DECISION

This is petition filed on October 18, 2012 for the Approval of Sale and Transfer of a Certificate Public
Convenience to Operate a SCHOOL Service under Case No. 2012-CAR-947 for the transportation of students on
the line: FROM AND TO THEIR RESIDENCES TO THEIR RESPECTIVE SCHOOLS WITHIN BAGUIO
CITY AND BENGUET with the use of one (1) unit hereinafter described, which Certificate expires on OCTOBER
20, 2015.

In compliance with the rules of Practice and Procedures before the Land Transportation Franchising and
Regulatory Board, applicant submitted the Affidavit of Publication issued by the publisher of the Junction, a
newspaper clipping of the notice of hearing as published and the page of the newspaper where said notice
appears.

Notwithstanding its publication, no one filed any written opposition nor appeared at the hearing to controvert
the same, hence, the same is considered uncontested.

From the evidence submitted, it shows that the applicant-vendee is a Filipino citizen; that the applicant-
vendee is legally qualified and financially capable to meet the requirements and responsibilities that are inherent to
the operation of the service; and that the service will further promote public necessity and convenience in a proper
and suitable manner due to public demand for transport service along the route or area of operation intended.

WHEREFORE, by virtue of Section 16(a) of Commonwealth Act No. 146, as amended and Executive
Order No. 202, dated June 19, 1987, this Board hereby APPROVES the aforecited application. Let a
Certificate of Public Convenience be issued authorizing the applicant-vendee DANILO SALVADOR to operate a
SCHOOL service for the transportation of students on the line FROM AND TO THEIR RESIDENCES TO
THEIR RESPECTIVE SCHOOLS WITHIN BAGUIO CITY AND BENGUET with the use of one (1) unit
described hereunder, to wit:

Applicant is hereby required to register the herein authorized units under HIRE denomination with the
BAGUIO CITY Agency of the Land Transportation Office and to show proof of registration to the Management
Information Division(MID) of the Board within thirty (30) days from receipt of a copy hereof. The Land
Transportation District Officer of said Agency, however, shall cause the inspection of applicant’s unit and accept
it/them for registration only if found fit for public service.

In the operation of the service, the operator shall observe and comply strictly with the requirements of law
of public transport services, and with any Provincial Resolution, Municipal or City Ordinances or Traffic Regulation
and to conform to duties imposed upon him as well as, the conditions of the Board hereof.
This Decision takes effect immediately and shall become final thirty (30) days after due notice to the parties.
