In principle, THE BARANGAY TANOD BRIGADE has proven to play a key


factor in maintaining peace and order in the barangays, and therefore should be
recognized as an effective community-based citizen’s involvement and initiatives
in promoting peace and order.

While it is recognized that the barangay tanods have risked their lives for
the security of the community, they are not properly compensated.
Consequently, it has become difficult for the barangays to recruit able-bodied
citizens to serve as barangay tanods.

The present challenges on peace and order in a fast growing City like
Dumaguete and the lack of police men to operate on the streets create an
urgent and compelling need to strengthen the cooperation between the City
Police, the City Government and the Barangays.

Also, considering the limited number of able-bodied barangay tanods for


every barangay due to lack of barangay funds and resources, this Ordinance to
institutionalize the Barangay Tanods in the City of Dumaguete in order to allow
the barangays to mutually help each other by sending their barangay tanods to
aid another barangay to prevent or suppress criminality, lawlessness and respond
to natural and human-induced disasters.

HENCE, IT IS THE VISION of this Ordinance that the Barangay is empowered


to be the first line of defense against crimes, bastion of disaster management,
sleepless assistant to those in need, and lives in the spirit of bayanihan with other
tanods in neighboring barangays in terms of aid and protection of their
constituents among others.

To achieve this vision, it is the objective of this Ordinance:

a. to professionalize the services of the barangay tanods by providing them


institutionalized capacitating trainings and adequate facilities

b. to standardize the compensation and benefits of barangay tanods.

c. to integrate whenever possible or align the program of the barangay


tanods with the bureaucratic system of the Dumaguete City Police, so that
they can be effective police force multiplier.

d. To establish a bayanihan system among barangays, by contributing their


barangay tanods in times of crisis or when the situation warrants.

e. To prevent criminality and reduce police response time by establishing


substations in the barangays headed by a policeman and aided by
barangay tanods;

f. To enhance the awareness in the barangay level on matters of security and
public safety:

g. To empower the barangay, with the aid of its tanods, in enforcing


ordinances of the City through deputation of barangay tanods to issue
citation tickets;

h. To augment the compensation of barangay tanods and enhance their


facilities from the penalties generated by the citation tickets issued by the
barangay;

With the objectives of this Ordinance, the Barangays of Dumaguete City


will be empowered to prevent criminality and respond to multiple crisis situations.

RESOLVED, AS IT IS HEREBY RESOLVED, to enact the following Ordinance:

“AN ORDINANCE ESTABLISHING THE CRISIS MANAGEMENT TEAM IN THE


BARANGAYS AND PROFESSIONALIZING THE BARANGAY TANODS IN
DUMAGUETE CITY, CAPACITATING THEM WITH THE AUTHORITY TO ISSUE
CITATION TICKETS AND APPROPRIATING FUNDS THEREFOR.”

Section 1. TITLE – This Ordinance shall be known as the “BARANGAY CRISIS


MANAGEMENT ORDINANCE.”

Section 2. THE CRISIS MANAGEMENT TEAM - There shall be established a


Crisis Management Team (CMT) in every barangay composed of the Punong
Barangay as Team Leader, the Police Sa Barangay and Chief Tanod as assistant
team leaders, and the barangay tanods as members. To this end, the City
Government of Dumaguete, through the Honorable Mayor, is hereby authorized
to negotiate and enter into a memorandum of agreement with the Dumaguete
City Police Office in engaging in assigning uniformed personnel to actively take
part in the Crisis Management Team.

The Crisis Management Team shall operate on a twenty four (24) hour basis,
and shall perform the following functions:

1. To establish a barangay based crime prevention program and criminal


detection system. The same shall be submitted to the City Peace and
Order Council, the City Mayor and the Committee on Peace and Order of
the Sangguniang Panlungsod;

2. To establish a community-based mechanisms where private citizens can


actively participate in promoting peace and safety in the barangay;

3. To act as first responders to any crisis in the Barangay, including man-made
or natural calamity;

4. To enforce City Ordinance, Barangay Resolutions and applicable laws as


part of a proactive peace and order initiatives, and to issue citation tickets
against violators therefor;

5. To assist traffic aides in traffic decongestion;

6. To perform other functions as may be directed by the BPOC, the CPOC and
the City Mayor;

Section 2. THE BARANGAY PEACE AND SECURITY OFFICER – The Barangay


Tanod are hereafter called the Barangay Peace and Security Officer (BPSO for
brevity). The BPSO shall be appointed by the Punong Barangay upon
recommendation of the Barangay Peace and Order Committee (BPOC). Upon
appointment of the BPSO, the BPOC shall report the appointments of the BPSO to
the City Peace and Order Committee (CPOC). Whenever possible, the BPOC
shall recommend candidates for BPSO from among the residents of their
barangay;

Section 3. QUALIFICATIONS OF BARANGAY PEACE AND SECURITY OFFICERS–


In order for the BPSO to function effectively, in addition to the established
qualifications of a barangay tanod under the Local Government Code, they shall
undergo and finish the training programs set by the CPOC which includes among
others:

a. Basic crime fighting and self defense;


b. Proper enforcement of ordinances and issuance of citation tickets;
c. Basic rules on evidence and how to testify in Court;
d. First Aid;
e. Rescue, man-made or natural disaster response;
f. Basic Fire Fighting;
g. Other related relevant trainings.

For this purpose and for purposes of economy, the City Government may
partner with academic institutions in providing the above-mentioned training
program. The training program shall commence not later than one (1) year from
implementation of this Ordinance.

On Year 2020, there shall be a mandatory continuing training program of


BPSO’s which shall be a basis for their continued employment.

The CPOC may create an Ad Hoc Committee to draft the syllabus of the
training program.

SECTION 4. INTER-BARANGAY MUTUAL ASSISTANCE or “BAYANIHAN” – In


pursuit of the mandate of the Crisis Management Team, the Punong Barangay
may deploy the BPSO to the requesting barangay to augment its crisis
management initiatives. The request for assistance shall be formally addressed
to the Punong Barangay of the aiding barangay prior to deployment.

When a barangay is in crisis or extreme situation when formal request for
assistance to the aiding barangay is not practicable, the Punong Barangay of the
barangay-in-crisis may informally request for assistance from the aiding barangay
for the deployment of its BPSO to provide assistance to the barangay-in-crisis.

SECTION 5. COMPENSATION – The Barangay Council, through a resolution,


shall determine for the compensation of the BPSO. The CPOC, on the other hand,
shall determine the compensation or Honorarium to be given to other members
of the Crisis Management Team.

SECTION 6. CITATION TICKETS – The BPSO shall be deputized to enforce all


ordinances and issue citation tickets against violators thereof. The BPSO shall
remit to the Office of the Punong Barangay all duplicate copies of the citations
not later than 24 hours from issuance.

SECTION 7. PROCEDURE TAKEN ON CITATION TICKETS – The Punong


Barangay, as Team leader of the Crisis Management Team, may summon all
violators of ordinances within his/her jurisdiction and require the latter to settle the
penalties pay paying the same to the barangay treasurer. For this purpose, the
City Government, whenever allowed by auditing rules, may deputize the
barangay treasurer to accept settlement of penalties. In turn, the barangay
treasurer shall remit all collections to the City Treasurer within 24 hours from receipt
thereof.

The violator is obliged to pay the administrative fine imposed on the


violation mentioned in the citation ticket within thirty six (36) hours from receipt
thereof. Beyond the period given, all unsettled citation tickets and evidence
establishing the violation shall be transmitted to the City Legal Office for
appropriate legal action.

Appropriate legal action against violators, including filing of criminal


complaint, shall be undertaken by the City Legal Office within a reasonable time
from receipt thereof and prior to prescription of the infraction.

SECTION 8. INFORMATION AND EDUCATION DRIVE – Within six (6) months


from the approval of this Ordinance, the Barangay Council shall conduct a
massive information and education drive in all the puroks in the barangays to
inform the residents of what ordinances are to be observed and the penalties for
their violation.

To achieve this end, the CPOC shall formulate and produce the education
material to be used in educating the residents in the barangay.

SECTION 9. THE TRUST FUND – All income derived from the citation tickets
issued by the barangay tanods shall form part of a trust fund solely intended for
the effective implementation of this Ordinance. The Trust Fund shall be
appropriated in the following manner:

a. Fifty Percent (50%) shall go to the remitting barangay which shall cover the
compensation of the BPSO, and the remainder of which may be used by the
barangay to fund peace and order initiatives and crisis management
programs in the barangay.

b. Fifty Percent (50%) shall go to the City Government which shall be used to:

b.1. Augment the compensation or honoraria of the other members of the


Crisis Management Team, deputized law enforcers and members of the
judiciary;

b.2. Purchase equipment, gadgets and facilities to aid the CMT in effectively
implementing the purposes of this Ordinance, and for such other purposes that
may ensure the effective implementation of local ordinances.

SECTION 10. INITIAL FUND – An initial fund of ONE MILLION PESOS


(PhP1,000,000.00) shall be appropriated to cover the initial implementation of this
Ordinance taken from the CPOC fund. Said amount may be appropriated to
the barangays in pursuit of this Ordinance upon the recommendation of the
CPOC.

SECTION 11. SEPARABILITY CLAUSE – If any provision, or part hereof, is held


to be invalid, the remainder of this ordinance shall not be affected thereby.

SECTION 12. REPEALING CLAUSE – All provisions of existing Ordinances


inconsistent herewith are repealed.

SECTION 13. EFFECTIVITY – This Ordinance shall take effect immediately


upon its approval and due publication in a newspaper of general circulation.
