Re: Demand for Reimbursement

Dear Ms. _____________:

I write on behalf of my client _____________, and in relation to your non-performance

to repair the Toyota Hi-Ace Grandia which you accidentally hit and collided on.

The following narration is based on records that are in our possession:

On 1 Feburary 2016, at around 5:05 in the afternoon, the vehicle I am

riding (which I own) is traversing Ortigas Avenue near corner Wilson
Street and bound to Santolan Road when the vehicle you are driving (Ford
Everest Wagon) collided/hit the rear portion of my Toyota Hi-Ave
Grandia. This is consistent with the Traffic Accident Report duly signed
and prepared by the Philippine National Police Officers as well as the
Incident Record Form that you accomplished and signed on 1 February
2016. Be informed that you admitted “miscalculating the distance of his
move and I bumped his back there was a small dent made by the bump.”

Several oral demands have been made by my client for you to facilitate the repair the
Toyota Hi-Ace Grandia but the same was not performed to the prejudice and damage of
my client. You even ignored for several times the phone calls and text messages made
by my client when you should bear in mind that you are the offender in this instance.
As a consequence, my client was forced to proceed with the repair of the vehicle
because of the urgent need of the same and that my client cannot forever wait for you to
do the repair.

Hence, demand is hereby made against you to reimburse the expenses of the repair of
my client’s vehicle within ten (10) days upon receipt of this letter amounting to PESOS:
FIFTY FOUR THOUSAND FIVE HUNDRED SEVENTY SEVEN. Attached herein is
the detailed work description and the Official Receipt as provided by Toyota North
EDSA. Consider this a final and non-negotiable demand.

Be advised that there is strong legal authority to support a criminal case for malicious
mischief or reckless imprudence resulting to damage to property as well as damages,
attorney’s fees and costs. Should you fail to heed this demand, be assured that my
client will not hesitate to enforce her legal rights before the proper court.

We hope you will be guided accordingly.
