ORDER:
In the reference read above, the ENC(R&B) Admn.,A.P.,Vij., has informed
that Sri H.Bhima Simha, Dy.EE (R&B) while he was on deputation with NHAI, was
placed under deemed suspension w.e.f 27.10.2017 as he was detained on police
custody for more than 48 hours, vide NHAI Office Order No.11019/1975/2013-
Admn., dt:03.11.2017. While under suspension, he was repatriated to parent
department on 24.04.2018, vide NHAI Officer Order No.11019/1795/2013-
Admn.II, dt:26.04.2018. He has reported to ENC office on 07.05.2018, while he
was continuing under suspension. Later, the suspension was revoked with
retrospective date i.e., w.e.f 26.01.2018 vide NHAI Office Orders
No.11019/1795/2013-Admn, dt:27.06.2018. Further on revoking from suspension,
Sri H.Bhima Simha, Dy.EE (R&B) Q.C was posted as Deputy Executive Engineer
(R&B) Q.C. wing, O/o the Engineer-in-Chief (R&B) Vijayawada in the existing
vacancy, vide ENC Proceedings, dt:28.06.2018 and he joined duty on 29.06.2018

2. Further Sri H.Bhima Simha, Deputy Executive Engineer (R&B) Zone- I was
permitted to retire from Govt. Service on 30.06.2018 AN, on attaining age of
superannuation, pending finalization of the criminal case pending against him vide
ENC, lr No.1448/Ser.II(1)/2018, dt:28.06.2018.

3. The Engineer-in-Chief (R&B), Admn., Vijayawada has requested to accord

sanction for payment of provisional pension to Sri H.Bhima Simha, Deputy
Executive Engineer (R&B) Zone-I (Retired on 30.06.2018) for an amount of
Rs.38,734/- P.M i.e, equivalent to 75% of the admissible pension of Rs.51,645/-
P.M, payable with effect from 01.07.2018 FN under rule 52 of AP Revised Pension
Rules 1980 duly withholding D.C.R.G. in full pending finalization of the disciplinary
case/criminal cases pending against him.

4. Government, after careful consideration of the matter, hereby accord

sanction for payment of provisional pension for an amount of Rs.38,734/- P.M i.e,
equivalent to 75% of the admissible pension of Rs.51,645/- P.M, as a provisional
pension; as per the Accountant General,A.P.,Amaravati verification report with
effect from 01.07.2018 to Sri H.Bhima Simha, Deputy Executive Engineer (R&B)
Zone-I (Retired on 30.06.2018) under Rule 52 (1) (a) of Andhra Pradesh Revised
Pension Rules, 1980, duly withholding the D.C.R.G. in full, pending finalization of
the disciplinary case pending against him.

5. The Principal Accountant General (A&E), A.P., Amaravati is requested not to

release full pension and D.G.R.G. to Sri H.Bhima Simha, Deputy Executive Engineer
(R&B) Zone-I (Retired on 30.06.2018) till the disciplinary case pending against him
is finalized.

6. Sri H.Bhima Simha, Deputy Executive Engineer (R&B) Zone-I (Retired on

30.06.2018) is informed that the above orders are subject to the outcome of final
orders on the disciplinary case pending against him. He is also informed that, if
afterwards, it is found that the amount sanctioned is in excess of the amount, to
which he is entitled, he shall be called upon to refund such excess amount.

necessary further action in the matter accordingly.
