CASE UPDATE

Dear sir,

This is a summary of what had transpired so far since the complaint-

affidavit was filed before the Office of City Prosecutor, Paranaque City.

On June 13 and 20, 2019, the preliminary investigation for the complaint
was set. However, the respondents did not appear on both occasions. The
assistant city prosecution, for the last time, set the hearing for preliminary
investigation on July 18, 2019. On this scheduled hearing, the counsel of
Respondent Asidao’s counsel appeared before the Honorable Prosecutor, and
requested that he be given days to file which was set on July 31, 2019. The
Honorable Prosecutor granted his request against the objection of the
complainants’ counsel. On July 31, 2019 Respondent Asidao appeared before the
Honorable Prosecutor and submitted his Counter Affidavit. Thereafter, the
complainants were required to submit their Reply-Affidavit on August 14, 2019.
On August 14, 2019, all the complainants appeared before fiscal
Mondragon to file their reply. No one on the part of the respondents appeared
except a representative who requested that the respondents be given time to file
their reply. The complainants objected on the ground that such request is a mere
dilatory tactic on the side of the respondents. Considering that the case has been
pending before the prosecutor for two months, the prosecutor denied the
request. Hence, the instant case is submitted for resolution.
