Re: Co-Sponsorship Request – Allowing the State of Ohio to Use Seized Fentanyl as a
Death Penalty Drug

In the coming weeks, I plan to introduce legislation that will allow the State of Ohio -specifically
the Ohio Department of Rehabilitation and Corrections- to utilize seized fentanyl as a drug to be
administered in death penalty cases.

The appropriate drugs for death penalty administration have not been readily available for
quite some time. I believe that seized fentanyl (considered forfeited contraband through the
court system) is the best solution to this problem. In order to accomplish this, the Department of
Rehabilitation and Corrections will work in conjunction with the Drug Enforcement
Administration to obtain pre-existing seized fentanyl and the DRC will have set rules for
appropriate handling, testing, and administration of the drug.

If you would like more information, or are interested in co-sponsoring this legislation, please
contact Ben James – 614-466-1474, ben.james@ohiohouse.gov.

Thank you for your consideration.

Sincerely,

Scott Wiggam
State Representative
Ohio House District 1
