Sub: Charge Sheet under Rule 16 of CCS (CCA) Rules, 1965 – Representation against
Ref: Your office Memo. No. F-4/I/2014 dated 22.10.2018

Respected Madam,

I have been proceeded against under Rule 16 of CCS (CCA) Rules, 1965
vide your office Memo. referred to above. The following charge has been levelled
against me:

“Smt. Santosh Kumari the then PA SBSO Ropar HO now PA Chandigarh while

working as PA SBSO Ropar HO for the period 21.05.2010 to 31.03.2014 was

failed to get verified the withdrawal for Rs 5000 in Ballamgarh Mandwara under

Mianpur SO from the concerned sub divisional head as required under Rule 85

POSB Manual Volume-I.

The details of Rs 5000 not verified is as under:

Due to non verification of withdrawals for Rs 5000/- of above made in


Ballamgarh Mandwara BO under Mianpur SO for the period 21.05.2010 to
31.03.2014 Smt. Santosh Kumari the then PA SBSO Ropar HO facilitated Smt.
Sharanjit Kaur BPM Ballamgarh Mandwara BO to commit misappropriation of
Rs 1065409.05. Had Smt. Santosh Kumari the then PA SBSO Ropar HO got
verified the above withdrawals, the fraud could have been detected timely as
provision contained in rules and further fraud could have been escaped.

It is therefore alleged that the said Smt. Santosh Kumari the then PA SBSO Ropar

HO has violated the provisions of Rule 85 of POSB Manual Volume-I and

thereby failed to maintain devotion to duty as laid down under Rule 3(1)(ii) of

CCS (Conduct) Rules, 1964”

2. My representation against the above charge sheet is as under:-

“It is respectfully submitted that the limit for verification of withdrawals from

Savings Accounts made at Extra Departmental Sub/Branch Post Offices and

Single Handed Post Offices has since been revised/increased from the existing

limit of Rs 5000/- to Rs 10,000/- vide SB Order No. 02/2013 issued by

Government of India, Ministry of Communications & IT, Department of Posts New

Delhi Communication No. 113-02/2001-SB dated 26.02.2013 (copy enclosed as

Annexure-1) and the above orders are applicable w.e.f. 01.03.2013 – which is

earlier than the alleged date of transaction in the above case viz., 02.07.2013.

Since the alleged withdrawal was made on 02.07.2013 for Rs 5000/-, and was

less than the revised limit of Rs 10,000/-, no further verification was required to

be made as per the amended rule as quoted above. Hence there is no violation

of Rule 85 of POSB Manual Volume-I as alleged against me”

I accordingly contend that the instant charge sheet issued vide your office

Memo. No. F-4/I/2014 dated 22.10.2018 is not justified and may kindly be

dropped in the interest of justice”
