of the GSECL
8. Sublet or transfer of contract without prior written approval of G.S.E.C.L., will be treated, as
breach of contract and it will be punishable by forfeiting the Security Deposit as well as
termination of contract.
9. The G.S.E.C.L. reserves the right to forfeit the S.D. in case of any breach of any condition of
contract and in case of dispute, the decision of C.E., G.S.E.C.L SIKKA TPS shall be final and
binding and shall be acceptable to the contractor.
10. WAGES TO BE PAID AND TIME OF PAYMENT ETC. BY THE CONTRACTOR
a) The contractor shall pay minimum of as prevailing wages declared by Govt. from time to time,
or as may be specified hereinafter or rates fixed under the minimum wages act, whichever is
higher. Considering the person certified by LWO based on punching system. The wages of
every contract labour employed by you under this contract shall be paid by contractor before
the expiry of 10th days of the last day of the month in respect of which the wages are payable
( i.e. wages of a month have to be paid by contractor in the first week of the next month.)
The payment of the wages shall be deposited in the any Nationalized/Co-operative Bank
every month and statement for the same shall be presented or produced to the HR
Department every month in token of timely disbursement of the minimum wages. The
contractor shall get the entries certified in the; register of wages by the representative of the
G.S.E.C.L. Any default will result in cancellation of contract forthwith or else contractor shall
be punishable to the extent of Rs. 100-00 fine per each day.
b) The contractor shall give his telephone number / mobile number and residential / office
address to the G.S.E.C.L. so that In case of labour trouble etc, the contractor can be
intimated. The contractor shall arrange to have his office outside the factory premises and the
contractor shall keep himself / his authorized representative, present throughout the working
hours.
c) It should be ensured that all the contract labours are covered under the provident fund
scheme and employee‟s pension scheme and their contribution are remitted regularly to the
concerned RPFC. The Xerox copies of challan in this regards should be submitted regularly

in G.S.E.C.L. office. Deposited PF account sheet in the labour A/c is to be submitted by
contractor.
d) In case the contractor having more than one contract in the same TPS, then the contractor
has to submit contract wise separate list of the workmen to the concerned Officer.
11. The contractor shall take all safety precautions during work as per Indian Electricity Act and
Rules.
12. LABOUR LAWS
a) Person below the age of 18 years and above 60 years should not be employed for the
work.
b) No female worker shall be employed in the night shift between 7.00 P.M. to 6.00 A.M.
c) The contractor shall maintain a valid labour license under the contract labour (Regulation
and Abolition) Act for employing necessary man power to be required by contractor. In
the absence of such license the contract shall be liable to be terminated without
assigning any reasons thereof.
d) The contractor shall at his own expense comply with all labour laws and keep the
G.S.E.C.L. Indemnified in respect thereof. Some of the major liabilities under various
labour and industrial laws, which the contractor shall have to comply, which are as
under:
I) Payment of contribution by way of employee‟s contribution towards provident fund,
family pension scheme, deposit linked insurance scheme, administrative charge etc., at
the rates made applicable from time to time by Govt. of Gujarat /Govt. of India and other
statutory authorities.
II) Payment of deposit in respect of each contract labour at the rate applicable of with the
offices of Commissioner of Labour as per the contract labour (Regulation and Abolition)
Act.
III) License fee as prescribed under the contract labour (Regulation and Abolition) Act and
rules framed there under depending upon the number of workmen employed by
contractor.
IV) Identity cards as prescribed under the factories Act shall be issued to workmen.
VI) Payment of retrenchment compensation, Notice pay and other liabilities as per Industrial
Disputes Act. Any payment to the contractor's employees arising out of any claim or
disputes under the Industrial Dispute Act 1947 or any other labour laws
VI) Payment of compensation in case of accidental injury shall be made as per the WC Act.
VII) If the female workmen are more than 30 numbers engaged then provision of crèches,
shall be complied accordingly.
VIII)Maternity leave as per the provision of the maternity benefit Act.
The above are some of the major liabilities of the contractor in addition to other liabilities
prescribed under the various labour laws in force from time to time from statutory Authorities
like State Government / Government of India, which the contractor shall have to comply with.
13. PROVIDENT FUND AND FAMILY PENSION SCHEME
The contractor shall submit along with his bill (month wise) statement regarding deductions
against employees‟ provident fund and family pension scheme in respect of each
concerned employee. Provident fund and family pension scheme at the rate of 12 % of
wages (or at the rates made applicable by the Government time to time). The contractor‟s
contribution and his workers contribution towards provident fund and family pension scheme
shall deposited by the contractor with Regional Provident Fund Commissioner, Ahmedabad.
In case if the contractor deposits the contribution to the Assistant Provident Fund
Commission, the zerox copy of challans and schedule must be submitted in the office. For
maintaining the CPF Account of contractor‟s employees the contractor will have to pay
administrative charges as applicable of the emoluments of the employer of the contractor's
every month.
14. GROUP INSURANCE SCHEME
The contractor has to take Group Insurance for all workmen engaged by him and copy of the
same shall be produced to Concerned Officer.
16. PAID LEAVE FACILITY
Paid leave facility at the rate of one day for every 20 days worked by the contract, labour shall
be provided the contractor to his workers. It shall be duly verified and approved/certified by
the LWO of the GSECL.
17. The contractor shall employ adequate number of experienced staff at site for daily supervision

and for maintaining of various registers and records required under the law and contracts. No
payment for such supervision shall be admissible.
19. CONTRACTOR TO INDEMNIFY THE GSECL
The contractor shall indemnify and keep indemnified the GSECL, and every member, officer
and employees of the GSECL, also Engineer-in-charge and his staff against all actions,
proceedings, claims, demands, costs and expenses whatsoever arising out of or in
connection with the matter referred in above clauses and elsewhere and against all actions,
claims demands, cost and expenses which may be made against the GSECL by any
workman/ employees of contractor or any sub contract or and or from any liability any wise to
any workman/employees of the contractor or sub-contractor under any laws, rules or
regulation having in force of law including but not limited to claims against the owner under
workmen compensation Act, 1923. The Employee‟s Provident Fund Act.1952, and/or the
contract labour (Abolition and Regulation) Act. 1970.
The GSECL shall not be liable for or in respect of or in consequence of any accident or injury
to any workmen or other person in the employment of the contractor or his sub-contractor,
and the contractor shall indemnify and keep indemnified the GSECL against all such damage
and compensation and against all claims, demands proceedings costs, charges and
expenses whatsoever in respect of or in relation thereto.
20. WORKMEN'S COMPENSATION & EMPLOYER'S LIABILITY INSURANCE
Insurance shall be affected for all the contractor‟s employees engaged in the execution of
these contracts. If any of the work is sublet, the contractor shall required the sub-contractor
to provide workmen's compensation and Employer's liability insurance for the latter's
employees unless such employees are covered under the contractor‟s insurance. It shall
be liability of contractor for employees of his sub-contractor.
21. The GSECL, reserves the right to terminate this annual rate contract at any time during its
tenure without giving notice of termination of any reasons thereof.
22. The GSECL will be entitled to deduct directly from the bill to be paid to the contractor, any
sum or sums payable by the contractor and which sum/sums the GSECL is required to pay as
a principal employer on account contractor‟s default in respect of all liabilities referred to in
above clauses.
23. Nothing in the contract document stated shall anywise continue any workman / employees of
contractor or any sub-contractor as or to be workmen / employees of the owner or place
obligation liability in respect of any such workman / employee upon the GSECL.
24. Office correspondence will be carried out in English/Gujarati. The English version will be the
correct one and the same only will held good for legal matters.
25. The period of the contract shall be of (ONE) 01 years from the date of commencement
of the work. It can be extended for six months at same terms and condition.
26. The General rules and regulation of the GSECL for tender and contract for works will apply to
the extend the same any not modified herein. The booklet for tender and contract for work is
attached here with. The contractor is deemed to have gone through it and considered to be
fully aware of the conditions mentioned therein.
27. Any other rules and regulation, conditions, etc., that are in force at present and that may be
framed by the GSECL From time to time in connection with contracts will be binding and
acceptable to contractor.
28. In case the contractor‟s work is found unsatisfactory or contractor abandons, stops, or creates
during the contract period, the GSECL will be entitled to terminate the contract. In case of
default the work will be got done through other agencies at the risk and cost of contractor and
GSECL shall be entitled to recover such expenses from defaulting contractor by such
methods as deemed fit. The contractor shall not however, be entitled to terminate the contract
or stop works undertaken by him before expiry of the contract period due to any reason
whatsoever.
29. Under the contract the contractor shall either himself be present on site or should nominate
persons in writing, who must be available at site and who should be authorized to take
decision about the works and mutual consultation from time to time. In the absence of any
responsible man of contractor at the time of any emergency adhoc decision of Engineer-in-
charge will be binding to the contractor.
30. For convenience of the contractor some open space will be provided in the working site for
making office of contractor and to keep his tools and equipments a token rent per month as
per GSECL rules & shall be charged from the contractor, which he will pay before the
commencement of the month.

31. The contractor is bound to execute the work for any item as per the instruction / mutual
consultation with EIC from time to time. On refusal to do same the work will be carried out at
contractor risk and cost by using his (contractor's) tools, tackles for which no compensation
whatsoever shall be payable to the contractor.
32. The successful tenderer / contractor will have to enter into agreement with the GSECL and
the cost of the stamp paper will be borne by the contractor. The contractor will also have to
execute Indemnify bond on required value of stamp paper as per GSECL, rules. The cost of
stamp for indemnity bond will be borne by the contactor.
33. As per the industrial Tribunal order the concerned contract workers of 29/99 presently
engaged for the same activity are to be continued by bidder, till further order of Honorable
Industrial [Rajkot] / Hon. H.C., A‟bad Hence bidder/contractor shall employed 18 Nos of
contract workers engaged by previous contractors. Who are concerned workmen in I.T.
ref.-29/99
34. The contractor will be responsible and liable to pay difference in wages if any and or observe
the revised service conditions that may be awarded by the Hon. Industries Tribunal effective
from the date directed in the award.
35. Rate quoted of tender are firm price basis, hence the labour escalation payment will not be
paid by GSECL to the contractors.
36. In case of delay in execution of work the penalty as CL. No. 3 of “Tender and contract for work”
will be applicable.
37. Any casualty will also have to be borne by the contractor for the period the contract continues.
38. The contractor must be solvent and should have sufficient trained labour force competent to
carryout the Job.
39. The contractor must maintain regular labour record and should be paying all acquired,
benefits to the labours which in force. Contractor should obtain certificate for this from Govt. /
Public organization for the works being executed by him.
40. The contractor must possess separate P.F. code for the above subject work.
41. Attendance rolls shall be maintained up to date. All the written registers, Performa etc…shall
be filled up and maintained up to date and kept ready for inspection at any time or submitted
in-time to the concerned authorities as per contract labour etc. Factory Act. Etc... By
contractor
42. (a) The contractor shall strictly observe all safety rules and provide safety equipment to the
contract labours as per the factories Act, 1948, and whatever amendments made from time to
time to avoid any chance of accident. The contractor shall strictly observe all instructions of
safety officer and factory inspector to avoid any chance of accident.
(b) As per the nature of work in the contract, Helmets, safety goggles, apron, hand gloves, safety
shoes, safety belts, leather/asbestos apron should be made available during the execution of
work.
(c) All the lifting and material handling equipment used during working under this contract are
must be inspected and certified by the competent person authorized for the same and
certificate there of must be made available to the person intended to required for verification.
43. It is the responsibility of the contractor to ensure that contractor‟s employees maintain strict
discipline as regards security, methods of safe working etc, and not to cause any hindrance to
smooth running of power station or in execution of duties by GSECL staff. Any lapse in this
regard will be viewed seriously and contract is liable to be terminated. If any of contractor‟s
staff is found unsuitable or not behaving properly, the contractor shall have to remove him
from the work-site on demand by GSECL. The contractor shall have to strictly observe the
rules and conditions specified in the enclosed works contract booklet of the GSECL, which
are not modified hereunder. To keep harmonious industrial relations amongst contract labours
is the sole responsibility of the contractor. Any breach of the same will be viewed seriously.
44 The contractor, shall at their own expense make all necessary provision for housing water
supply and sanitary arrangement for their contract employee as well as for works and shall
pay direct to the authorities concerned all rates, and taxes.
45. The contractor shall make their own arrangements for the necessary approach road, for
transport of their materials and be responsible for the Compensation on account of damage to
crop on G.S.E.C.L. property.
46. All the royalty charges octroi other duties will be paid by the contractor and no extra could be
claimed on this account.
47. It will be absolutely incumbent on the contractors to have on the site of work only such of the
materials as have been duly passed by the Engineer-in-charge Materials that have rejected

must on no account be allowed to remain on the side and inspire-of written order to do so any
such rejected material is on the site beyond a period of 48 hours notice the Engineer-in-
charge shall have the right to remove it at the risk and cost of the contractor and even destroy
it.
48. It must be distinctly understood that the conditions of contract and of claims in respect of extra
work will not be allowed, unless the works to which they relate is clearly without the spirit and
meaning of the specifications or unless such work are ordered In writing by the Engineer-in-
charge and claimed for in specified manner.
49. On completion of the work, the site shall be cleared by the contractor within the stipulated
period, and ground brought to original stage and they shall not be entitled for any extra claim
on this account.
50. Damage causes to works
The work whether fully constructed or not, and all materials, machinery plant tools, temporary
building and other things connected there shall be at the risk and in the sole charge of the
contractor until the works have been delivered, completed to the Engineer-in-charge and
certificate form him to that effect obtained Until such delivery the contractor shall at their own
cost take all the precautions reasonably necessary to keep all the aforesaid works materials
machinery, plant, tools. Temporary building and other things connected with the work, free
from any loss or damage and in the event to the same or any part thereof being lost or
damage and in the event to the same or any part thereof being lost or damage shall from with
within possible speed, reinstate and make good such loss or damage at contractor's own
cost.
51. There will be generally no objection on the component parts of the works being given over to
responsible sub contractors but it must be borne in mind that this department would under no
circumstances recognize these sub contractors and responsibility of executing the work in
accordance with the condition of contract will entirely rest on the main contractors. The main
contractors will therefore always have the very responsible member preferably a technical
hand, present on the works with power to sign all work order issued on the site of work and to
take requisite actions in the interest of very efficient execution of works.
52. The work shall be carried out as per the standards and norms fixed by the G.S.E.C.L. i.e. the
Engineer in Charge or his authorized agent wherever it concern to the G.S.E.C.L. interest the
decision of C.E (C&O) shall remain, binding .
53. The work shall be carried out / executed according to the technical specification and
contractor shall make such changes as deemed fit from technical viewpoint by concerned
E.I.C. during execution.
54. The contractor will have to communicate the name of his authorized agent who shall be
presentation the works and shall be authorized to sign the materials requisitions receive
Instruction given verbally, or on the order book on behalf of the contractor.
55. The contractor will have to sign the conditions of contract and execute the agreement; pay up
the security deposits, failing to that the earnest money deposit will be for feted. The value of
the stamp paper and stamp duty charges shall be borne by the contractor.
56. The contractor must arrange for all transport of materials weighting of material issued at
department stores and all such cost include in the rates of schedule 'B' with the less or above
percentage quoted by the contractor for finished work.
57. The competent authorities can delete to any items in the schedule 'B‟ of the tender order if
they feel that the items is not essential to be executed.
58 Schedule of quantities is included in the tender document it shall definitely under stood that
the G.S.E.C.L. does not accept any responsibility for the correctness or completion or this
schedules and this schedule is liable to alterations by commissions, deductions or additions at
the description of the Chief Engineer of as set forth in conditions of contract specific
percentage less or above shall be quoted by the contractor below the total amount of
schedule „B‟
This tender notice shall form a part of contract
59. The entire work is to be completed within the stipulated time limit from the date of
commencement of work. You will not be eligible for any extra for the idle period of work or
waiting period that may be required to suit other considerations and no claim for
compensation on account of such will be considered. However in case of delay due to
circumstances beyond the control of contractor either in date of commencement or due to
waiting during construction extension time may be considered for completion of work.
60. In case contractor is unable to account for full quantity of materials issued to him from the

department stores, recovery will be effected from contractor‟s at cost rates or market rates
prevailing at the time of issue whichever is higher, plus 15% to cover G.S.E.C.L. departmental
supervision charges for all material unaccounted for.
61. The work shall be carried out by contractor as per the technical requirement to be worked and
in consultation with E.I.C. Contractor‟s responsible and qualified representative, who can
manage the site, shall remain present at SIKKA T.P.S round the clock for such consultation.
62 Supply of Electricity:
Electric supply if required the contractor shall be given at contractors cost as per GSECL
rules. Payment of bills for the same shall be made by contractor regularly within stipulated
time as per G.S.E.C.L. rules.
63. Should this tender be accepted I / We have agreed to abide by and full fill all the terms and
provision of "Tender and Contract of Works" as applicable and in de-fault there to fore-fit and
pay to the G.S.E.C.L the sum of money due.
64. The Work will have to be carried out in-co-ordination with other Agencies on the same site on
account of this in case the contractor has to stop or delay his works for same time, contractor
will not claim any thing extra only G.S.E.C.L. may consider to give suitable extension in time
limit if necessary on such account.
65. Any dispute arising out of the contract, if not settled mutually, than only the Vadodara court
shall have jurisdiction to settle & decided the dispute.
66. The GSECL reserves the rights to forfeit the SD in case of any breach of contract & in case of
disputes. The decision of Chief Engineer SIKKA TPS shall be final binding and acceptable to
contractor. If contractor fail to start the work as stipulated, the EMD & the SD shall be
forfeited.
67. The monthly payment to the labours must be paid before 10th day of succeeding month in the
presence of Labour Welfare Officer, SIKKA TPS. The copy of the same must be submitted
along with monthly R.A bill duly certified by the Labour Welfare Officer. The certificate should
contain detail of average no. of labours deployed, total wages, salaries paid and overtime
amount separately.
68. Submission of the bill by the contractor
Bills shall be submitted by the contractor for each month on or before 5th of every month for
the all the works, executed in the previous month.
Along with the R.A bills the contractor should submit material account wherever applicable,
proof of payment of provident fund and other statutory dues, certificate issued by IRO/LWO
certifying nos. of labours deployed during the month and total amount of wages and salaries
paid to labours. The R.A bills along with the supporting documents will be paid within 30 days
if possible.
69. Income Tax:
Income tax will be deducted at the source from each bill as per statutory requirements.
70. The GSECL will be entitled to deduct directly from the bills to be paid to the contractor any
sum or sums payable by the contractor and which sum/sums the GSECL is required to pay as
a principal employer on account of contractor‟s default in respect of all liabilities referred to in
above clauses.
71. (a) No sales tax, Professional tax or any other taxes, cess or levy, Excise duty, Octroi, royalty
or other duties will be payable by the GSECL against this contract.
(b) The rates of Schedule – B are exclusive of Service Tax. Service tax at prevailing rates, if
Applicable will be paid by GSECL extra on production of paid evidence / challan
73. The TDS at applicable rate as per section 57A and 57B of GST act shall be deducted from
Contractors‟ bills as per government rules.
74. Arbitration:
If at any time any question, dispute, difference, shall arise between the GSECL or the
engineer in charge and contractor or any person claiming through him upon or in relation to or
in connection with the matter herein before stipulated and specified to be referred to
arbitration, either party may forthwith give to the other a month‟s notice in writing of the
existence of such question, dispute or differences whatsoever, which may at any time arise
between the parties to this agreement, touching the agreement or subject matter thereof,
arising out or in relation thereto and whether as to construction or otherwise shall be referred
to the decision of the sole Arbitrator appointed by the chairman of G.S.E.C.L for the purpose,
who shall be a retired High Court Judge or a retired District and Session Judge, and upon the
parties reference to the arbitration act, 1940, as amended from time to time and the rules
therein. The Arbitration proceeding shall be conducted at G.S.E.C.L, Head office, Baroda, or

at such place as the sole arbitrator may determine. The award of the sole arbitrator (or
umpire) shall be final and binding upon the parties upon every or any such reference the costs
of and incidental to the reference and award respectively, shall be at the discretion of the
arbitrator or umpire who may determine the amount thereof or direct to the same to be taxed
as between party, and the party shall direct by whom and in what manner the same shall be
borne and paid, provided, however, that either party to be dispute shall in respect of any
monetary claim, be entitled to receive from the other party by way of cost any time exceeding
the percentage set out below, irrespective of the actual fees and expenses incurred by him.
Work under contract shall continue during the arbitration proceeding and no payment, other
than for matters in dispute due or payable by the purchaser, shall be withheld on account of
such proceedings.
The percentage above referred to in this clause is five percent on any such monetary award,
which does not exceed Rs. 10000/-, three percent on the next or any party thereof, two
percent on the next Rs. 50000/-, or any part thereof, and one percent on Rs. 40000/- or in
case it exceeds Rs. 100000/-.
75. Time limit:
The time limit for completion of this contract works, if awarded is one years from
commencement of work. The G.S.E.C.L can extend contract for further period of six
months after expiry of time limit, if desired by the G.S.E.C.L, at the same rate, terms &
conditions of awarded order of this tender, and quantity will be enhanced
proportionately.
76. The contractor shall quote only certain percentage of rates above or below the estimated
rates; i.e. contractor should quote either, say A% above the estimate or B% below the
estimate for all the items.
77 The rates quoted shall be firm.
78 Conditional tender is liable to be rejected. Withdrawal or insertion of conditions unilaterally
after opening of tenders will not be permitted unless it so desired by the GSECL.
79 Before starting the work, the contractor should contact Industrial Relation Officer/ Labour
Welfare Officer for all formalities and obtaining the gate passes of all contract labourers and
for other formalities.
80. The contractor shall deposit 15 days salary at the rate of last drawn salary for every
completed two years of services for each worker for the liabilities of the gratuity
