The right to be forgotten is a concept that was discussed and practiced in the European Union and Argentina at the

very end of the century . It allows an individual to request the withdrawal of certain information that could harm
him or her in actions that he has done in the past. The right to be forgotten applies concretely either by the withdrawal of
the information on the site of origin, one speaks about the right to the erasure, or by a dereference of the website by the

search engines , one talks about then the right to dereference .

The right to be forgotten is the product of more than 10 years of work of the European institutions, from the Data
Protection Directive in 1995 to a new work since 2012 which resulted in the decision of the Court of Justice of the
European Union of 13 May 2014 devoting a right to be forgotten in Europe.
The Directive thus specifies by defining them notions such as 'personal data', 'processing' of such data, 'responsible' and
'consent of the data subject'. The person responsible must ensure that the data are "collected for specific purposes", "not
excessive in relation to the purposes for which they are collected" and "kept in a form that allows the identification of data
subjects for no longer than not that necessary to achieve the purposes for which they are collected. Finally, the Directive
provides that "(...) treatment can only be carried out if (...) the data subject has unambiguously given his or her consent".
It is on this directive that the European Court of Justice relies to devote what is now called the right to be forgotten.
This initiative culminated on January 25, 2012 with the publication by the European Commission of a European
regulation proposal for data protection (in English : General Data Protection Regulation ). The text is subsequently
amended by the European Parliament and the Council of Ministers. It is voted on 12 March 2014 by the European

Parliament and transmitted by its president to the Council of Ministers and to the Committee . Its adoption was planned

for the beginning of 2015 to begin to apply in 2017. It provides :

that the rules of the Union apply even if the processing of personal data is "abroad by companies established on
the European market and offering their services to citizens of the Union",
a "single body of rules" to remove "unnecessary administrative obligations" which would represent an "annual
saving of (...) EUR 2.3 billion",
that the consent of the subject "shall be given explicitly",
strengthen the powers of the independent national data protection authorities
penalties of up to EUR 100 million or 5% of the company's overall annual turnover,
the obligation of portability of personal data.
Google Inc. is not subject to the Privacy Directive 95/46 / EC and Google Spain is not responsible for Google Inc.'s
search engine activities.
The activity of a search engine does not include processing of personal data,
None of the entities of Google can be considered as "data controller" as defined by Directive 95/46 / EC on the
protection of personal data ,
There is no right of withdrawal or deletion of legally published data.
On the question of the "territorial scope of national data protection legislation", Mr Jääskinen proposes that the
Court declare "that national data protection legislation is (...) applicable to the protection of personal data". an
Internet search engine service provider when it creates, in a Member State, for the purpose of promoting and
selling advertising space offered on the search engine, a branch or subsidiary whose activity targets the inhabitants
of that state. "
On Google's "legal position as an internet search engine service provider", such a provider "can not, in law or in
fact, fulfill the data controller's obligations under the Directive with respect to personal data on source web pages

Characterization of a search engine as data controller: "the activity of a search engine consisting in finding
information published or placed on the Internet by third parties, automatically indexing it, temporarily storing them
and, finally, making them available to internet users in a given order of preference must be qualified as "processing
of personal data" (...) and (...) the operator of this engine must be regarded as the "person in charge" of that
treatment,
On the territorial scope of Directive 95/46 / EC on the protection of personal data : "processing of personal data is
carried out within the framework of the activities of an institution of the person responsible for that processing in the
territory of 'a Member State ... where the operator of a search engine establishes in a Member State a branch or
subsidiary to promote and sell advertising space offered by that engine and whose activity is aimed at the
inhabitants of that Member State ',
On the question of a right to be forgotten: "the operator of a search engine is obliged to remove from the list of
results, displayed after a search made from the name of a person, links to web pages, published by third parties
and containing information relating to that person, (...) even when their publication in itself (...) is lawful ",
Finally, the Court of Justice adds that these rights take precedence over "the economic interest of the search
engine operator" and "on the public interest in accessing that information", unless, because of the "The role played
by that person in public life", "the interference with his fundamental rights is justified by the overriding interest of that
public".
The decision of the Court of Justice thus grants individuals the right to object to the processing of their personal data and
to request the dereferencing of links that appear in a search associated with their name, while taking into account the
overriding interest of the public to have access to information.
On May 31, 2014, the first day this form was available, Google reportedly received more than 12,000 requests from
European citizens. Two months later, at the end of July, France was at the top of the list with 17,500 applications , ahead

of Germany ( 16,500 applications ) and the United Kingdom ( 12,000 applications ) . At the end of July, out of a total of
91,000 requests for more than 328,000 links , Google removed more than 150,000 links, asked for additional information
for 15% of requests and rejected the remaining 30%. However, on December 19, 2014, Google is sentenced for the first

time in France for rejecting a request to delete a link to a 2006 Parisien article .

In France, the person responsible for the site where the information is present has a legal deadline of two months to

respond to the complainant's request. In case of no reply or refusal, the complainant may file a complaint with the CNIL
.

There is a Children's Online Privacy Protection Act in the US, and a Do Not Track Kids Act (in) which was in 2013 in
negotiations subcommittee communications and technology United States Congress in 2013.

The OECD Directorate for Science, Technology and Innovation offers a list of recommendations on respect for privacy .
Google enlève les liens des résultats de recherche incriminés uniquement dans les versions européennes de son moteur de
recherche (google.fr, google.it, ...), vers lesquels ils redirigent activement les citoyens européens au lieu de google.com. Le
retrait s'effectue donc dans tous les pays de l'Union européenne mais pas au niveau mondial, et seulement lorsque les
termes de la recherche contiennent le nom de l'individu.
Sur les critères utilisés par Google pour trouver l'équilibre entre leur intérêt économique ainsi que l'intérêt général du
public d'avoir accès à l'information et le droit au retrait des résultats de recherche, Google répond que leur intérêt
économique n'a pas d'impact pratique ou direct lorsqu'ils considèrent une demande de retrait. Ils mentionnent comme
critères le fait que les informations sont trop vieilles ou trop peu pertinentes, ainsi que si le demandeur est un personnage
public ou non, la qualité, officielle ou non, du site vers lequel pointe le lien ainsi que le contenu de l'information disponible
dans chacun des liens (s'il s'agit d'un contenu politique, s'il a été publié par le demandeur, si l'information est de nature
professionnelle ou criminelle). L'entreprise souligne trois difficultés, en particulier le fait que certaines cours de justice des
États membres de l'UE publient des décisions incluant les noms des parties alors que d'autres ne publient des décisions
qu'une fois celles-ci anonymisées, qu'il est plus difficile sur Internet que dans la presse papier ou à la télévision d'évaluer la
fiabilité d'une source journalistique et enfin qu'il est difficile de faire la différence entre ce qui relève de la vie politique
d'un pays et ce qui relève d'une simple activité politique de la part des citoyens.

En ce qui concerne la notification des tiers qui ont publié les contenus déréférencés, Google entend continuer à leur
communiquer lorsqu'ils déréférencent ces contenus, pour des raisons évoquées de transparence ainsi que pour laisser la
possibilité d'un recours sur leur décision était erronée. C'est ainsi que Google entend améliorer l'équilibre trouvé entre les
différents critères du paragraphe précédent. Enfin, Google cite le cas particulier d'entreprises ou de sites web qui
demanderaient le retrait des pages les plus populaires de leurs concurrents afin d'en réduire le trafic.
Commission européenne
La Commission européenne soutient la direction prise par la Cour de justice en soulignant depuis 2012 les bénéfices
apportés par une réforme des règles de protection des données personnelles, parmi laquelle le droit à l'oubli devrait
figurer.
Si la nouvelle Commission de Jean Claude-Juncker ne s'est pas prononcée officiellement sur le sujet, le nouveau vice-
président de la commission et Commissaire à l'économie et à la société numériques, Günther Oettinger, affirme, dans sa

déclaration devant les parlementaires , qu'il entendait défendre un tel droit aussi longtemps que nécessaire.

Dans une tribune publiée dans Le Figaro le 11 juillet 2014 , David Drummond exprimait son désaccord avec cette
décision, estimant qu'un « débat solide est indispensable car sur cette question aucun moteur de recherche n'a trouvé à ce
jour de réponse immédiate ou parfaite » et évoquant les mesures prises par Google afin de se conformer au droit ainsi que
les difficultés rencontrées.

Il annonçait également la mise en place un comité consultatif , afin de « trouver le juste équilibre » et « être conseillés
sur les principes à appliquer pour [se] prononcer sur chaque cas ». Ce comité s'est réuni à Madrid, Rome, Paris, Varsovie,

Berlin, Londres et Bruxelles, lors de sessions enregistrées et disponibles sur leur site . Ce comité s'interroge notamment

Le droit à l'oubli peut entrer en conflit avec d'autres droits, dont ceux de l'information et de l'expression. L'équilibre entre
ces différents droits font l'objet de critiques.
La Wikimedia Foundation, l'hébergeur de Wikipédia dont des articles sont concernés par le droit à l'oubli imposé à
Google, accuse la Cour de justice de l'Union européenne de « perforer l'accès au savoir ». Jimmy Wales, le cofondateur de

Wikipedia, parle d'une « loi complètement folle et qui doit être réparée » dans un article publié sur The Observer .
