WAIVER OF RIGHTS

KNOW ALL MEN BY THESE PRESENTS;

WE, RENE L. GIGANAN, of legal age, Filipino, a resident of Blk. 18, Lot 4, Amazon
St. Riverwalk, Villa Angela Subd., Bacolod City, Negros Occidental; and MERLE
GIGANAN VINLUAN, of legal age, Filipino, and a resident of #16 Soriano St.,
Poblacion, Lingayen, Pangasinan City, Negros Occidental, Philippines, after being duly
sworn to in accordance with law, depose and state THAT:

1. We are no longer interested to exercise our Right of Retention over the remainder
of a parcel of land, situated in the Barrio of San Rafael, Municipality of Hinoba-an,
Negros Occidental, covered by Transfer Certificate of Title No. P-12458 and
registered in the name of PRUDENCIO GIGANAN and MARIA LEONOR
LOCSIN GIGANAN containing a total area of, more or less, ONE HUNDRED
THREE THOUSAND ONE HUNDRED TWENTY-FOUR (103,124) SQUARE
METERS, and more particularly described as follows:

“A PARCEL OF LAND (LOT 6082, SGS-06-000847 BEING A


PORTION OF LOT 4147), SITUATED IN THE BARRIO OF SAN
RAFAEL, MUNICIPALITY OF HINOBA-AN, PROVINCE OF NEGROS

2. The aforementioned agricultural property was covered under the Comprehensive


Agrarian Reform (CARP) Law;

3. The Constitution grants landowners the RIGHT TO RETAIN a portion of their


lands covered by agrarian reform, which under the CARP, this retention right is
limited to a maximum of five hectares per landowner;

4. That we hereby voluntarily WAIVE our RIGHT TO RETAIN the remaining Five
Hectares of the above-mentioned agricultural property in accordance with PD 27
and RA 6657;

5. That we voluntarily offer the remaining Five Hectares of the above-mentioned


agricultural property for acquisition by the Department of Agrarian Reform;

6. That we hereby affirm that we have voluntarily executed this instrument out of
our own free will, without force, intimidation or violence from any person present
at the time of execution of this presents, nor anything which somehow may vitiate
our individual consent;

7. That we are executing this affidavit with full knowledge of the consequences
thereof, and for any legal purpose this affidavit may serve.

Principals further sayeth naught.
