Q: Mr. Witness in your residence, do you have any neighbors?

A: I only have one ma’am.
Q: Do you know the address of your neighbor?
A: Yes Ma’am, it is Block 7 Rainbow Hills Subdivision Baguio City
Q: Do you know the name of your neighbor?
A: No I only know that an old man is living in that house
Q:Ms Witness where were you in the evening of November 1, 2018?
A: I was at work during the evening of November 1, 2018 since my shift during that day is from 6:30
p.m. to 2:30 a.m
Q: Do you have any proof for that matter?
A: Yes I have here my DTR

Q:It appears from your DTR that you have reported out of work at 2:30 a.m., What did you do after
work?
A: I immediately went home
Q: What did you ride when you went home?(Objection-irrelevant)
A: I rode a taxi as I always do ## I always ride a taxi.
Q: How many minutes does it take for you to reach home?
A: I normally have a 30-minute travel ## Normally, it takes 30 minutes travel time.
Q: What time did you arrive in your house on November 2, 2018?
A: At about 3:15 a.m.
Q: What did you do thereafter?
A: I changed my clothes and prepared to sleep
Q: Were you able to go to sleep immediately?
A: No
Q: Why?
A: I was disturbed by a banging noise outside
Q: Can you identify the location of the noise?
A: yes
Q: where?
A: the banging noise came from my neighbor’s house
Q: After hearing the banging noise, what did you do next?
A: I immediately stood up and peeped through my window
Q: What did you see?
A: I saw a shadowy figure
Q: Where was this shadowy figure?
A: It was on my neighbor’s front door.
Q: After seeing the shadowy figure what did you do next?
A: I went back to attend to my personal necessities before going to bed.
Q: you did not even bother to know who was that banging on the door of your neighbor?
A: No. I presumed that it was just some relative, of the old man who went home late, and was locked
outside of their house.
Q: The banging on the door, can you describe it?
A: The banging was so loud. I could hear it even if our houses were about 50 meters away from each
other.
Q: Can you say that it is simply a knocking on the door?
A: NO. It’s not simply knocking on the door. It is a forceful banging on the door.
Q: You say forceful. So do you mean to say that it is an aggressive banging on the door, a situation
where you may believe that something dangerous might be happening during that time?

A: Yes.
Q: After you peeped out of your window, and gone back to attend to your personal routines, what did
you do next?
A: I am prepared to get some sleep already despite the continuous banging on the door from my
neighborhood. But to my surprise, I heard a gunshot.
Q: Where did the gunshot come from?
A: From the old man’s house.
Q: What did you do next after hearing the gunshot?
A: I started to realize that something wrong might have happened at the old man’s house. I called the
authorities to investigate the area.
Q: Did the authorities respond to your call?
A: Yes. It so happens that another person called them and reported the incident also.
Q: Who might have called the authorities ahead of you?
A: According to the police officer who received my call, certain ABE called to them reporting a
gunshot incident also. (objection- hearsay)
Q: Did the authorities arrive at the area?
A: Yes, and they started to investigate.

Q: Ms. Witness, you said that you arrived at 3:15 a.m., did you not?
A: Yes
Q: Considering your fatigue and urge to sleep, did this not compromise your consciousness to be able
to determine accurately what was happening in your surroundings, did it?
A: No I was fully aware of my surroundings despite my urge to sleep because of my fatigue.
Q: How can you be so sure that the sound was coming from your neighbor’s house?
A: In that part of the subdivision, there are no other houses nearby
Q: How about animals that may make unusual sounds?
A: There are none
Q: Were there any other people around at that time that may make a disturbing sound like that?
A: There are none except from the shadowy figure
Q: After hearing the gunshot, did you not have the chance to see what happened thereafter?
A: None, I was scared so I called the police but when I talked to them, there was already a caller
before me reporting the same incident.
