DON SERVILLANO PLATON MEMORIAL NATIONAL HIGH SCHOOL

to
GOA SCIENCE HIGH SCHOOL

IN THE DEPARTMENT OF EDUCATION – CAMARINES SUR DIVISION

KNOW ALL MEN BY THESE PRESENTS:

This agreement made and executed into this _________ day of _________ 2019 by and between:
The DON SERVILLANO PLATON MEMORIAL NATIONAL HIGH SCHOOL, a duly
established Secondary School in the Department of Education – Schools Division Office of
Camarines Sur with office address at Sta. Cruz, Tinambac, Camarines Sur represented herein by
its School Head GUILLERMO C. ORTUA JR., hereinafter referred to as the “FIRST PARTY”.

The GOA SCIENCE HIGH SCHOOL, a duly established Secondary School in the Department
of Education - School Division Office of Camarines Sur with office address at Tagongtong, Goa,
Camarines Sur represented herein by its School Head ROSEMARIE MIRAÑA, hereinafter
referred to as the “SECOND PARTY”

WITNESSETH

WHEREAS, Republic Act 9155 or the Governance of Basic Education Act of 2001 provides for
the Schools Division to supervise schools within the Division;
WHEREAS, the same Republic Act provides for the authority, responsibility, and accountability
of Schools Division Superintendent;
WHEREAS, among the authority, responsibility, and accountability of School Superintendent
includes planning and managing the effective and efficient use of all personnel;
WHEREAS, it is further provided in that Act that School Division Superintendent shall cause the
hiring, placing and evaluating all employees in the division, both teaching and non – teaching
personnel;
WHEREAS, this agreement is made in order to bind the parties according to their duties and
responsibilities as agreed upon by the relative to the aforesaid projects;
NOW, THEREFORE, for and in consideration of the above premises, the parties agree, through
their authorized officials, to enter into a Memorandum of Agreement under the following terms
and conditions:
I. ROLES AND RESPONSIBILITIES OF THE PARTIES

THE FIRST PART SHALL:

a. Analyze teachers need base on Teachers Need Assessment (TNA) result;
b. Determine number of excess new teacher items for deployment based on teachers
Need Assessment (TNA) analysis;
 c. Declare the total number of excess new teacher items;
d. Deploy two teachers namely MAY O. CLADO (Math) and SANDY B. ORTICIO
(MAPEH) to the SECOND PARTY;
e. Facilitate the carving of the excess new teacher items to the Personal Services
Itemization and Plantilla of Personnel (PSIPOP);
f. Assist in the transfer of the excess new teacher items to the Personal Services
Itemization and Plantilla of Personnel (PSIPOP) of the SECOND PARTY;
g. Report to the Office of the Assistant Schools Division Superintendent (ASDS) In-
charge for Secondary the herein agreement between the parties; and
h. Recall from SECOND PARTY such excess new teacher items should teacher needs
arise.

THE SECOND PARTY SHALL:

a. Analyze teachers need base on Teachers Need Assessment (TNA) result;
b. Determine number of excess new teacher items for deployment based on Teachers
Need Assessment (TNA) analysis;
c. Declare the total number of excess new teacher items NEEDED;
d. Accept the two newly deployed teacher items from the FIRST PARTY;
e. Assist in the immediate transfer of the excess new teacher items to the Personal
Services Itemization and Plantilla of Personnel (PSIPOP) of the SECOND PARTY;
f. Facilitate the enrolment of the newly deployed teacher items to the Personal Service
Itemization and Plantilla of Personnel (PSIPOP) from the FIRST PARTY;
g. Report to the office of the Assistant Schools Division Superintendent (ASDS) In-
charge for Secondary the herein agreement between the parties; and
h. Release such excess new teacher items should need arises in the FIRST PARTY.

II. EFFECTIVE AND VALIDITY

This Agreement shall take effect immediately upon approval and signing by the contracting
parties and attestation by the Schools Division Superintendent and shall remain in the force
an effect, unless sooner terminated.
IN WITNESS WHEREOF, the parties herein, acting through their representatives thereto
authorized, have caused this agreement to be signed in their respective names in,
________________________ Philippines on _________ day of ______________2019.
