SWORN STATEMENT
2. That I was inside of the said vehicle during the said accident together
with Carmelita Agno, Jovelyn Banayat, Justin Banayat;
4. Afraid that one of the passengers had fell from the flatbed of the
vehicle, I instructed my son, JHON DEO C. BANAYAT, who was then
driving the vehicle to slow down and pull off at the right shoulder of
northbound lane;
6. While the vehicle was at rest at the shoulder of the northbound lane, I
asked the passengers at the flatbed what was the bang (kalampag)
sound all about;
7. That upon knowing that the new water jug has fallen from the flatbed,
I instructed my son JHON DEO C. BANAYAT, to make a U-turn to
retrieve the said water jug;
8. Soon after the vehicle was at a complete stop at the right shoulder of
the National Highway, Respondent turned the hazard light off and
turned the left blinkers/signal on, after which Respondent prepared
to commence the process of making a U-Turn.
9. When the pick-up truck was already about half-way and still on the
on the north-bound lane, Respondent and passengers suddenly saw,
heard and felt a motorcycle hit the left fender of the pick-up truck.
10. That the vehicle driven by JHON DEO C. BANAYAT has not moved
from its original position where the motorcycle driven by RICHELLE R.
SADIRI has bumped the same.
